What You Need Before You Start
Two items. The citation packet mailed to you (which contains the blank Certificate of Innocence, your citation number, the incident date, the vehicle photo, and a password for the online portal),3Portland.gov. One point that trips people up: as an individual vehicle owner, you are not required to name the person who was actually driving. Oregon law says the citation must be dismissed based on your sworn statement and the license photocopy alone, “without requiring a court appearance by the registered owner or any other information.”2Oregon Public Law. Filling it in helps the court reissue the ticket to the right person, but leaving it blank should not block your own dismissal. Businesses and rental companies play by a different rule, described further down.
Filling Out the Form
The certificate itself is short. At the top, write in the citation number, the incident date, and your vehicle’s license plate number, all of which appear on the citation. The body of the document is a single sworn declaration: you affirm that you were not driving the vehicle at the time of the violation. Because this is an affidavit, signing it when you actually were driving exposes you to penalties for a false sworn statement.
Sign and date using the name shown on your vehicle registration. If two owners are listed, the person named on the citation is the one who should sign. Print legibly. Court clerks process these in volume, and an unreadable citation number or signature is one of the fastest ways to have your form kicked back. How to Submit
You have two options.
By mail, send the completed form and license photocopy to Multnomah County Circuit Court, P.O. Box 114, Portland, OR 97207. A pre-addressed envelope comes with your citation packet. The 75-Day Deadline
The completed form and license photocopy must arrive at the court within 75 days of the incident date on the citation.1Portland.gov. How to Resolve a Safety Camera Citation What counts is the arrival date, not the postmark. If you are mailing near the end of the window, submit online instead or overnight the envelope.
Why Forms Get Rejected
- No driver’s license photocopy attached. The single most common oversight; the sworn statement by itself will not be processed.
- Handwriting a clerk cannot read, especially in the citation number or signature.
- Arrival after the 75-day window. Anything late will not be processed, and you remain liable for the fine.
- Incomplete information. Portland states plainly that without “complete and accurate information, the citation will not be dismissed.”4Portland.gov. Photo Enforcement
What Happens After You Submit
Once the court has a valid certificate, staff compare the camera image against your driver’s license photo. If the person in the camera image is clearly not you, the citation is dismissed.4Portland.gov. Photo Enforcement
There is one important wrinkle. The court can reissue the citation to you one time if it looks at both images and concludes you do appear to be the driver. If that happens, a second Certificate of Innocence is not available for the reissued citation. Your remaining options are to pay the fine, request a hearing, or contest the charge in court.2Oregon Public Law. If You Miss the Deadline
Do nothing, and the court can enter a default judgment against you based on the complaint and any evidence the judge accepts.5Oregon Public Law. The typical fine for a Portland speed camera violation is $170, made up of a Class C violation presumptive fine of $165 plus a $5 surcharge.6Oregon State Legislature. Businesses and Rental Vehicles
If the citation went to a business, a public agency, or a rental car company, the Certificate of Innocence is not the right form. Those owners use a Certificate of Nonliability, and the rules are stricter: the business must name the actual driver, providing that person’s name, address, and driver’s license number, and confirming the vehicle was in the custody of an employee, renter, or lessee at the time.7Oregon Public Law. If you were driving a rental car, expect the rental company to receive the citation and respond first. Most companies pay the fine and then bill you for the amount plus an administrative fee. If you want to contest the ticket yourself, contact the rental company as soon as you learn about the citation, before they pay it on your behalf.
