What to Gather First
Pulling together documentation before you start writing saves trips back to the clerk’s window. You need full legal names, current addresses, Social Security numbers, and dates of birth for both spouses and any minor children; the date and location of the marriage, and the date of separation if that applies; legal descriptions from the deeds to any real estate; the year, make, model, and VIN for each vehicle; bank and investment account numbers with balances and institution names; outstanding balances on the mortgage, auto loans, and credit cards; and recent tax returns and pay stubs.
Income records matter most when children are involved. Filling In the Findings of Fact
The Findings of Fact section establishes that the court has authority to hear the case. Confirm the residency requirement: that you or your spouse has been an actual, good-faith resident of Oklahoma for at least six months before the petition was filed.6Justia. State the date of the marriage and identify the grounds for divorce.
Use the Oklahoma statutory language. Most uncontested Oklahoma divorces list “incompatibility” as the no-fault ground, not “irreconcilable differences” or “irretrievably broken,” which belong to other states.7Justia. Filling In the Orders
The Orders section is where the actual terms live, and every line has to match the documentation you gathered. Oklahoma is an equitable-distribution state, so the court divides marital property fairly rather than automatically in half. Parenting Education When Children Are Involved

Waiting Periods and Timing
Oklahoma imposes a 90-day waiting period from the filing date in any case involving a minor child.1Justia. Without minor children, a divorce can be granted as soon as 10 days after the petition is filed if both parties agree.
Uncontested Cases and the 24-Hour Rule
In an uncontested divorce, the responding spouse usually signs a General Appearance and Waiver of Summons rather than being formally served. The Final Hearing and Filing the Signed Decree
At the final hearing, the judge reviews the completed decree to confirm it meets legal standards, reflects the parties’ agreement or the court’s prior rulings, and fairly addresses custody and support. Once the judge signs the original, take it immediately to the County Court Clerk for filing. Filing creates the official public record and starts any timelines for appeals, property transfers, and support payments. Filing fees vary by county; expect roughly $270, though the exact amount depends on your courthouse.
Retirement Accounts Need a Separate Order
If the decree awards part of a 401(k), pension, or other employer-sponsored retirement plan to the non-participant spouse, the decree by itself will not make the plan administrator release the funds. You need a separate Qualified Domestic Relations Order, or QDRO. The QDRO cannot require the plan to provide benefits the plan doesn’t already offer or to increase benefits beyond what the plan provides. The plan administrator, not the court, decides whether a submitted order qualifies. Getting the QDRO drafted and approved by the plan before the divorce is finalized avoids a common headache: going back to court months later for a separate signed order.
What the Decree Itself Doesn’t Do
A few post-decree steps live outside the form and need their own attention. A certified copy of the decree is what you present to the Social Security Administration on Form SS-5 if the decree restores a former surname, and to the State Department on Form DS-5504 for a passport update within a year of issuance.11Social Security Administration.
