The South Dakota Residency Affidavit is a one-page sworn statement you file with the Department of Public Safety when you want a South Dakota driver’s license or ID but can’t produce the usual proof of a physical address. To submit it, download the form, pull together your identity documents, Social Security number proof, a one-night South Dakota lodging receipt, and your mail-forwarding service contract, then sign the affidavit in front of either a notary public or a driver license examiner at the licensing station.1South Dakota Department of Public Safety. Who the Affidavit Is For
The form exists for people who cannot show a traditional proof of address like a utility bill, lease, or mortgage statement. In practice that means full-time RVers, long-term travelers, digital nomads, and overseas expats who use a commercial mail-receiving agency (sometimes called a personal mailbox or PMB service) as their South Dakota address.2South Dakota Department of Public Safety. Full-Time Travelers If you own or rent a home in South Dakota and have a standard document showing your name at a physical address, skip the affidavit; you don’t need it.
Under state law, domicile is a place where you’ve been physically present and consider home, combined with the intent to remain permanently. You can have multiple residences but only one domicile.3South Dakota Legislature. Residency Laws Signing the affidavit is your sworn statement that South Dakota is that one domicile, even when your day-to-day life takes you elsewhere.
Documents to Gather Before You Start
The affidavit is short, but it’s useless without the supporting paperwork. Collect everything before you fill anything out so you can finish the form and visit the licensing station in a single trip.
Proof of Identity
U.S. citizens must bring one original document (no photocopies):
- Certified birth certificate issued by a state or county
- Valid, unexpired U.S. passport or passport card
- Consular Report of Birth Abroad from the U.S. Department of State
- Certificate of Citizenship or Naturalization
Non-citizens can use an unexpired Permanent Resident Card, Employment Authorization Card, or a foreign passport with an I-94 Record of Arrival and Departure.4South Dakota Department of Public Safety. Driver License/ID Card Required Documents
If your current legal name is different from the name on your birth certificate, bring certified documents showing every change in between: marriage certificates, court orders, or both. The chain has to be unbroken from birth name to current name.
Proof of Social Security Number
New applicants and out-of-state transfers whose current license lacks the gold star (the REAL ID indicator) have to prove their SSN with an original Social Security card, W-2, 1099, or pay stub showing both the full name and full SSN.5South Dakota Department of Public Safety. Required Documents Photocopies won’t work here either.
One-Night South Dakota Lodging Receipt
You need a receipt proving at least one night of stay at a South Dakota hotel, motel, campground, or RV park. The receipt must show your name and the physical address of the establishment.2South Dakota Department of Public Safety. Full-Time Travelers A common approach is to book a campground near the licensing station the night before your appointment, so the stay and the station visit happen on the same trip.
Mail-Forwarding Service Contract
Bring the contract or service agreement from your commercial mail-receiving agency. It demonstrates that the South Dakota mailing address you’re claiming is active and legitimate.
Filling Out the Form
Download the Residency Affidavit directly from the South Dakota Department of Public Safety website. It’s a single-page PDF whose stated purpose is to request an exception to the standard proof-of-residency requirement for a driver’s license or ID card.1South Dakota Department of Public Safety. State of South Dakota Residency Affidavit
Enter your full legal name exactly as it appears on your identity document, whether that’s your birth certificate or passport. For the South Dakota address, most full-time travelers put the street address of their mail-forwarding service. Add your current mailing address if it’s different.
Check that the name on the affidavit matches the name on your lodging receipt and your identity documents. Mismatches between documents are one of the fastest ways to get turned away at the counter.
The affidavit carries a perjury statement: by signing, you swear under oath that everything on the form is true and correct.2South Dakota Department of Public Safety. Full-Time Travelers Don’t sign yet. Your signature has to be witnessed.
Signing in Front of a Notary or Examiner
The affidavit must be signed in front of either a notary public or a South Dakota driver license examiner.1South Dakota Department of Public Safety. State of South Dakota Residency Affidavit Signing in front of the examiner at the licensing station is usually simpler because it folds the witnessing step into the appointment you’re already making.
If you prefer to get it notarized ahead of time, bring a valid government-issued photo ID to the notary. One detail worth flagging: if you use a California notary, the notary page must specifically name the residency affidavit as the accompanying document being signed. South Dakota’s form calls this out for California notarizations. Notaries in other states follow their own state’s procedures.
Submitting the Affidavit at a Licensing Station
South Dakota operates permanent and mobile driver licensing exam stations around the state, and you can find locations and schedule an appointment through the Department of Public Safety’s online portal. Bring the complete packet: the affidavit (notarized, or unsigned if you plan to sign in front of the examiner), your lodging receipt, your identity document, SSN proof, and your mail-forwarding contract.
The examiner reviews everything, and you can expect a vision screening. New applicants and out-of-state transfers may also have to take a written knowledge test and possibly a driving skills test, depending on license history. Applicants who already hold a valid South Dakota license and are simply renewing go through a lighter process.
Fees
A standard driver’s license costs $38, and a non-driver ID card also costs $38. Renewals carry the same fee.6South Dakota Department of Public Safety. Fees Payment is due at the time of application. Stations accept cash, checks, money orders, and Visa, Mastercard, American Express, and Discover. Debit card transactions carry a $2 fee. Credit card transactions carry a fee of $2 or 2.95 percent of the charge, whichever is greater.
What You Leave With, and What Comes Later

What the Affidavit Does Not Cover
The residency affidavit applies to your driver’s license or ID card only. It isn’t a required document for vehicle registration. You do need a valid South Dakota license or ID to register a vehicle, so the affidavit is an indirect prerequisite, but vehicle registration itself goes through the Department of Revenue, a separate agency from the Department of Public Safety that issues your license.9South Dakota Department of Revenue. Penalties for a False Affidavit
The perjury clause on the affidavit is not boilerplate. Signing with knowingly false information is perjury under South Dakota law, and when it happens outside a trial or formal court proceeding, as on a government affidavit, perjury is a Class 6 felony.10South Dakota Legislature. South Dakota Codified Laws 22-29 Possessing or displaying a fraudulently obtained driver’s license is a separate Class 1 misdemeanor, punishable by up to one year in county jail, a fine of up to $2,000, or both.11South Dakota Legislature. South Dakota Codified Laws 22-6-2 If you’re claiming South Dakota as your domicile, the state expects you to mean it.
