Who Qualifies

Kansas looks at two things: your earnings and why you’re out of work.

On the reason for separation, you must be unemployed through no fault of your own. The Waiting Week

Filing Weekly Certifications

Each certification asks whether you were able and available to work and requires you to report any earnings. You can earn up to 25 percent of your weekly benefit amount with no reduction; anything above that is deducted dollar for dollar.9State of Kansas Department of Labor. Work Search and My Reemployment Plan

Every week you claim benefits, Kansas requires three work search activities. At least two must be actual job applications or resume submissions. The third can be a job fair, networking event, or skills assessment.

How Severance Affects Payments

Severance doesn’t disqualify you, but it reduces your weekly benefit dollar for dollar for as long as the severance covers.11Kansas Office of Revisor of Statutes. If your severance is larger than your weekly benefit, you’ll receive zero for those weeks, and they still count against your 16-week limit. File anyway when you separate so remaining eligible weeks aren’t lost.

Taxes on Your Benefits

Unemployment benefits are taxable at both the federal and state level. Even with the combined 13.5 percent withholding, your actual tax bill may be higher depending on other income, so set aside extra if you can.

If Your Claim Is Denied

You have 16 calendar days from the mailing date of the determination to file an appeal.7Justia Law. Kansas Code 44-709 – Claims for Benefits The deadline is strict; the only exception is a late filing caused by circumstances beyond your control.

After you appeal, you’ll receive a Notice of Telephone Hearing. Hearings are conducted entirely by phone and typically last 45 minutes to an hour. You must register by providing your contact number no later than 1 p.m. the business day before the hearing, or you won’t be called.14State of Kansas Department of Labor. If You Get an Overpayment Notice

  • Request a repayment plan by submitting form K-BEN 899 with an initial payment.
  • Apply for a waiver on regular unemployment overpayments using form K-CNS 2203. You can request one waiver per year, the overpayment must be older than five years, and repayment must cause undue hardship or be against equity and good conscience.15State of Kansas Department of Labor. Ignoring the notice doesn’t work. Kansas can offset future benefits and pursue other collection. If you think the overpayment determination is wrong, appeal it within 16 calendar days using the appeals process above rather than filing for a waiver.
