How to Fill Out and Submit Oklahoma Form 773: Fees and the Mandatory Step

Oklahoma Form 773, the Notice of Transfer of Ownership of a Vehicle, is an optional $10 filing that lets you tell Service Oklahoma you’ve sold your car. Once the transfer is recorded, the buyer is presumed to be the legal owner from the sale date forward, which protects you if they delay titling the vehicle and rack up tickets, tolls, or worse while it’s still showing in your name.1Justia. Oklahoma Code 47-1107.4 – Written Notice of Transfer – Fee – Presumptions You can file it online through OkCars, in person at any licensed operator (tag agency), or by mail.

Why File a Voluntary Form

Nothing in Oklahoma law forces you to file Form 773. The statute uses “may,” and the administrative code states plainly that “the filing of Notices of Transfer is optional.”2Cornell Law Institute. Oklahoma Code 670:20-37-1 – General Provisions; Assignments; Liens; Registration; Notice of Transfer Skipping it carries no fine, and the statute says failing to file “does not impose or establish any civil or criminal liability” on the seller.1Justia. Oklahoma Code 47-1107.4 – Written Notice of Transfer – Fee – Presumptions

So why spend the $10? Because the filing creates a rebuttable presumption that the buyer owns the vehicle, and therefore owes any civil or criminal liability tied to ownership, from the date Service Oklahoma records.1Justia. Oklahoma Code 47-1107.4 – Written Notice of Transfer – Fee – Presumptions If the buyer sits on the title for weeks and runs through toll gantries or parking zones in the meantime, that record is what gets you out from under the bill.

One thing Form 773 does not do: it does not transfer title. The administrative code is explicit that the notice “does not constitute a transfer of ownership and does not alleviate the buyer/new owner of the responsibility of properly and timely transferring title and paying all applicable taxes and fees.”2Cornell Law Institute. Oklahoma Code 670:20-37-1 – General Provisions; Assignments; Liens; Registration; Notice of Transfer The buyer still has to go through full registration on their own.

What You Need Before You Start

The form itself is a single page. Pull out the vehicle’s Oklahoma title, the most recent registration, and the buyer’s contact details, and you’ll be able to fill it in a few minutes. The fields are:3Service Oklahoma. Oklahoma Form 773 – Notice of Transfer of Ownership of a Vehicle

  • Vehicle Identification Number (VIN), the 17-character code on the dashboard and the title.
  • Title number, from your Oklahoma certificate of title.
  • License plate number that was on the vehicle at the time of sale.
  • Date of transfer, meaning the actual day you handed the vehicle over.
  • Buyer’s full legal name, printed.
  • Buyer’s street address, city, state, and ZIP.

The form doesn’t ask for the year, make, or model. The VIN and title number are enough for Service Oklahoma to identify the vehicle. Check the VIN character by character before you sign; one wrong digit points to a different vehicle entirely and will hold up processing. Your signature on the form certifies that what you’ve entered is accurate.

How to Submit the Form and Pay

You have three options:

The fee is $10 whichever route you choose. Of that, $7 goes to the licensed operator who processes it and $3 goes to the Service Oklahoma Reimbursement Fund.1Justia. Oklahoma Code 47-1107.4 – Written Notice of Transfer – Fee – Presumptions

The Mandatory Step That Is Not Form 773

Form 773 is optional, but Oklahoma does require a separate pre-registration submission within two business days of every private sale under 47 O.S. ยง 1112.2.5Justia. Oklahoma Code 47-1112.2 – Transferability of License Plates Either the buyer or the seller can file it. Business days are Monday through Friday, excluding state holidays. Pre-registration identifies the vehicle, the buyer, and any associated plate, and can be completed online at the Navigate website, at Service Oklahoma headquarters in Oklahoma City, or at any licensed operator. If you file it as the seller, the buyer gets an email asking them to confirm the information, and then has two months from the purchase date to complete full registration.6Service Oklahoma. Pre-registration and Form 773 are not the same filing. You can do both. The pre-registration is the one you cannot skip.

What to Give the Buyer

Form 773 covers your side of the paperwork. The buyer still needs documents from you to complete their registration at a tag agency:6Service Oklahoma. Ready, Set, Tag!

  • The Oklahoma title, properly signed over on the assignment line.
  • A properly assigned purchase agreement, Form 722-1 for private sales.
  • Form 729, the Odometer Disclosure Statement, for vehicles model year 2011 or newer with a functioning odometer.

Keep the license plate. In Oklahoma, plates belong to people, not vehicles. When you sell the car, the plate comes off and goes with you, to be transferred to your next vehicle or surrendered.6Service Oklahoma. Ready, Set, Tag!
