How to Fill Out and File Michigan Form 5092: Amended Return

Michigan Form 5092 is the amended sales, use, and withholding tax return you file when a Form 5080 you already submitted contains an error. Enter your corrected figures (not the difference between old and new), pick a reason code, and file the form through Michigan Treasury Online at mto.treasury.michigan.gov or by mail to the Department of Treasury in Lansing. You have four years from the original due date to do it.1Michigan Legislature. Michigan Compiled Laws 205.27a – Statute of Limitations

When Form 5092 Is the Right Form

Form 5092 corrects only monthly and quarterly returns filed on Form 5080. If your original return was the annual Form 5081, use Form 5082 instead; if it was the combined 4% and 6% annual Form 5091, use Form 5093.2Michigan Department of Treasury. I Need to Amend My Sales, Use and Withholding Tax Return – What Is the Process

The form asks you to select a two-digit code that explains why you’re amending:

  • 01 — Increasing tax liability
  • 02 — Decreasing tax liability
  • 03 — Incorrect information or figures on the original return
  • 04 — Original return was missing information or incomplete
  • 05 — Claiming previously unclaimed prepaid sales tax
  • 06 — Disputing an adjustment
  • 07 — Tax exempt
  • 08 — Other (requires a written explanation)

Most corrections fall into codes 01 through 04: a wrong gross sales figure, forgotten use tax on business purchases, an incorrect withholding amount, a blank field. If you pick 08, write a clear explanation directly on the form. Treasury will not process a vague “other.”

Filling Out the Form

At the top, enter your business name, address, FEIN or TR Number, and the exact tax period you’re correcting. Check the box for the tax type being amended: sales, use, withholding, or a combination. Complete only the sections that match what you checked. If you’re fixing only a withholding error, skip the sales and use tax lines entirely.3Michigan Department of Treasury. The form has four numbered parts, and throughout them you enter corrected totals, never differences. The form itself works out whether you owe more or have overpaid.

Part 1: Sales and Use Tax

Lines 1a and 1b are your corrected gross Michigan sales, rentals, accommodations, and telecommunications services. Both come from line 4 of Worksheet 5095: 1a for sales tax, 1b for use tax. Lines 2a and 2b are the tax itself, calculated at Michigan’s 6% rate,5Michigan Department of Treasury. Sales and Use Taxes and carried from line 7 of Worksheet 5095. Negative amounts are not allowed on these lines.3Michigan Department of Treasury. Form 5092 – Sales, Use and Withholding Taxes Amended Monthly/Quarterly Return

Lines 3 through 5 handle prepaid tax credits and the vendor discount for timely filing. The discount applies only to two-thirds of the sales or use tax collected at 6%, and the calculation differs depending on whether you file monthly, quarterly, or on an accelerated schedule. The form instructions walk through each version. Line 6 is your total sales or use tax due after the discount.3Michigan Department of Treasury. Part 2: Use Tax on Purchases

Line 7 covers use tax on items bought for business or personal use without paying sales tax, or inventory pulled for your own use. Multiply the applicable base by 6% and carry the amount from line 9 of Worksheet 5095.3Michigan Department of Treasury. Form 5092 – Sales, Use and Withholding Taxes Amended Monthly/Quarterly Return

Part 3: Withholding Tax

Line 8 is the corrected total Michigan income tax withheld for the period. One number.

Part 4: Total Tax and Payment Due

Line 9 sums your corrected totals from lines 6a, 6b, 7, and 8. If that number comes out negative, it’s an amount available to offset future periods, and you skip the rest of the form. Line 10 is what you already paid for this period, including any overpayments carried forward. Line 11 is the net tax due after subtracting those prior payments. Lines 12 and 13 are penalty and interest (see below). Line 14 is the total payment due, adding lines 11, 12, and 13. If it’s less than one dollar, don’t send anything.3Michigan Department of Treasury. Form 5092 – Sales, Use and Withholding Taxes Amended Monthly/Quarterly Return

Penalty and Interest If You Now Owe More

When an amendment increases your tax, penalty and interest run from the original due date, not the date you filed the correction. The penalty is 5% of the unpaid tax for the first two months. After that, another 5% accrues each month or partial month the tax remains unpaid, capped at 25%.3Michigan Department of Treasury. Interest runs daily at the average prime rate plus one percentage point, with the rate reset every January 1 and July 1.6Michigan Legislature. Michigan Compiled Laws 205.23 – Deficiency; Interest; Penalties

The penalty can be waived if you show Treasury the failure to pay on time was due to reasonable cause rather than willful neglect.7Michigan Legislature. Michigan Compiled Laws 205.24 – Failure to File Return or Pay Tax; Penalty Interest generally is not waivable. Filing the amendment as soon as you spot the error keeps both charges as small as possible and helps if you later request a waiver.

Submitting the Return

You have two ways to file:

If you owe additional tax and pay by check, write your account number, “SUW Monthly/Quarterly,” and the return period on the check. You can also mail the paper form and pay separately through MTO.3Michigan Department of Treasury. Form 5092 – Sales, Use and Withholding Taxes Amended Monthly/Quarterly Return

How Long You Have to Amend

Michigan gives you four years. Under MCL 205.27a, you cannot claim a refund more than four years after the date the original return was due, and Treasury cannot assess additional tax more than four years after the due date or the actual filing date, whichever is later.1Michigan Legislature. Michigan Compiled Laws 205.27a – Statute of Limitations Beyond that window, you can’t recover an overpayment, and the state generally can’t come after an underpayment either.

Keep your amended return, the original Form 5080, and all supporting records for at least four years after the tax was due, matching the statute of limitations.8Michigan Legislature. Michigan Compiled Laws 205.68 – Records; Retention; Tax Liability That covers invoices, exemption certificates, payroll records, and anything else supporting the corrected figures if Treasury audits the period.
