How to Fill Out and File a South Dakota Lien Release Form

A South Dakota lien release is the document that clears a paid-off creditor’s claim from a vehicle title or a real estate record. For a vehicle, the lender has 20 days after your final payment to execute and deliver the release, which then goes to any County Treasurer.1South Dakota Legislature. Releasing a Vehicle Lien

South Dakota puts the release burden on the lienholder, not on you. Within 20 days of your final payment, the lender must execute and deliver the release.1South Dakota Legislature. How the release reaches the County Treasurer depends on who has been holding the paper title. If the lender held it, they take the title and the release directly to any County Treasurer’s office. If you held it, the lender executes the release and sends it to you, and you deliver both documents to the County Treasurer yourself. Electronic Lien and Title (ELT)

Many South Dakota lenders participate in the state’s Electronic Lien and Title system, in which no paper title exists while the lien is active. When your lender uses ELT, the release runs electronically through its ELT provider, the state processes it, and a paper title is printed and mailed to you.3South Dakota Department of Revenue. If you’re not sure whether your lender is on ELT, ask after your final payment. If no title arrives in the mail within a few weeks, follow up with both the lender and the County Treasurer.

Getting a Clean Paper Title

Once the Treasurer processes the release, the lien is gone from your vehicle record. If you want a fresh paper title in hand showing no lien, request a duplicate. Satisfying a Mortgage on Real Property

Clearing a mortgage lien means recording a satisfaction of mortgage (sometimes called a certificate of release) with the Register of Deeds in the county where the property sits.   • The names of the mortgagor (borrower) and the mortgagee (lender).
  • The date of the original mortgage, plus the book, page, county, and state where it was recorded.
  • The legal description of the land being released.
  • A statement that the mortgage is fully paid, satisfied, or discharged.

A missing book-and-page reference or an unnotarized signature will get the document rejected.

Recording and Fees

File at the counter during business hours or by mail. The recording fee is $30 for the first 50 pages, plus $2 for each additional page.8South Dakota Legislature. Once the Register of Deeds records it, the discharge is noted on the margin of the original mortgage record.2South Dakota Legislature. Many South Dakota counties also accept electronically recorded documents through vendors such as Simplifile and Corporation Service Company (CSC).9South Dakota Association of County Officials. If the Lender Misses the Deadline

For a vehicle, the 20-day clock is a hard deadline.1South Dakota Legislature. South Dakota Code 32-3-44 If it passes without action, write to the lender and keep a copy.

For real property, once the balance hits zero, send the mortgagee a written demand to satisfy the mortgage. The lender then has 10 days to execute and record the satisfaction.10South Dakota Legislature. South Dakota Code 44-8-26 Send the demand by certified mail so you have proof if a dispute arises.

If the Lender No Longer Exists

When the bank or credit union that held your loan has closed, merged, or been taken over, the successor institution should have your records and issue the release. When neither a successor nor the FDIC can produce a release, the remaining option for real property is a quiet title action, a court proceeding that asks a judge to remove the lien from the record. Uncontested claims are typically resolved by default judgment. You’ll need an attorney to file the petition, and costs vary, but it is sometimes the only way to clear a title when the lienholder no longer exists.
