To renew your SCRIE benefit, complete the renewal application the NYC Department of Finance mails you about 60 days before your current benefit expires, attach your renewal lease and income proof, and return it by mail or through the Tenant Access Portal within that same 60-day window.1NYC Department of Finance. Senior Citizen Rent Increase Exemption (SCRIE)2NYC.gov. Renewing Your Benefit Missing that deadline does not end the benefit immediately; a six-month grace period follows. But if the grace period closes without a renewal on file, your landlord can charge the full legal rent retroactive to the expiration date, and you owe the difference.3NYC311. Which Form You Fill Out
The Department of Finance sends one of two renewal forms depending on how long you have held the benefit. Tenants at five or more years get the short form: you affirm that household income has not risen by more than $1,000 since your last approval, note any new household members, and attach your renewal lease plus proof of income for anyone new.4NYC Department of Finance. SCRIE Short Form Renewal Application Tenants under five years get the standard renewal, which requires a full listing of every household member, each person’s income by source, and tax returns or other proof of earnings for everyone in the apartment.5New York City Department of Finance. Whichever form arrives in the mail is the correct one for your situation. If nothing arrives 60 days out, call 311 to request it rather than assuming you were skipped.
Eligibility You Still Have to Meet
The rules that got you in still have to hold at renewal. You must be at least 62, live in a rent-regulated apartment as your primary residence, and be named on the lease or rental agreement. Total combined household income — everyone in the apartment, not just you — must remain at $50,000 or less.6NYC.gov. Qualifications
One rule surprises renewing tenants: your rent has to exceed one-third of your total household income. This applies at renewal to most participants. Tenants whose SCRIE has been in effect continuously since on or before July 1, 2015, are exempt.7American Legal Publishing. New York City Rules 52-05 – Eligibility Requirements for SCRIE and DRIE Benefits If your income has grown while your rent stayed frozen, do the math before filing.
Documents to Gather Before You Start
Assembling the paperwork first is the difference between a 30-minute filing and weeks of back-and-forth. Depending on the form you received, expect to need most of the following:
- Proof of income. The most recently filed federal or state tax return (Form 1040 or IT-201) for every household member who files. If someone did not file, submit proof of each income source: SSA-1099 for Social Security, 1099-R for pension or IRA distributions, W-2 for wages, 1099-INT for bank interest, and so on. The Department of Finance publishes an Income Worksheet listing every category that counts.5New York City Department of Finance. NYC Department of Finance – Rent Freeze Programs
- Renewal lease. A copy of the most recent lease signed by you and your landlord. If your landlord has not offered a renewal, submit the Certification without a Lease form and proof of residency such as a utility bill.5New York City Department of Finance. - Preferential rent rider, if your landlord charges you less than the legal regulated rent. For tenants who first became eligible for SCRIE after July 1, 2019, the frozen rent is based on the preferential rent rather than the legal rent, so this rider matters to how your benefit is calculated.8New York City Department of Finance. Notice of Adoption of Final Rule
- Rent-controlled tenants only: the Notice of Maximum Collectible Rent (Form RN-26) for the last year and the current year if you have it.4NYC Department of Finance. SCRIE Short Form Renewal Application
- Major Capital Improvement (MCI) or individual apartment improvement paperwork, if your landlord received a DHCR approval for a building-wide MCI or made unit improvements. Include the approval order or the tenant-landlord agreement.
- Power of attorney or court-appointed guardianship paperwork, if someone else is signing on your behalf.
Filling In the Standard Renewal, Section by Section
The standard form runs five sections. Working in order is the fastest way through.
Sections 1 and 2: Your Information and Any Representative
Section 1 asks for name, date of birth, Social Security number, address, and contact information. Match the address to what the Department of Finance already has on file, apartment number included. Section 2 is optional and lets you designate a family member, friend, or social worker to receive your SCRIE notices and speak with the Department of Finance for you.5New York City Department of Finance. NYC Department of Finance – Rent Freeze Programs You can also add or change a representative later by filing the Rent Freeze Change Form on its own.9NYC Department of Finance. Tools
Section 3: Household Members and Income
Most errors happen here. List every person living in the apartment, whether or not they are on the lease, with name, date of birth, Social Security number, and relationship to you. For each person, check every applicable income source and enter the annual amount. The form covers Social Security, veterans benefits, wages, pension, IRA or annuity earnings, workers’ compensation, interest, capital gains, public assistance, business income, and rent collected from boarders.5New York City Department of Finance. NYC Department of Finance – Rent Freeze Programs
Every number should match a supporting document. If your 1040 shows $14,200 in Social Security and you write $14,000 on the form, the Department of Finance will flag the mismatch and slow the review. For anyone with no income, check the “No Income” certification box rather than leaving the line blank. The deductions column lets you subtract federal, state, local, and Social Security taxes actually paid; the Income Worksheet on the Department of Finance site walks through what belongs there.
Sections 4 and 5: Lease Information and Signature
Section 4 asks whether the current lease runs one year or two, and whether your landlord has added MCI or individual apartment improvement charges. If you are not sure about an MCI, check “I don’t know” and let the agency verify. Section 5 is the signature block. The primary applicant signs and dates. If a representative with power of attorney is signing, attach the authorization documents. A missing signature is the single most common reason applications come back unread, so check it before sealing the envelope.
Submitting the Application
You can file two ways.
Tenant Access Portal
The Department of Finance’s Tenant Access Portal lets you upload the signed application and scanned supporting documents as PDFs. The portal opens 60 days before your benefit expires.2NYC.gov. Use certified mail with a return receipt for a dated record of delivery. Keep a full photocopy of the form, every attachment, and the certified mail receipt. If the Department of Finance later says something is missing, your copies show what you sent.
If You Miss the Deadline
You do not lose the benefit the day it expires. NYC law gives a six-month (180-day) grace period, during which your landlord must keep charging the frozen rent.3NYC311. Rent Freeze Program Renewal For rent-stabilized tenants, the grace period runs from the start date of the new lease. For rent-controlled tenants, it runs from the beginning of the Maximum Base Rent cycle.
If the grace period ends without a renewal on file, the benefit terminates, and your landlord can collect the full legal rent retroactively for the entire six months.3NYC311. Rent Freeze Program Renewal With several years of accumulated rent increases in the background, that back-rent bill can be sizable. The grace period is a safety net, not a plan.
If you need extra time because of a disability or physical impairment, request an extension by calling 311 or submitting the Request for an Extension of Time form. Medical documentation may be required.11NYC.gov. Apply or Renew
After You Submit
The Department of Finance reviews your application and documents. There is no officially published processing timeline, and review periods vary. If something is missing, the agency mails a Request for Additional Information with a short response window, so watch your mail carefully after filing.
When the renewal is approved, both you and your landlord receive an Approval Order. Your copy shows the frozen rent amount, the exemption period, and the benefit end date.12NYC311. Rent Freeze Program for Seniors If your renewal was approved after the prior benefit expired, the new order is typically retroactive to that expiration date, so coverage does not gap.
If Your Renewal Is Denied
A denial notice states the reason, usually excess household income, a missing document, or a residency issue. You have 120 days from the date on the denial letter to file an appeal using the Department of Finance’s Tenant Appeal Application.13American Legal Publishing. New York City Rules 52-19 – Appeal Process If you need more time, you can request an extension for good cause or as a reasonable accommodation for a disability.
The appeal form asks you to identify the determination you are challenging and explain why it was wrong. Attach corrected documents or new evidence; for instance, if the denial was based on income that included a one-time distribution, you can show it was nonrecurring. Download the appeal application from the Department of Finance site or call 311 for a mailed copy.10NYC311. Rent Freeze Program Assistance Mail the completed appeal to the same P.O.
