How to Get a Business License in Nevada: SilverFlume, Costs, Renewal

To get a business license in Nevada, you apply for a State Business License through the Secretary of State’s online portal, SilverFlume. The fee is $200 for most business types and $500 for corporations, and the license must be renewed every year.1Nevada Legislature. NRS Chapter 76 – State Business Licenses NRS 76.100 requires the license before you conduct any business in the state, and that rule applies to corporations, LLCs, partnerships, and sole proprietors alike.2Nevada Legislature. Nevada Revised Statutes 76.100 – State Business License Required; Application and Fee for License; Activities Constituting Conduct of Business Most businesses also need a separate local license from their city or county, so plan for both.

What to Have Ready Before You Apply

The State Business License application asks for your legal entity name, the type of business activity, a NAICS code, and a signature from someone authorized to sign for the business. Sole proprietors and general partners sign personally; LLCs and corporations have a member or officer sign for the entity.2Nevada Legislature. Nevada Revised Statutes 76.100 – State Business License Required; Application and Fee for License; Activities Constituting Conduct of Business A few pieces need to be in place first.

Choose Your Business Structure

Sole proprietorships and general partnerships don’t file formation documents with the Secretary of State and can go straight to the license application. LLCs file articles of organization, and corporations file articles of incorporation. Your structure sets which formation documents you file, the fees you pay, and how you’re taxed.

Appoint a Registered Agent

Every corporation and LLC must designate a registered agent who either resides in Nevada or is authorized to do business here, with a physical Nevada street address (not a P.O. box) where legal documents can be served.3Nevada Legislature. Nevada Revised Statutes 78.090 – Registered Agent Required; Address of Registered Office You can serve as your own agent if you have a qualifying address, or hire a commercial registered agent service.

Get a Federal EIN

An Employer Identification Number from the IRS is required for most entities and is a practical necessity for sole proprietors who plan to hire or open a business bank account. The IRS recommends forming your entity with the state first, since applying for an EIN before the entity is registered can delay processing.4Internal Revenue Service. Get an Employer Identification Number The online application is free and issues the number immediately.

Pick Your NAICS Code

The application requires a six-digit NAICS code classifying your primary business activity. The U.S. Census Bureau maintains the official directory with a keyword search tool.5U.S. Census Bureau. North American Industry Classification System – NAICS Choose carefully. The same code determines your Commerce Tax rate later if your Nevada gross revenue crosses $4 million in a taxable year.6Nevada Legislature. NRS Chapter 363C – Commerce Tax

Business – Nevada Secretary of State In a single session you can file articles of incorporation or organization, submit the initial list of officers or managers, and obtain your State Business License.

For entities formed under NRS Title 7, including corporations, LLCs, and limited partnerships, the initial list of officers or managers and the State Business License fee are due no later than the last day of the month after you file your formation documents.8Nevada Secretary of State. State Business License – FAQ Filing the initial list costs $150 for corporations.9Nevada Legislature. Nevada Revised Statutes 78.150 – Filing Requirements

Corporations formed under NRS Chapters 78, 78A, or 78B, along with foreign corporations filing under Chapter 80, pay the $500 license fee. Every other business type pays $200.1Nevada Legislature. NRS Chapter 76 – State Business Licenses The portal accepts major credit cards and pre-funded Secretary of State trust accounts for frequent filers. After payment, you get an immediate transaction receipt and can download a digital certificate once background verification is complete. Save both.

Sole proprietors and general partnerships follow a shorter path on SilverFlume since they skip formation documents. Your Local City or County License

The State Business License does not replace local licensing. Your city or county almost certainly requires its own general business license, and possibly extra permits depending on your business type and location.

First determine whether your business address sits inside an incorporated city or in unincorporated county territory, because that decides which office has jurisdiction. Local applications typically ask for details about your premises, including square footage and intended use. If you’re operating from home, expect to need a home occupation permit or a similar zoning waiver confirming that your neighborhood allows commercial activity.

Local timelines run longer than the state’s. Clark County, for example, estimates about 45 days for a general business license once it receives a complete application, and applications that trigger fire, health, or building inspections can take longer. Some cities accept online filings through their own portals; others still require paper applications by mail or in person. For anything mailed, use certified mail so you have a delivery record.

Fictitious Firm Name

If you plan to operate under a name different from your legal name or the entity name on your formation documents, Nevada requires you to file a fictitious firm name certificate with the county clerk in every county where you conduct business.10Nevada Legislature. NRS Chapter 602 – Doing Business Under Assumed or Fictitious Name That covers sole proprietors using a trade name, LLCs operating under a brand name, and corporations doing business under anything other than their articles-of-incorporation name. Fees vary by county.

Regulated Occupations Need Additional Licenses

Certain occupations require a separate professional license from a state board before you can practice. NRS Title 54 covers dozens of regulated professions, from engineers and land surveyors to contractors, nurses, and accountants.11Nevada Legislature. Nevada Revised Statutes 625.381 – Licenses: Issuance; Content; Effect Each board sets its own education, examination, and fee requirements. Initial fees for regulated professionals typically range from $50 to $300 depending on the profession.

These credentials are additional to, not a substitute for, the State Business License and any local license. A licensed contractor starting a construction company needs all three. Many boards also require proof of insurance or a surety bond before issuing credentials.

Tax Registrations to Handle Alongside the License

Nevada has no corporate or personal income tax, but selling taxable goods or hiring employees still triggers state tax registrations. If your business sells tangible goods or certain taxable services, you must register for a Sales/Use Tax Permit with the Nevada Department of Taxation. Register online through the My Nevada Tax portal or by mailing the Nevada Business Registration Form. The fee is $15 per business location, and you’ll need your EIN and State Business License number before registering. Online applicants get their permit ID within 24 hours; paper applications take several weeks.12State of Nevada. Register a Business FAQs

If you have employees, Nevada also imposes the Modified Business Tax on wages, filed quarterly, with a return due for every quarter even if you paid no wages that period.13State of Nevada. Modified Business Tax (MBT) FAQs

Renewing Every Year

Both the State Business License and the annual list of officers or managers are due on the last day of the anniversary month in which you originally filed your formation documents.8Nevada Secretary of State. State Business License – FAQ The renewal fee matches the initial fee: $500 for corporations, $200 for everyone else.

The annual list fee for corporations starts at $150 and scales upward based on the total value of authorized shares, so a corporation with more than $75,000 in authorized capital pays progressively more.9Nevada Legislature. Nevada Revised Statutes 78.150 – Filing Requirements Local jurisdictions run their own renewal schedules, often on a different cycle than the state, and some base renewal cost on gross receipts. Track both.

What Happens If You Skip It

Operating without a State Business License carries a $100 penalty for each year you conducted business without one, on top of the license fee itself.14Nevada Legislature. Nevada Revised Statutes 76.110 – Penalty for Failing to Obtain State Business License Before Conducting Business The penalty applies to entities that never got a license and to those that let their renewal lapse.

The bigger risk is downstream. Failing to file your annual list and renew your license can lead to administrative revocation of your entity’s right to do business in Nevada. Once revoked, you lose the legal protections your entity provides, including the liability shield that LLCs and corporations offer their owners. Reinstatement means paying all back fees, penalties, and often a reinstatement fee on top, and contracts signed during the gap can face legal challenges. Filing on time each year costs less than any of that.
