Check That You Qualify Before You File

Two tests decide whether you get benefits: how much you earned recently, and why you’re out of work.

On the earnings side, Colorado looks at a “base period” covering the first four of the last five completed calendar quarters before you file. You need at least $2,500 in wages from insured employers during that window.3Department of Labor & Employment. Applying for UI Benefits If your standard base period comes up short, CDLE may use an alternate base period made up of the most recent four completed quarters.4U.S. Department of Labor. On the separation side, the rule is that benefits exist for people who are unemployed through no fault of their own.5Justia. Colorado Code 8-73-108 – Benefit Awards – Definitions A layoff or a business closure clears that bar automatically. If you quit, you can still qualify if you left for “good cause attributable to the employer,” which the statute recognizes in situations like an unreasonable pay cut, unsafe working conditions, or a substantial change in your employment terms. A purely personal reason for quitting usually leads to disqualification. If you were fired for gross misconduct, Colorado imposes a 26-week disqualification.6Department of Labor & Employment. What to Have Ready Before You Open the Application

Gather everything before you start. The system can time out between screens, and mistakes in your work history get cross-checked against employer tax records, which slows the claim down. You’ll need:7Department of Labor & Employment. Helpful Facts About Unemployment Insurance Benefits

Submitting the Claim Through MyUI+

Go to MyUI+ and create an account, or log into an existing one if you filed a Colorado claim any time since 2015.8Department of Labor & Employment. File a Claim Enter your personal information first, then your employment history. Accuracy matters because the system compares what you enter against employer tax records, and any discrepancy can trigger an investigation that delays your claim.

Before you submit, the portal shows a summary and asks you to confirm the information is truthful. Save the confirmation number when you’re done. That number is your proof of when you filed.

If you can’t use the online system, call CDLE’s customer support center at 303-318-9000, or toll-free at 1-800-388-5515, to file by phone.

FAQs Miss a week and your claim goes inactive; you’ll have to reopen it before payments resume. You can also request payment by phone at 303-813-2800, or 1-888-550-2800 outside the Denver metro area.

Document Your Work Search

You have to actively search for work every week you claim. CDLE recommends at least five work-search activities per week, such as submitting applications, attending interviews, or participating in reemployment services at a workforce center.14Department of Labor & Employment. Maintaining Your UI Eligibility For each activity, keep a record of the employer’s name, address, phone number, and the person you contacted.15Department of Labor & Employment. Eligibility and Work Search Requirements CDLE runs random audits, and if you can’t produce proof, you can be denied and hit with an overpayment.

Turning down what CDLE considers “suitable work” can end your benefits. A legitimate reason, such as unsafe conditions or pay well below your prior rate, may protect you; declining because you’d rather keep collecting will not.

Money Questions That Come Up During a Claim

How Much You’ll Get

Your weekly benefit runs about 55 percent of your average weekly wage over the prior 12 months, up to a maximum that changes each year and is shown by CDLE’s online Benefits Estimator at coloradoui.gov.2Department of Labor & Employment. Amount of UI Benefits Standard benefits last up to 26 weeks per benefit year.

Severance Pay

Report any severance when you file and again when you request weekly payments. A true severance allowance, paid because you were separated rather than for hours already worked, may be deducted from your benefits.2Department of Labor & Employment. Amount of UI Benefits If you aren’t sure whether a payment counts, report it and let CDLE decide. Failing to report creates an overpayment that’s much harder to unwind later.

Part-Time Earnings

You can work part-time and still collect. If you’re working fewer than 32 hours a week, you may qualify for partial benefits. Colorado lets you earn up to 50 percent of your weekly benefit amount before any reduction; above that, your benefit drops one dollar for every dollar earned.16Department of Labor & Employment. Working and Collecting So on a $400 weekly benefit, you can earn $200 and still get $400. Earn $250 and the benefit drops to $350. Earn $400 or more that week and you get nothing. Report earnings honestly each week when you certify.

Taxes

Unemployment benefits are taxable income at the federal level.17Internal Revenue Service. Topic no. 418, Unemployment Compensation Colorado also taxes them at its flat 4.4 percent income tax rate. You can elect through MyUI+ to have 10 percent of each payment withheld for federal taxes. Colorado does not offer a separate state withholding election through the unemployment system, so you may need to make estimated state payments on your own. Early each year CDLE sends you Form 1099-G showing the total benefits paid in the prior year; a digital copy is usually available in MyUI+ if the mailed one doesn’t arrive by early February.18Internal Revenue Service. About Form 1099-G, Certain Government Payments

If Your Claim Is Denied

You have 20 calendar days from the date the determination letter was mailed to appeal. If the 20th day is a weekend or legal holiday, the deadline moves to the next business day.19Department of Labor & Employment. Appeal Rights File the appeal in MyUI+ under “Issues and Determinations.”

You’ll then get a notice scheduling a hearing before an administrative law judge, where you can present evidence, bring witnesses, and question your former employer’s witnesses. This is where the case is won or lost, so bring documentation for everything you plan to say: emails about unsafe conditions, a layoff letter, pay stubs showing a wage cut. Claimants routinely lose at this stage because they arrive without records.

A Note on Honest Reporting

If CDLE pays you more than you were entitled to, you have to pay it back whether the mistake was yours or the agency’s. Intentional fraud, meaning knowingly false statements or hidden income, adds a 65-percent penalty on top of the overpayment and can bring criminal theft charges scaled to the dollar amount. Report your earnings, severance, and work-search activities accurately every single week and this stays a straightforward claim.
