The UC Statement of Legal Residence is the online questionnaire every incoming and continuing University of California student completes so the campus can decide whether you pay resident or nonresident tuition. You fill it out through UC’s residency portal, answer questions about where you have lived and how you support yourself, and upload documents that show you meet California’s residency rules by the Residence Determination Date for your enrollment term. Getting it right the first time matters: for 2026–27, nonresident supplemental tuition alone runs $39,270 on top of the resident rate.1Legislative Analyst’s Office. The 2026-27 Budget: Nonresident Tuition Rates at UC
Know Your Residence Determination Date
Every part of the SLR is measured against the Residence Determination Date (RDD) for the term you plan to enroll. By that date, you must have been physically present in California for at least 366 continuous days and established the required legal ties. For 2025–26, the RDDs are:2University of California Office of the President. Residence Policy Guidelines 2025-26 Academic Year
- Fall quarter: August 27
- Winter quarter: January 5
- Spring quarter: March 30
- Fall semester (Berkeley and Merced): August 27
- Spring semester (Berkeley and Merced): January 20
Count back 366 days from the RDD. That is the latest date you needed to be in California and building the record you will later show on the SLR. Miss the RDD by a day and you will not qualify for that term, no matter how strong your other evidence is.
What the SLR Is Asking You to Prove
The questionnaire exists to test three things: physical presence, intent to remain in California, and (for most students under 24) financial independence. You have to satisfy all three. Falling short on one produces a nonresident classification.
Physical Presence
You must be continuously physically present in California for more than one year immediately before the RDD.3UC Santa Barbara Office of the Registrar. UC Residence Policy and Guidelines Short trips out of state for vacation or family are fine so long as your California home remains your home. Moving back to another state, keeping a primary residence elsewhere, or spending long stretches outside California without a clear reason to return breaks the clock.
Being here mainly to attend school does not, on its own, make you a resident. Under California Education Code 68017, presence for the purpose of enrollment does not confer resident status.4California Community Colleges Chancellor’s Office. Residency for Tuition Purposes General Overview You also have to show California is your permanent home.
Intent to Remain
California law says residence changes “only by the union of act and intent.”5California Legislative Information. California Code Education Code 68040 – Classification UC looks for four specific governmental ties, and all four are required:6University of California San Diego. Residency Requirements: Undergraduate Students
- A California driver’s license or state ID, with any out-of-state license surrendered.
- California voter registration, if you are legally eligible to register.
- California vehicle registration for every motor vehicle you own (or your parents own, if you are a dependent student).
- A California state tax return filed as a resident, effective from the date you declared residency. Returns amended after you submit the SLR will not count for the term being evaluated.
All four ties need to be in place at least a year before the RDD. Cutting ties on the other side matters too. Keeping an out-of-state license or voter registration active will undermine your claim even if everything on the California side is done.
Financial Independence If You Are Under 24
If you will not turn 24 by December 31 of the year your term begins, and you are not the dependent of a California-resident parent, you also have to prove financial independence.7University of California, Merced. Statement of Legal Residence Financial Independence Overview This is the requirement that makes resident status very hard for most out-of-state undergraduates, including California community college transfers whose parents live elsewhere.
Two things have to be true. You cannot have been claimed as a tax dependent by anyone for the current tax year and the two years before your target term. And you need documentation that you covered your own living and educational expenses over that same period using your own resources: wages from your own work, financial aid, and loans obtained on your own credit without a co-signer.
What does not count: loans or gifts from parents; gifts from friends or relatives around the time of enrollment; free room and board from anyone; and funds from a savings account or trust established after your 14th birthday. If a substantial portion of your support comes from those sources, you will be classified as a nonresident.
Documents to Gather Before You Start
Open the SLR only after you have your evidence assembled. The residency deputy reviewing your form may ask for any of these:8University of California. The Process for Determining Residency
- California driver’s license or state ID, plus proof you surrendered any out-of-state license
- California vehicle registration
- Voter registration confirmation
- State and federal tax returns filed as a California resident
- Bank statements showing local activity
- Lease, pay stubs, or other employment and housing verification
- Selective Service registration if applicable
Check that the dates line up. If your driver’s license is dated March 15 but you tell the SLR you arrived on January 1, that two-month gap invites questions. Date inconsistencies are among the most common reasons applications get flagged for additional review.
One practical step before you upload anything: redact your Social Security number from tax returns, bank statements, and any other attachment.9Office of the University Registrar. Statement of Legal Residence The portal will ask directly for identifying information it needs; your uploads should not carry SSNs.
Filling Out and Submitting the Form
The SLR lives at residency-for-tuition.universityofcalifornia.edu.10University of California. UC Residency Determination Applicants reach it from the UC application. Continuing students access it through their campus student portal or registrar’s website.11UCLA Registrar’s Office. Statement of Legal Residence
The questionnaire asks about your citizenship or immigration status, when you arrived in California, everywhere you have lived, and the legal ties you have established. If you are under 24, it also asks about your parents’ residency, work, and tax filings. Your answers determine which supporting documents the system requests, so work through it carefully.
After the questionnaire, upload your documents through the same portal. Save digital copies of everything you submit. Uploads occasionally fail or corrupt, and you will want to resubmit fast if that happens.
After You Submit
A campus residency deputy reviews your submission against UC’s requirements.8University of California. The Process for Determining Residency The deputy may ask for more: additional proof of physical presence, more financial independence documentation, verification of immigration status. Those requests are routine and don’t mean the application is failing.
Respond quickly. Letting a documentation deadline pass results in a default nonresident classification and a bill for the full supplemental tuition that term. Decisions come through your campus email and student portal.
Timelines vary by campus and by how complete your submission was. Clean cases resolve in a few weeks; cases needing follow-up take longer. Submit well ahead of your enrollment date so back-and-forth does not delay registration.
Veterans and Military-Connected Students
Federal law creates a shortcut. Under 38 U.S.C. § 3679, any public university that wants to stay approved for GI Bill and Veteran Readiness and Employment programs must charge covered individuals the in-state rate regardless of official residency.12Office of the Law Revision Counsel. 38 USC 3679 – Disapproval of Courses Covered individuals include veterans using Post-9/11 or Montgomery GI Bill benefits and qualifying dependents, provided they live in the state where the campus is located.
You still complete the SLR, but you should receive a nonresident supplemental tuition exemption even without 366 days of presence or the four intent items. Contact your campus veterans’ services office about documentation.
AB 540 Exemption
Students who cannot qualify as California residents, including many undocumented students, may still be exempt from the nonresident supplemental tuition under AB 540. Eligibility requires all three:13University of California Admissions. AB 540 Nonresident Tuition Exemption
- Three or more years of full-time attendance (or equivalent) at a California high school, adult school, or community college; or three years of California high school coursework combined with three years at a California elementary or secondary school.
- Graduation from a California high school (or equivalent), an associate’s degree from a California community college, or completion of minimum transfer requirements from a California community college to a UC or CSU campus.
- A signed California Nonresident Exemption Request form.
AB 540 does not reclassify you as a resident. It waives the nonresident supplemental tuition so you pay the resident rate. You apply for it through the SLR process.
If You Are Classified as a Nonresident
Two paths exist if the first decision doesn’t go your way.
Continuing students who have since met the requirements can file a Petition for Reclassification for a future term. Deadlines are set by each campus. At UC Davis, for instance, the fall petition is due September 1, with winter and spring petitions due no later than the first day of instruction.14UC Davis Office of the University Registrar. Petition for Classification to Resident Form and Instructions The evidence looks like the original SLR: 366 days of presence, all four intent items, and (if under 24) financial independence. Reclassification is not retroactive. It applies only to the term you petition for and beyond, not to tuition already paid.
You can also appeal, but only on two grounds:15UCLA Registrar’s Office. Appeal a Nonresident Classification
- UC error: a significant factual error, procedural error, or misapplication of policy that, if corrected, would produce a resident classification.
- Significant new information that you could not reasonably have known about or obtained earlier.
You file the UC Application to Appeal Nonresident Determination through the UC Office of the President. The UC Office of General Counsel handles reviews and typically takes six to eight weeks after receiving your submission. An appeal that repeats the original evidence without identifying an error or new information is unlikely to succeed.
Answer Honestly
The SLR requires you to certify that everything you submit is accurate. False information can trigger discipline up to dismissal, and you can be billed back the difference between resident and nonresident tuition for every term you were incorrectly classified. Given the current $39,270 annual supplement, that back-bill can exceed $100,000 over four years.1Legislative Analyst’s Office.
