How to Get a Certificate of Rehabilitation in California

To get a Certificate of Rehabilitation in California, you wait out a rehabilitation period that runs from three to ten years after your sentence ends, file a free petition in the Superior Court where you live or were convicted, give at least 30 days’ notice to the District Attorney and the Governor, and then convince a judge at a hearing that your conduct since the conviction shows you’ve been rehabilitated. If the judge signs the certificate, it’s forwarded automatically to the Governor as a formal pardon application.

Check Whether You Qualify

The certificate is available to two groups. The first is anyone convicted of a felony who served time in state prison. The second is a narrower group: people convicted of a misdemeanor sex offense listed under Penal Code Section 290 whose case was later dismissed under Penal Code Section 1203.4, provided they haven’t been incarcerated since the dismissal and aren’t currently on felony probation.1California Legislative Information. You also need to have lived in California continuously for at least five years before filing.2County of Fresno. Certificate of Rehabilitation (Penal Code Sections 4852.01, 4852.21)

Some people are shut out of the court process entirely under Penal Code Section 4852.01(c):

  • People serving a life sentence with the possibility of parole, or a death sentence.
  • People convicted under Penal Code Sections 269, 286(c), 287(c) (formerly 288a(c)), 288, 288.5, 288.7, or 289(j).
  • People in military service at the time of the offense.

Being ineligible for a certificate doesn’t close every door. The Governor can still grant a direct pardon in extraordinary cases, but the court-based route is unavailable.1California Legislative Information. California Penal Code 4852.01

Count Out the Waiting Period

You can’t file right after release. The rehabilitation clock starts on the earliest of these dates: your release from custody, or the day you began parole, post-release community supervision, mandatory supervision, or probation. From that date, the total waiting period is the five-year California residency plus additional years tied to the offense:3California Legislative Information. California Penal Code 4852.03

  • Seven years total for most offenses (five plus two).
  • Nine years total for murder, kidnapping, train wrecking, assault by a life prisoner, or any other offense carrying a life sentence (five plus four).
  • Ten years total for sex offenses requiring registration under Penal Code Section 290 (five plus five).

If you served consecutive sentences on multiple convictions, the judge can extend the waiting period, though the total cannot exceed the sum of the maximum penalties for all your convictions combined. Throughout this period, you must live honestly, stay sober, show good moral character, and obey the law.4California Legislative Information. California Penal Code PEN 4852.05

File the Petition

Once the waiting period is met, file in the Superior Court of the county where you currently live or where you were convicted.5California Legislative Information. Petition forms are available from the Superior Court clerk or the California Courts self-help site. The certificate petition is a different form from the Petition for Dismissal (Form CR-180), which handles a separate kind of record relief, so ask the clerk to point you to the correct paperwork.7California Courts Self-Help Guide. What to Put in the Petition

You’ll need the specifics of every felony on your record: date of conviction, the charges, county, and sentence. You’ll also need your release dates and the dates you finished parole or probation.8California Department of Corrections and Rehabilitation. Petition for Certificate of Rehabilitation and Pardon Requesting your criminal history report (RAP sheet) from the California Department of Justice first is the easiest way to confirm those dates.9California Courts. Include your residences and employment history for the rehabilitation period. That’s the evidence a judge is looking for.

Give Notice

After you file, you must serve formal notice on the District Attorney of the county where you’re filing and on the Governor’s office. Notice has to go out at least 30 days before the hearing.10California Legislative Information. California Penal Code 4852.07

Go Through the Hearing

Expect a wait before the hearing is set. The District Attorney’s office investigates your background, checking for new arrests and looking at how you’ve conducted yourself during the rehabilitation period. In some counties, the DA’s office is the one that schedules the hearing after finishing that investigation.9California Courts. Certificate of Rehabilitation

At the hearing, you’ll have the opportunity to explain why you believe you’ve been rehabilitated. The judge must find two things: that your conduct since the conviction shows genuine rehabilitation, and that you are fit to exercise all the civil and political rights of citizenship. If both findings are made, the court issues the certificate, and it operates as an official recommendation that the Governor grant a full pardon.11California Legislative Information. California Penal Code PEN 4852.13

One extra rule applies in sex offense cases: even when every other requirement is satisfied, the certificate will not be granted if the court determines you still present a threat to minors.11California Legislative Information. California Penal Code PEN 4852.13

What the Certificate Actually Gets You

The certificate does not erase your record. Your conviction will still appear on background checks. What it does is create an official court finding of rehabilitation, and that carries weight in a few concrete places:

  • State licensing boards must consider the certificate when deciding whether to issue a professional license, and for many boards it creates a presumption in your favor.
  • You have documented proof of rehabilitation to give employers, though private employers aren’t required to hire you.
  • The certificate is automatically forwarded to the Governor as a formal pardon application, giving you a judicial recommendation that a direct pardon application would lack.

Two boundaries are worth being clear about. The certificate is not an expungement and does not seal any records. And a certificate issued on or after July 1, 2021 does not by itself relieve you of the duty to register as a sex offender; that requires a separate petition under Penal Code Section 290.5.3California Legislative Information. What Happens After the Judge Signs

Once the certificate is signed, the court clerk sends a certified copy to the Governor’s office. That transmission is the pardon application, and you don’t need to file anything else.9California Courts. Certificate of Rehabilitation

From there, the Board of Parole Hearings reviews the certificate, conducts its own assessment, and issues a recommendation to the Governor.8California Department of Corrections and Rehabilitation. Petition for Certificate of Rehabilitation and Pardon The Governor has complete discretion. A pardon is never guaranteed, many people who receive certificates never receive pardons, and the review can take years. The certificate is a real result on its own; the pardon is a separate outcome you may or may not eventually see.
