The BC PNP Employer Declaration Form is the PDF a British Columbia employer completes and signs to confirm a genuine job offer supporting a foreign worker’s application under the BC Provincial Nominee Program’s Skills Immigration streams. You download it from the WelcomeBC site, fill in your company details, the job offer, and your recruitment efforts, then upload the signed PDF through the BCPNP Online portal with the rest of the application package.1WelcomeBC. BC PNP Employer Declaration Form Your signature is a legal attestation that everything in it is truthful and complete, so the time to catch errors is before you upload.
Confirm Your Business Qualifies Before You Fill Anything In
The declaration asks you to attest to things that only an eligible employer can truthfully claim. Checking the gates first saves you from completing a form the program will refuse on sight.
Physical Presence and Operating History
Your business needs a physical presence in British Columbia, meaning a fixed location such as an office where employees report to work. Remote-only operations without a BC office do not qualify. The business must be incorporated in BC, extra-provincially registered, or registered as a partnership in BC, and it must have operated in BC for at least one year. For the Entry Level and Semi-Skilled stream, the operating minimum is two years.2WelcomeBC. BC PNP Skills Immigration Program Guide
Employee Count
Staffing thresholds depend on location. Within the Metro Vancouver Regional District, you need at least five indeterminate, full-time employees (or full-time equivalents) performing their work from within BC. Outside Metro Vancouver, the minimum is three. A full-time employee averages at least 30 hours per week; two part-timers whose combined hours reach 30 count as one full-time equivalent.2WelcomeBC. Good Standing
An application can be refused if the supporting employer, or any director or owner, has received penalties or fines from a government or regulatory body within the past two years, or within the past five years for immigration-related violations. The same applies if the employer is under investigation or has been charged with a criminal offence related to immigration or business operations. You also need a valid municipal business licence for the operating location.2WelcomeBC. BC PNP Skills Immigration Program Guide
Filling Out the Form Section by Section
Download the current version of the PDF from WelcomeBC. The form itself tells you to check that page for the latest version before you start.1WelcomeBC. BC PNP Employer Declaration Form
Prospective Employee
The opening section is short: the worker’s given name(s) and family name(s). Copy these from the worker’s passport exactly, including the order and spelling of multiple given names. A mismatch here is one of the most common reasons a file gets kicked back.
Company and Organization
This section captures who you are and how you are structured. You provide the legal name, the operating name if different, the mailing and business addresses (with city, province, country, and postal code; both addresses if they differ), and a contact person’s name, title, phone number, and email. You also enter the company website, the economic sector, the year the business was established in BC, the number of full-time-equivalent employees in BC, the legal structure (incorporated in BC, limited liability partnership, extra-provincially registered, or other), and your BC incorporation or registration number.1WelcomeBC. BC PNP Employer Declaration Form
One point of frequent confusion: the form does not ask for a Canada Revenue Agency business number or a WorkSafeBC account number. The identifying number it wants is your BC incorporation or registration number.
Job Offer (Section 3a)
Enter the job title, hourly wage, annual wage, work location address (with a field for a second location if applicable), and hours worked per week. Indicate whether the position is indeterminate, meaning permanent with no set end date. If the position is not permanent, provide the end date and explain why the role is time-limited.
Section 3b applies only if the position is an eligible BC PNP Tech occupation. If it isn’t, skip it.
Position Details (Section 3c)
This is a series of yes/no questions aimed at whether the job is genuinely needed and whether the worker is qualified for it:
- Whether the position requires any language other than English or French, and if so, why.
- Whether the worker holds the necessary BC certification, licensing, or registration for the job.
- Whether the company has been refused a Labour Market Impact Assessment for this or a similar position in the past year.
- Whether the position falls under a collective bargaining agreement.
- Whether the position is new, together with the number of employees in the same occupation and location who were terminated in the past 12 months, currently working, currently laid off, and the number of current vacancies.
Those staffing counts help the BC PNP judge whether you genuinely need a foreign worker for the role, so take the time to pull the numbers from payroll rather than estimating.
Recruitment Summary
Describe your recruitment activities: the type, location, and duration of advertisements, the total number of applicants, and how many days formal recruitment lasted. Confirm whether active recruitment took place in Canada, and explain why the position was offered to this particular applicant. The burden sits with you to show the job offer is bona fide.1WelcomeBC. Check the Wage Before You Type It
The offered wage must sit within the wage range posted on WorkBC or the federal Job Bank for that occupation and location. It also has to be comparable to what you pay Canadian citizens and permanent residents doing similar work with similar qualifications, and consistent with your overall wage structure.2WelcomeBC. BC PNP Skills Immigration Program Guide Pull the WorkBC wage data for the specific occupation and region before you complete the hourly and annual wage fields. An offer below the posted range is likely to draw questions or a refusal.
Uploading Through BCPNP Online
Save the completed form as a PDF. Log in to the BCPNP Online portal, open the relevant application, and upload the declaration as part of your supporting documentation package. That package also typically includes a recommendation letter, a copy of the signed job offer, a detailed job description, and evidence of recruitment efforts.3WelcomeBC. For Employers Review every field one more time before you submit. Once submitted, the information is locked.
What Happens After You Submit
The BC PNP communicates through the BCPNP Online portal. Requests for additional documents, clarifications, or a formal interview appear as notifications on the dashboard, and slow replies can lead to file closure.
The province’s Program Integrity Unit may conduct site visits to verify that conditions on the ground match what the declaration describes.4British Columbia News. Ministers Statement on BC Provincial Nominee Program Audit Report Visits can be unannounced. Inspectors check whether the nominee is actually working at the declared location, whether the duties and wages match the form, and whether the business still meets the staffing and operational requirements it claimed.
Penalties for False or Misleading Information
Under the Provincial Immigration Programs Act, if the director determines that an employer provided false or misleading information in any part of the application, the worker’s provincial approval can be cancelled after the person is given an opportunity to be heard. The director can also refuse to accept any future applications from the employer for up to two years.5BC Laws. Provincial Immigration Programs Act
The program guide adds that if the BC PNP finds an employer appears to be violating any municipal, provincial, or federal law, it may share that information with the relevant enforcement body.2WelcomeBC.
