To file for temporary guardianship in North Carolina, you file two documents at the same time with the Clerk of Superior Court in the county where the respondent lives: the Petition for Adjudication of Incompetence (Form AOC-SP-200) and a verified motion asking the Clerk to appoint an interim guardian under N.C.G.S. 35A-1114.1North Carolina General Assembly. North Carolina General Statutes 35A-1114 – Appointment of Interim Guardian If the Clerk grants the motion after a hearing, the court issues Form AOC-E-421, the Letters of Appointment that prove the temporary guardian’s authority to hospitals, banks, and government agencies.2North Carolina Judicial Branch. When the Clerk Will Appoint an Interim Guardian
A temporary guardian exists to bridge the gap between the day you file the incompetency petition and the day the full hearing happens, which may be weeks away. The Clerk of Superior Court has original jurisdiction over all guardianship and incompetency proceedings in North Carolina, so the Clerk, not a Superior Court judge, decides whether that bridge is needed.3North Carolina Industrial Commission. North Carolina Code 35A-1203 – Jurisdiction; Authority of Clerk
Your interim motion has to lay out facts showing three things:
- Reasonable cause to believe the respondent is incompetent. Specific observations or medical evidence, not a general sense that something is wrong.
- Imminent or foreseeable risk of harm. Either the respondent’s physical safety is in play (wandering, refusing critical medication, being exploited) or their finances face serious and immediate danger (accounts being drained, bills unpaid, property at risk of loss).
- A need for immediate intervention. The situation cannot safely wait for the full adjudication hearing.
If the Clerk is satisfied on both the incompetence and the risk, the Clerk enters an order appointing a temporary guardian and issues AOC-E-421.1North Carolina General Assembly. North Carolina General Statutes 35A-1114 – Appointment of Interim Guardian The Clerk can also appoint an interim guardian without a motion if that need becomes clear during the full hearing itself.
What to File and Where
Form AOC-SP-200 is the main petition. Its full title is “Petition for Adjudication of Incompetence and Application for Appointment of Guardian or Limited Guardian.”4North Carolina Judicial Branch. Petition For Adjudication Of Incompetence And Application For Appointment Of Guardian Or Limited Guardian Any person can file it, including family members, friends, healthcare providers, and state or local human services agencies. Agencies and healthcare providers can file without an attorney.5North Carolina General Assembly. North Carolina General Statutes 35A-1105 – Petition Before Clerk The petition must be verified, meaning signed under oath, and it needs to include:
- The respondent’s full legal name, date of birth, residential address, and mailing address.
- Your relationship to the respondent and why you are bringing the petition.
- A factual basis for incompetence: specific behaviors, diagnoses, or incidents showing the respondent cannot manage their own affairs or make important personal decisions. Concrete examples carry weight. “Was found wandering on the highway at 2 a.m. on three occasions in January” says much more than “seems confused.”
- The type of guardian requested: a guardian of the person, a guardian of the estate, or a general guardian who handles both.6North Carolina Judicial Branch. Guardianship
- An inventory of the respondent’s assets, income, and liabilities, especially if you want a guardian of the estate or a general guardian.
- Names and addresses of next of kin: spouse, parents, adult children, and siblings. The court uses this list to send notice.
- The name and qualifications of the person or entity you want appointed.
Alongside AOC-SP-200, file your verified motion for appointment of an interim guardian. The motion is where you lay out the imminent-risk facts described above. If the main petition is already pending, the respondent’s guardian ad litem can file the interim motion later if the emergency develops after filing.
The filing fee is set by N.C.G.S. 7A-307. The base is $120: $10 for courthouse facilities, $4 for telecommunications, and $106 for General Court of Justice support.7North Carolina General Assembly. North Carolina Code 7A-307 – Costs in Administration of Estates On top of that, add 40 cents per $100 of the respondent’s gross estate, capped at $6,000. Clerk’s offices typically take cash, certified checks, and money orders.
Serving the Respondent and Notifying the Family
Two five-day clocks start when you file.
Within five days, the Clerk issues a written notice setting the hearing on the full petition, which must fall between 10 and 30 days after the respondent is served. The sheriff personally serves the respondent with copies of the petition, the notice of hearing, and a notice of the respondent’s legal rights, and does so without requiring fees in advance.8Dare County, NC. Guardianship and Incompetency
Also within five days of filing, you must mail copies of the petition, the notice of hearing, and the notice of rights to every next of kin listed in the petition, plus anyone else the Clerk designates. First-class mail is sufficient. You then file an affidavit with the Clerk confirming the mailing, or recipients can file a certificate accepting notice. Missing a close relative or skipping this step is one of the fastest ways to get the case delayed or dismissed. Stripping someone’s legal rights is not something the court will let happen quietly.
The Interim Hearing and What AOC-E-421 Does
The Clerk holds a separate hearing on the interim motion, usually on an expedited basis given the urgency the motion alleges. If the Clerk finds the facts support appointment, the Clerk enters the order and issues the Letters of Appointment on Form AOC-E-421. The form is governed by N.C.G.S. 35A-1121, 35A-1203, and 35A-1206.2North Carolina Judicial Branch. Letters Of Appointment Temporary Guardian
AOC-E-421 is the temporary guardian’s credential. Present a certified copy to the hospital to make medical decisions, to the bank to freeze or manage accounts, to the landlord, to a government agency. The powers granted are those spelled out in the Clerk’s order, which may be narrower than the full powers a permanent guardian would hold, since the appointment is meant to address a specific risk during a limited window.
The Guardian ad Litem for the Respondent
Once the petition is filed, the Clerk appoints an attorney as guardian ad litem for the respondent, unless the respondent has already retained their own lawyer, in which case the appointed guardian ad litem may be discharged.9North Carolina General Assembly. North Carolina General Statutes 35A-1107 – Right to Counsel or Guardian ad Litem Representation is not optional in these proceedings. The guardian ad litem personally visits the respondent, explains their rights, finds out what the respondent actually wants, and presents those wishes to the Clerk at every stage. If the attorney believes the respondent’s expressed wishes conflict with the respondent’s best interest, the attorney can make separate recommendations, but the respondent’s own voice comes first.
What Comes After the Temporary Letters Issue
AOC-E-421 is temporary by design. The full incompetency hearing is still ahead, and the standard of proof there is clear, cogent, and convincing evidence that the respondent lacks sufficient capacity to manage their own affairs or to make and communicate important decisions.6North Carolina Judicial Branch. Guardianship The respondent can request a 12-person jury. If no one requests a jury, the Clerk decides. If the evidence falls short, the Clerk dismisses the case. If it meets the standard, the Clerk adjudicates incompetence and appoints a permanent guardian.8Dare County, NC. Guardianship and Incompetency
A guardian of the estate or general guardian, whether temporary or permanent, cannot pick up their letters until a surety bond is posted. The Clerk sets the bond based on the value of the ward’s personal property plus the rents and profits from any real estate. A surety-backed bond must be at least 1.25 times that value; a bond with personal sureties must be at least double. For estates over $100,000, the Clerk may accept a bond set at 110% of the determined value.10North Carolina General Assembly. North Carolina General Statutes 35A-1231 – Terms and Conditions of Bond Annual surety premiums generally run between 0.5% and 10% of the bond amount, depending on the guardian’s credit and the size of the estate.
Within three months of appointment, the guardian files a sworn inventory of the ward’s entire estate with the Clerk. The Clerk can extend that deadline up to six months for good cause.11North Carolina General Assembly. North Carolina Code Chapter 35A Article 10 – Returns and Accounting After the initial inventory, annual accounts are due within 30 days of the close of the guardian’s chosen fiscal year, with supporting bank and investment records attached.
One Thing Court Appointment Does Not Give You
Being appointed temporary guardian does not make you the ward’s Social Security representative payee. The Social Security Administration does not recognize state-court guardianship orders for this purpose and makes its own decision about who should receive and manage benefits. If the ward collects Social Security, apply separately through your local SSA office. Once appointed as payee, you file an annual Representative Payee Accounting Report.12Social Security Administration. Internet Representative Payee Accounting Report
