How to File NY State Taxes: Deadlines, Credits, and Amendments

To file your New York State income tax return for 2025, you’ll complete either Form IT-201 (if you were a full-year resident) or Form IT-203 (if you were a nonresident or part-year resident), attach the credits and schedules that apply to you, and submit it to the Department of Taxation and Finance by April 15, 2026.1Department of Taxation and Finance. Filing Due Dates Most people file electronically, often alongside their federal return. The steps below walk through who has to file, what you need, how to submit, and what happens if something goes wrong.

Who Has to File a New York Return

Your filing obligation depends on your residency and your income. Under New York Tax Law ยง 605, you are a resident if you are domiciled in the state or if you keep a permanent place of abode here and spend more than 183 days in New York during the tax year.2New York State Senate. New York Tax Law Section 605 Active-duty military members are excluded from the 183-day rule even when stationed in New York.

A full-year resident must file if any of the following is true:3Department of Taxation and Finance. Filing Information for New York State Residents

  • You had to file a federal return.
  • Your federal adjusted gross income plus New York additions came to more than $4,000 (or more than $3,100 if you are single and can be claimed as a dependent on someone else’s federal return).
  • You want a refund of state, New York City, or Yonkers tax that was withheld from your pay.
  • You want to claim a refundable or carryover credit.

Nonresidents file if they had New York-source income greater than their New York standard deduction. Part-year residents report everything they earned while they lived in New York, plus any New York-source income from the portion of the year they lived elsewhere.

If one spouse was a full-year New York resident and the other was not, the two spouses must file separate New York returns even if they filed a joint federal return. The resident uses IT-201; the nonresident or part-year resident uses IT-203.4Department of Taxation and Finance. Instructions for Form IT-203 Nonresident and Part-Year Resident Income Tax Return

The Deadline and How to Get More Time

For the 2025 tax year, both IT-201 and IT-203 are due April 15, 2026.1Department of Taxation and Finance. Filing Due Dates If you need more time, file Form IT-370 by April 15 and you get an automatic six-month extension that moves your filing deadline to October 15, 2026.5Department of Taxation and Finance. Read this part carefully: the extension buys you time to file, not time to pay. If you expect to owe, you need to estimate the balance and pay it by April 15 to avoid interest charges.5Department of Taxation and Finance. What You Need Before You Start

Finish your federal Form 1040 first. New York begins its calculation from your federal adjusted gross income, so you cannot complete the state return without it.3Department of Taxation and Finance. Filing Information for New York State Residents Then pull together:

  • W-2s from every employer, showing wages and state tax withheld.
  • 1099s for interest, dividends, retirement distributions, freelance income, or anything else that was not wages.
  • Social Security numbers for you, your spouse (if filing jointly federally), and every dependent.
  • Records of property taxes paid, mortgage interest, and charitable contributions if you plan to itemize.
  • College tuition records if you or a dependent attended college in New York, since the state has a tuition credit.

Full-year residents use Form IT-201; nonresidents and part-year residents use Form IT-203.4Department of Taxation and Finance. If you don’t itemize, you claim New York’s standard deduction, which runs smaller than the federal one. The 2025 amounts are $8,000 for single filers ($3,100 if you can be claimed as a dependent), $16,050 for married couples filing jointly, $8,000 for married filing separately, and $11,200 for head of household.6Department of Taxation and Finance. 2025 Standard Deductions Because New York’s standard deduction is lower, some people who take the standard deduction federally still come out ahead itemizing on the state return.

New York has nine income tax brackets for 2025, from 4% up to 10.9% on income over $25 million. The full rate schedules for every filing status are in the IT-201 instructions.7Department of Taxation and Finance. You don’t file a separate city return.

How to Submit the Return

Electronic filing is the fastest and most reliable option, and the state offers several ways in:8Department of Taxation and Finance. E-File Options for Personal Income Tax

  • Free File. If your 2025 federal adjusted gross income was $89,000 or less, you may qualify to e-file both your federal and state returns at no cost through the state’s Free File partners. Each partner sets slightly different eligibility rules, so check before choosing one.9Department of Taxation and Finance. Free File Your Income Tax Return
  • Commercial software. Programs like TurboTax and H&R Block prepare the state return alongside the federal one and transmit both.
  • Paid preparers. Most New York preparers are required to e-file their clients’ returns.
  • Taxpayer Assistance. If your income was $89,000 or less and your investment income was $11,950 or less, you may qualify for free in-person help from the Department of Taxation and Finance.8Department of Taxation and Finance. E-File Options for Personal Income Tax

If you e-file and owe, you can authorize an electronic funds withdrawal during the filing process. Credit and debit cards are accepted too, but processors typically charge a convenience fee of 2% to 3%.

Mailing a Paper Return

Paper filers send the return to one of two Albany addresses depending on whether a payment is enclosed:10Department of Taxation and Finance. Mailing Address (Personal Income Tax Returns)

Write the last four digits of your Social Security number, the tax year, and “Income Tax” on your check so the payment gets credited to the right account.

Credits Worth Checking Before You File

Several New York credits reduce the tax you owe directly, and some are refundable, which means you get the money even if your tax liability is already zero.

  • Empire State Child Credit. Up to $1,000 per child under age 4 and up to $330 per child ages 4 through 16. The credit begins phasing out at $110,000 of income for married couples filing jointly and $75,000 for other filers.12Office of Temporary and Disability Assistance. Empire State Child Credit
  • New York Earned Income Tax Credit. Equal to 30% of your federal EITC. If you qualify federally, you qualify at the state level.
  • College Tuition Credit. Up to $400 per eligible student for tuition paid to an eligible institution for you, your spouse, or a dependent.
  • Child and Dependent Care Credit. A percentage of the federal credit for child care expenses, with the percentage varying by income.

Claiming a credit usually means attaching an additional form. The IT-201 instructions list every credit and identify which form goes with each one.7Department of Taxation and Finance. If You Have Income Without Withholding

Freelance income, rental income, and investment gains generally don’t have New York tax withheld, which means you may owe quarterly estimated payments on Form IT-2105. The threshold is low: if you expect to owe at least $300 in New York State, New York City, or Yonkers tax after subtracting your withholding and credits, you should be making estimated payments.13Department of Taxation and Finance. Instructions for Form IT-2105

The 2026 quarterly due dates are April 15, June 15, and September 15 of 2026, plus January 15, 2027. To avoid an underpayment penalty, your payments for the year need to equal at least 90% of your current-year tax or 100% of your prior-year tax (110% if your New York adjusted gross income exceeded $150,000).13Department of Taxation and Finance. Instructions for Form IT-2105

What Happens If You Miss the Deadline

Missing April 15 without an extension costs real money. The late filing penalty is 10% of the unpaid tax if you are up to one month late, plus 1% for each additional month the return stays unfiled, up to 30%. If you are more than 60 days late, the minimum penalty is the lesser of $100 or 100% of the tax due, but never less than $50.14Cornell Law School. New York Comp. Codes R. and Regs. Tit. 20 Section 536.1 – Failure to File or Pay Tax

Interest also accrues on anything unpaid. For the second quarter of 2026, New York charges 8.5% annual interest on late payments, and that rate resets quarterly.15Department of Taxation and Finance. Interest Rates: 4/1/2026 – 6/30/2026 Filing on time even if you can’t pay the full balance is almost always better than not filing, because it eliminates the late filing penalty and limits your exposure to the much smaller late payment penalty.

Fixing a Return After You File

If you find an error on a return you already filed, or if the IRS makes a change to your federal return that affects your New York tax, file an amended return. Full-year residents use Form IT-201-X; nonresidents and part-year residents use Form IT-203-X. You generally have three years from the date you filed the original, or two years from the date you paid the tax, whichever is later.

One tight deadline to watch: if you amend your federal return or the IRS adjusts it, you have 90 days from the date of that federal change to file your amended New York return. Miss that window and you can lose a refund or face additional penalties. Paper amended returns go to the same addresses listed above.10Department of Taxation and Finance.
