How Form 1127.2 Differs From Form NYC-1127
These are two different documents, and confusing them is the most common mistake in the process. Form 1127.2 is informational. Your payroll department fills it out and hands it to you, reporting your wages and the Section 1127 amount already taken from your paychecks. Nothing on the 1127.2 requires a decision from you. Your only job with it is verification: confirm the numbers, then carry them onto the NYC-1127.
Who Receives a 1127.2
You get a Form 1127.2 if you work for the City of New York or one of its agencies, lived outside the five boroughs for any part of the tax year, and were hired on or after January 4, 1973. That date matters because Section 1127 of the NYC Charter requires every person hired after it to sign an agreement accepting this obligation as a condition of employment.1NYC Department of Finance. Civil service classification and job title don’t affect the requirement. Mayoral agency, Department of Education, or another city entity — if you lived in Westchester, on Long Island, in New Jersey, or anywhere outside Manhattan, Brooklyn, Queens, the Bronx, or Staten Island, the obligation applies.3American Legal Publishing. One thing to know: the Section 1127 payment is not technically a tax. The NYC-1127 instructions say so directly. It is a contractual payment to the city, made as a condition of employment, calculated to equal what you would have paid in NYC personal income tax if you had been a resident.1NYC Department of Finance. What’s on the Form and What to Check
The 1127.2 is short. Your employer fills in your Social Security number, the NYC agency code for your department, your total wages for the calendar year, and the total Section 1127 amount withheld.4NYC Department of Finance. Before you do anything with it, compare the wages against your federal W-2 and your pay stubs. Discrepancies happen. Catching one now saves you from a Department of Finance letter later. If the numbers don’t line up, contact your agency’s payroll office and get a corrected statement before you file.
Using the 1127.2 to File NYC-1127
To complete the NYC-1127 you need three things:
- Your Form 1127.2.
- A complete copy of your New York State income tax return (IT-201 if you’re a state resident, IT-203 if nonresident or part-year), including all schedules. This gets attached to the NYC-1127.
- Any federal or state extension approval letter, if you have one.
The calculation runs in a few steps. Line 1 takes your New York State taxable income from the IT-201 or IT-203. Line 2 is the Section 1127 liability, calculated as if you were a city resident using the form’s liability tables, plus any other NYC taxes already on your state return. Line 3 subtracts credits. Credits That Reduce What You Owe
Schedule B on the back of the NYC-1127 lists credits that mirror those available to NYC residents. Applying them can meaningfully lower your liability:
- NYC School Tax Credit (fixed-dollar amount plus a rate-reduction amount).
- NYC Household Credit, using the tables in the IT-201 instructions.
- NYC Earned Income Credit; attach Form IT-215.
- NYC Child and Dependent Care Credit; attach Form IT-216.
- UBT Paid Credit, if you also pay the Unincorporated Business Tax.
- NYC Claim of Right Credit from Form IT-201-ATT, line 16; attach Form IT-257.
- NYC Income Tax Elimination Credit; attach Form IT-270.

If You’re Married
If you file a joint New York State return but your spouse doesn’t work for a city agency, you can exclude your spouse’s income from the Section 1127 calculation. Schedule A separates your income from your spouse’s, starting with joint NYS adjusted gross income and subtracting the non-city-employee spouse’s share. A limitation percentage is applied to your deductions and exemptions so they stay proportional to your portion of the joint income. The resulting allocated taxable income goes on line 1 and runs through Liability Table C rather than the standard table.
If both spouses work for city agencies and both are nonresidents, use the standard joint filing status instead of Filing Status C.
Deadline and Where to Send It

Extensions
There is no separate extension form for the NYC-1127. If you already have a federal or New York State extension, your NYC-1127 is due within 15 days after that extended deadline. Amended Returns
If your New York State return is later changed, by you or by the state, and the change affects your Section 1127 calculation, file an amended NYC-1127 with the Department of Finance showing the corrected figures.
Interest on Late Payments
Late Section 1127 balances accrue interest daily. For 2026, the Department of Finance charges 11 percent annually for the first quarter (January through March) and 10 percent for the second quarter (April through June). If the Department finds a discrepancy between your return and its records, it sends a written inquiry asking for documentation, usually your W-2 or state return. Respond promptly. Interest keeps running on any unpaid balance until the issue is resolved. Keep copies of everything you mail, and use certified mail or the e-Services portal so you have proof of submission.
