To file California Form FL-410 for contempt, you complete the Judicial Council’s four-page Order to Show Cause and Affidavit for Contempt, attach either Form FL-411 (for unpaid support, fees, or costs) or Form FL-412 (for custody, visitation, or domestic violence order violations), and file the packet with the clerk of the same court that issued the order being violated.1California Courts. Order to Show Cause and Affidavit for Contempt (FL-410) A judge then signs the order to show cause, sets a hearing, and you arrange personal service on the other party. Because contempt can send someone to jail, the proceeding is quasi-criminal, and you will have to prove the violation beyond a reasonable doubt.2Judicial Council of California. When FL-410 Is the Right Form
California Family Code section 290 authorizes contempt as one of the tools for enforcing any judgment or order made under the Family Code.3California Legislative Information. California Family Code 290 The common triggers are missed child or spousal support, blocked custody and visitation time, violations of a domestic violence restraining order, and refusal to pay court-ordered attorney fees or costs.2Judicial Council of California. Order to Show Cause and Affidavit for Contempt
Deadlines matter and they are strict. For unpaid child, family, or spousal support, you have three years from the date each payment was due; each missed installment runs on its own clock. For every other family law violation, including custody, visitation, property division, and restraining order breaches, the deadline is two years from the date of the violation.4California Legislative Information. What to Gather Before You Start
Pulling these items together before you open the PDF makes the drafting faster and the affidavit stronger:
- A certified copy of the court order that was violated, with the date it was signed, the department that issued it, and the case number. If you no longer have it, the court clerk can provide one.
- Proof that the other party knew about the order. The form asks how the person learned of it: present in court when it was made, served with a copy, or signed a stipulation leading to the order.2Judicial Council of California. Order to Show Cause and Affidavit for Contempt
- A dated record of each violation. Every missed payment, denied visit, or breached protective order term is a separate count of contempt, so specificity matters.
- The right attachment. Use Form FL-411 to itemize financial defaults (support, attorney fees, litigation costs); use Form FL-412 for custody, visitation, or domestic violence order violations. Attach both if your violations cross categories.5Judicial Council of California. FL-411 – Affidavit of Facts Constituting Contempt6California Courts. Affidavit of Facts Constituting Contempt (Domestic Violence/Custody) (FL-412)
- Evidence that the other party could have complied. This is where contempt cases most often fall apart. Bank statements, pay stubs, employment records, and even social media posts showing discretionary spending help you show the citee had the ability to follow the order and chose not to.
Filling Out the Form
FL-410 runs four pages. Type or print in ink. The instructions on pages three and four of the PDF explain each item in order.2Judicial Council of California. Order to Show Cause and Affidavit for Contempt
Caption and Party Information
Top-left box: your name, address, phone, and fax if you have one. If a restraining order protects you and you want to shield your home address, use any mailing address where you can receive court papers, but be aware you can be legally served at whatever address you list. The second box takes the county, court address, and branch name of the court that issued the original order. File in that same court. The third box lists Petitioner, Respondent, and Other Parent or Party exactly as they appear on the most recent violated order. Case number goes in the upper-right box.
Items 1 Through 7
Item 1 is the name of the “citee,” meaning the person you say disobeyed the order. Item 2 is the hearing date and courtroom; leave it blank, because the clerk fills it in after the judge reviews your paperwork. Item 3 is where you check boxes for the FL-411 or FL-412 you are attaching. Item 5 establishes how the citee knew about the order: present in court, served with a copy, signed a stipulation, or another method you describe.
Items 6 and 7 cover history. Item 6 asks whether you have previously applied for a contempt order and what happened. Item 7 asks whether the citee has ever been found in contempt before. Both matter because penalties escalate with repeat findings. If you run out of room, check the continuation box and staple an attachment.
Item 8: Describing the Violations
Item 8 is the heart of the affidavit. Check 8a for financial order violations and reference the attached FL-411. Check 8b for custody, visitation, or domestic violence order violations and reference FL-412. Use 8c for any other type of violation, describing which order was broken, how, and when, based on facts within your personal knowledge. Item 8d is for additional material facts, especially anything showing the violation was deliberate and without justification. Continuation pages are fine if you need them.
State facts, not conclusions. “Respondent did not make the $1,500 support payment due on March 1, 2026” is a fact. “Respondent has a blatant disregard for the court’s authority” is a conclusion. Give the judge dates, dollar amounts, and specific actions or omissions, and let the judge draw the conclusion.
Signing Under Penalty of Perjury
The bottom of the form carries a declaration under penalty of perjury. Sign and date it. You are swearing under California law that everything in the affidavit is true and correct.2Judicial Council of California. Order to Show Cause and Affidavit for Contempt A knowingly false sworn statement carries its own legal consequences, so include nothing you cannot back up.
Filing the Packet
Bring the completed FL-410, the attached FL-411 or FL-412, and copies of the violated order to the family law clerk’s office. The filing fee for a motion or order to show cause in a family law matter is $60.7Los Angeles Superior Court. Civil Fee Schedule 2026 If you cannot afford it, file Form FW-001 (Request to Waive Court Fees) at the same window. You qualify automatically if you receive Medi-Cal, CalWORKS, or food assistance, or if your household income falls below the thresholds printed on the form.8Judicial Council of California. FW-001 Request to Waive Court Fees
After filing, a judge reviews the Order to Show Cause portion, signs it, and sets a hearing date.
Serving the Citee
California law requires personal service for papers that bring someone into contempt; mail is not enough.9California Legislative Information. California Code of Civil Procedure 1015 That means a person who is not a party to the case, so not you, hands the papers directly to the citee. A professional process server or the county sheriff’s office handles this routinely.
Once service is done, the server fills out Form FL-330 (Proof of Personal Service), and you file it with the court. Without that proof on file, the court cannot proceed with the hearing. Build in time: if the citee is hard to find or actively avoids service, the process can stretch for weeks.
What You Will Have to Prove
Contempt hearings run closer to criminal trials than typical family law appearances. The citee has the right to an attorney, including appointed counsel if they cannot afford one, plus the right against self-incrimination and the presumption of innocence.10Superior Court of California. Contempt Procedures
You carry the burden of proving every element beyond a reasonable doubt:10Superior Court of California. Contempt Procedures
- A valid court order existed at the time of the alleged violation.
- The citee knew about the order, which is why Item 5 on the form matters.
- The citee had the ability to comply with the order.
- The citee willfully disobeyed the order.3California Legislative Information. California Family Code 290
The ability-to-comply element is where filers most often stumble. If the citee shows credible evidence of job loss, disability, or genuine financial hardship, the court may find the violation was not willful. The citee has the burden of raising inability as a defense, but if you expect that argument, bring evidence that undermines it: recent purchases, employment records, bank activity.
What a Contempt Finding Can Cost the Citee
Under the general contempt statute, each count can carry a fine of up to $1,000, imprisonment of up to five days, or both. The court may also order the citee to pay your reasonable attorney fees and costs incurred in bringing the proceeding. Family law contempt uses a separate, escalating schedule that climbs with each repeat finding, with community service and jail time measured in hours per count, and probation available as an alternative to custody.11California Legislative Information. California Code CCP 1218
Consider Lower-Friction Options First
Contempt is the enforcement tool with the sharpest teeth, but it also demands the highest burden of proof and the most procedural formality. Before committing to FL-410, think about whether a less adversarial route reaches the same result faster.
For unpaid support, you can request an income withholding order through the local child support agency, which directs the employer to deduct payments before the paycheck is issued. You can record an abstract of support judgment with the county recorder’s office to place a lien on real property. License suspensions, including driver’s license, professional license, and passport restrictions for arrearages over $2,500, are available through the Department of Child Support Services without a separate court motion.
For custody and visitation problems, a motion to modify the parenting plan is sometimes more productive than contempt. The court can restructure the schedule, add make-up days, or shift primary custody. You can pursue modification and contempt at the same time if the violations are serious enough to warrant both.
