To file for an uncontested divorce in Oklahoma, one spouse must have lived in the state for at least six months, both spouses must agree on every issue in the case, and the filing spouse submits a petition along with a signed waiver from the other spouse and a proposed decree. A childless case can finalize in as little as ten days; a case with minor children requires a 90-day wait unless the judge shortens it.1Justia. Confirm You Can File in Oklahoma
Two separate geographic rules apply. For residency, either you or your spouse must have been an actual resident of Oklahoma for at least six continuous months immediately before filing. Military members stationed at an Oklahoma post or reservation for six months also qualify.2Justia. Oklahoma Code 43-102 – Residence of Plaintiff or Defendant
For venue, you file in the county where you have lived for the 30 days before filing, or in the county where your spouse lives.3Justia. Oklahoma Code 43-103 – Venue for Any Action for Divorce, Annulment of a Marriage or Legal Separation Filing in the wrong county won’t kill your case, but it will likely get transferred and set you back.
Agree on Everything First
A case stays uncontested only if you and your spouse agree on every term the decree will include: how property and debts are divided, whether either spouse pays or receives alimony, and all custody, visitation, and support arrangements for any minor children. Disagreement on even one issue converts the case into a contested divorce, with longer timelines and the possibility of a trial.
The legal ground for an uncontested case is almost always incompatibility, Oklahoma’s no-fault option.4Justia. Oklahoma Code 43-101 – Grounds for Divorce Neither spouse has to prove the other did anything wrong.
Prepare the Core Documents
Four documents form the backbone of the filing.
The Petition for Dissolution of Marriage opens the case. It states both spouses’ names, the date and place of the marriage, whether minor children were born during the marriage, the ground for divorce, and what you want the court to order.
The Entry of Appearance and Waiver of Summons is signed by the non-filing spouse. It confirms they know about the case, have a copy of the petition, and give up the right to formal service and further notices. This waiver is where “waiver divorce” gets its name.
The Servicemembers Civil Relief Act affidavit is required by federal law before any default-style judgment. The filing spouse must state whether the other spouse is currently serving in the military, is not serving, or whose status cannot be determined.5Office of the Law Revision Counsel. 50 USC 3931 – Protection of Servicemembers Against Default Judgments A false affidavit is a federal crime punishable by up to one year in prison.
The Decree of Dissolution of Marriage is what the judge signs to end the marriage. It spells out every term you and your spouse have agreed to, from property division to a parenting schedule. Draft it carefully. Once signed, changing it requires a separate motion and a good reason.
Add the Children’s Paperwork If Applicable
A divorce involving minor children carries extra requirements that catch many filers off guard.
UCCJEA Affidavit
Both parents must file an affidavit under the Uniform Child Custody Jurisdiction and Enforcement Act listing where each child has lived for the past five years, every person the child has lived with, and any other proceedings that could affect custody, including protective orders and termination-of-parental-rights cases.6Justia. Oklahoma Code 43-551-209 – Information to Be Submitted to Court The point is to confirm Oklahoma is the right state to decide custody and that no conflicting order exists elsewhere.
Child Support Computation
Oklahoma calculates child support from both parents’ combined gross income, with each parent responsible for a share matching their percentage of the couple’s adjusted income.7Oklahoma Department of Human Services. Guidelines and Computation You complete a Child Support Computation form using the state’s guideline schedule. Even in an uncontested case, the judge checks whether your agreed amount matches the guidelines, and if it doesn’t, you may need to justify the deviation as being in the child’s best interest. The form also accounts for health insurance premiums, childcare, and extraordinary medical costs, so have recent pay stubs, tax returns, and premium documentation ready.
Parenting Class
Both parents in an incompatibility-based divorce must complete an educational program about the impact of divorce on children.4Justia. Oklahoma Code 43-101 – Grounds for Divorce The court will not finalize the divorce until both parents finish it. Approved providers offer the course online for a modest fee, and it usually takes a few hours.
Pay the Filing Fee or Request a Waiver
In most Oklahoma counties, the filing fee runs about $258 if you file without an attorney, or roughly $268 if an attorney enters an appearance on your behalf.8Cleveland County, OK. Uncontested Divorce Amounts vary slightly by county, so confirm with your local clerk. The fee generally does not change based on whether children are involved.
If you cannot afford the fee, file a Pauper’s Affidavit describing your financial situation. A judge reviews it at a short hearing, and proof of low income or benefits like SNAP, SSI, or TANF strengthens the request. If approved, you file the petition without paying upfront.
Wait Out the Required Period
Oklahoma’s statutory waiting period applies only when minor children are involved.1Justia. Oklahoma Code 43-107.1 – Actions Where Minor Child Involved – Delayed Final Order – Waiver
For childless couples, there is no mandatory cooling-off period, and uncontested cases can finalize in as little as ten days after filing, depending on your local court’s schedule.
For couples with minor children, the court cannot issue a final order for at least 90 days after the petition is filed. A judge can waive that period for good cause as long as neither spouse objects, which typically means the court is satisfied reconciliation is unlikely. The judge can also shorten the wait if both spouses voluntarily attend marital or family counseling and the court finds reconciliation unlikely.
Attend the Final Hearing
Once the waiting period expires, or as soon as the court has an opening in a childless case, the filing spouse schedules a short hearing. The judge’s bailiff or court coordinator sets the date. Some counties run a dedicated uncontested docket that moves faster.
The hearing itself usually takes only a few minutes. The judge reviews the decree to confirm it complies with Oklahoma law and fairly addresses property, debt, and any child-related terms. Expect standard questions: whether you signed everything voluntarily, whether the marriage is irretrievably broken, and whether you understand what you agreed to. Once the judge signs the decree and the clerk files it, the marriage is legally over.
Handle These Details Before the Decree Is Signed
A few items are easy to miss and expensive to fix later.
Joint Debt
Your decree can order your spouse to pay a specific joint credit card or car loan, but that only binds the two of you. It does not bind the creditor. If your name is still on the account and your ex stops paying, the lender can come after you, and your only remedy is to drag your ex back to court for violating the decree. Close or refinance joint accounts into the responsible spouse’s name alone whenever possible before the decree is finalized.
Retirement Accounts
Employer-sponsored plans like 401(k)s and pensions generally cannot pay benefits to anyone other than the account holder unless the court issues a Qualified Domestic Relations Order.9Office of the Law Revision Counsel. 29 USC 1056 – Form and Payment of Benefits A QDRO is a separate court order that tells the plan administrator exactly how much goes to the other spouse and when. The decree alone will not divide the account; without a QDRO, you could lose your share entirely. Plan administrators must approve the order, and review can take weeks or months, so start early.10U.S. Department of Labor. QDROs: The Division of Retirement Benefits Through Qualified Domestic Relations Orders
Name Restoration
If either spouse changed their last name at marriage, the decree can restore the former name. Oklahoma law allows this for either spouse.11Justia. Oklahoma Code 43-121 – Restoration of Maiden or Former Name Include the request in the decree before the judge signs it, and specify both the current married name and the name to be restored. Miss this step and you will need a separate legal name-change proceeding with additional fees. Order several certified copies of the signed decree to update Social Security, the DMV, banks, and other records.
Timing and Taxes
Your tax filing status for the whole year depends on your marital status on December 31. If the divorce is final by that date, the IRS treats you as unmarried for the entire tax year, and you file as single or, if eligible, as head of household.12Internal Revenue Service. Filing Taxes After Divorce or Separation Couples finalizing near year-end should run the numbers both ways before locking in a hearing date.
