West Virginia’s resale certificate, Form F0003, lets a registered business buy inventory and raw materials without paying the state’s 6% sales tax, provided the goods will be resold to a customer. The form is officially the Streamlined Sales Tax Certificate of Exemption, it has six required sections, and it goes to your vendor, not to any government office.1Streamlined Sales Tax Governing Board. What the Resale Exemption Actually Covers
West Virginia exempts sales of tangible personal property purchased for resale in the form of tangible personal property. That includes finished goods you stock for sale and raw materials that physically become part of a product you manufacture, like lumber a furniture maker turns into a desk or fabric a tailor sews into a garment.2West Virginia Legislature. West Virginia Code Chapter 11 Taxation 11-15-9 – Exemptions
Two things the exemption does not cover. Building materials and supplies a contractor installs into real property are treated as end-use purchases by the contractor, not resale inventory, even though they end up in a finished structure sold to a client.2West Virginia Legislature. West Virginia Code Chapter 11 Taxation 11-15-9 – Exemptions And anything your business consumes internally — office supplies, cleaning products, break-room coffee — stays fully taxable. The test is simple: if the item will be sold to a customer, the exemption applies; if your business is the final user, it does not.
Register Your Business First
Before a vendor will accept Form F0003 from you, you need a West Virginia Business Registration Certificate from the State Tax Department. Every person or entity doing business in the state is required to have one.3West Virginia Tax Division. The certificate is permanent and stays valid unless your business name changes, you move, ownership changes, or the Tax Commissioner suspends or revokes it.3West Virginia Tax Division. Filling Out the Six Sections
Form F0003 is available on the West Virginia State Tax Department’s Streamlined Sales and Use Tax page.5West Virginia Tax Division. Streamlined Sales and Use Tax All six sections must be completed; a certificate missing any section is not valid.6Streamlined Sales Tax Governing Board. Streamlined Sales Tax Certificate of Exemption
Section 1: Single Purchase or Blanket
Check the single-purchase box and enter the invoice number if the certificate covers only one transaction. Leave it unchecked to make it a blanket certificate that applies to all qualifying purchases from the same vendor going forward.6Streamlined Sales Tax Governing Board. Section 2: Purchaser and Seller Information
Enter the full legal name, street address, city, state, country, and zip code for both your business and the vendor. Use your legal business name exactly as it appears on your registration certificate.
Section 3: Type of Business
Check the numbered category that best describes what you do. The form lists retailer, wholesaler, manufacturer, and other common categories. If none fits, check option 20 (Other) and write a brief description.6Streamlined Sales Tax Governing Board. Streamlined Sales Tax Certificate of Exemption
Section 4: Reason for Exemption
Check the letter matching your reason. For inventory purchases, this is Resale. If none of the listed reasons fit, check L (Other) and explain.6Streamlined Sales Tax Governing Board. Streamlined Sales Tax Certificate of Exemption
Section 5: Identification Number
Enter your state tax ID number and identify the state that issued it. If you claim exemptions in more than one state, list the ID number and reason for each.6Streamlined Sales Tax Governing Board. Streamlined Sales Tax Certificate of Exemption
Section 6: Signature
An authorized representative signs and dates the form. A signature is required on paper certificates.7West Virginia Legislature. West Virginia Code 11-15B-24 – Administration of Exemptions
Be specific when you describe your business and the items you’re buying. A clothing retailer buying wholesale garments should say “retail apparel sales,” not just “retail.” Vague descriptions invite questions during audits and give vendors reason to reject the certificate outright.
Blanket Certificates vs. Single-Purchase Certificates
A blanket certificate stays in effect until you cancel it, as long as no more than 12 months pass between purchases from that vendor. If the gap stretches beyond a year, the vendor will need a fresh certificate.6Streamlined Sales Tax Governing Board. Streamlined Sales Tax Certificate of Exemption For a one-time order or a supplier you don’t expect to use again, check the single-purchase box in Section 1 and include the invoice number so the certificate is clearly tied to that transaction.
Giving the Form to Your Vendor
Hand the completed form directly to the seller. The form itself is explicit: “Do not send this form to the Streamlined Sales Tax Governing Board. Send the completed form to the seller and keep a copy for your records.”1Streamlined Sales Tax Governing Board. Streamlined Sales Tax Certificate of Exemption A physical copy or a digital file both work, depending on what your vendor prefers.
Timing has some give. Present the certificate at the time of sale if you can; otherwise you have up to 90 days after the sale date to provide it.1Streamlined Sales Tax Governing Board. Streamlined Sales Tax Certificate of Exemption After 90 days, vendors generally won’t accept a late certificate because they lose the liability protection that comes with it.
Expect scrutiny. Under West Virginia law, all sales are presumed taxable, and the burden of proving a sale was exempt falls on the vendor unless they hold a properly completed certificate.8West Virginia Legislature. West Virginia Code Chapter 11 Taxation 11-15-6 A seller stuck with uncollected tax because of a defective certificate has every incentive to check your ID number and item descriptions before processing the sale tax-free.
Keeping Your Records
Keep a copy of every certificate you give out. Sellers are required to maintain proper records of exempt transactions and produce them when the Tax Commissioner requests them, and if the certificate on your end disappears while the vendor’s is also missing, the sale defaults to taxable.7West Virginia Legislature. West Virginia Code 11-15B-24 – Administration of Exemptions The exemption statute itself does not set a minimum retention period, but holding onto certificates for three to five years lines up with standard state audit windows. Digital copies are acceptable; there’s no requirement to keep paper originals.
Consequences of Misusing the Certificate
Using Form F0003 to avoid tax on items you’ll use yourself or consume in your business is treated as tax evasion. The purchaser who improperly claims an exemption becomes directly liable for the unpaid tax, plus interest and penalties assessed by the Tax Commissioner.7West Virginia Legislature. West Virginia Code 11-15B-24 – Administration of Exemptions Operating without a valid Business Registration Certificate can bring per-day fines on top of that.
Most misuse surfaces during routine audits, when an examiner compares the goods purchased tax-free against the business type on the certificate. A landscaping company that claimed a resale exemption on riding mowers used on client properties would stand out immediately, because the mower is a business-use asset, not resale inventory. When you’re unsure whether a purchase qualifies, pay the tax at the register and apply for a refund later if the exemption turns out to apply.
