To get a Federal Firearms License in Texas, you file ATF Form 7/7CR with the Federal Firearms Licensing Center, pay the fee for the license type you want, submit photos and fingerprint cards for every responsible person, and pass an in-person interview at your business premises. Texas does not require a separate state dealer license, which spares you a layer of paperwork applicants in other states must handle. From the day the ATF receives a complete application, the process runs roughly 60 days.
Pick the Right License Type
The ATF issues nine FFL types, and each one authorizes a specific activity. Choosing the wrong type means paying for a license that doesn’t cover what you actually want to do.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Federal Firearms Licenses
- Type 01 — Dealer. Retail and wholesale firearms sales and gunsmithing. The default choice for a gun shop. $200 application; $90 renewal every three years.
- Type 02 — Pawnbroker. Everything a Type 01 covers, plus taking firearms as collateral. $200 application; $90 renewal.
- Type 03 — Collector of Curios and Relics. Personal collecting of firearms on the ATF’s C&R list. Not a business license. $30 application; $30 renewal.
- Type 06 — Ammunition Manufacturer (excluding armor-piercing and destructive-device ammo). $30 application; $30 renewal.
- Type 07 — Firearms Manufacturer. Covers manufacturing firearms and ammunition other than destructive devices. $150 application; $150 renewal.
- Type 08 — Importer of firearms and ammunition. $150 application; $150 renewal.
- Types 09, 10, and 11 — Dealer, manufacturer, and importer of destructive devices. $3,000 application; $3,000 renewal.
Every license runs three years. Most Texas applicants land on a Type 01 or a Type 07. The gap between them is only $50 at application and $60 at renewal, so if there is any real chance you will build a firearm, the Type 07 pays for itself.
Confirm You Qualify
You must be at least 21 and either a U.S. citizen or a lawful permanent resident. The ATF will run a federal background check on every “responsible person” on the application. Under 18 U.S.C. § 922(g), the license will be denied if any responsible person has:2Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons
- A felony conviction (any crime punishable by more than one year, regardless of the sentence actually served).
- A misdemeanor conviction for domestic violence.
- A dishonorable discharge from the military.
- An active restraining order involving an intimate partner or their child.
- A history of unlawful drug use or addiction to a controlled substance.
- A mental-health adjudication or involuntary commitment.
A “responsible person” is anyone with authority to direct the management and policies of the firearms business — sole proprietors, corporate officers, directors, partners, majority shareholders.3eCFR. 27 CFR 478.11 – Meaning of Terms If someone in that role is a prohibited person, either remove them from the application or expect a denial.
Handle the Texas Pieces Before You Apply
Texas does not issue its own firearms dealer license. Once your federal license issues, you can operate in Texas without a parallel state permit. But a few state and local requirements still apply, and getting ahead of them prevents avoidable problems at the ATF interview.
Local zoning is the single biggest tripwire. The ATF will not issue a license if the proposed location violates a local ordinance, and Texas cities each set their own rules. Home-based FFLs are allowed by the ATF, but many Texas municipalities restrict customer traffic, signage, and hazardous-material storage in residential zones. Call your city or county planning office before you submit anything, and get written confirmation that a firearms business is permitted at your address.
Sales tax permit. Texas charges 6.25% state sales tax on firearms and ammunition, and local jurisdictions can add up to 2%, for a combined rate as high as 8.25%. Register for a sales tax permit through the Texas Comptroller’s office before your first sale.
Safe-storage warning. Texas law requires firearms dealers to post warnings about safe storage of firearms.
Pawnbroker display rule. Pawnbrokers may not display pistols in storefront windows, sidewalk cases, or any signage visible from the street.
Fill Out and Submit Form 7/7CR
ATF Form 7/7CR is available on the ATF website. It asks for your personal information, the business name and address, entity type (sole proprietorship, LLC, corporation), and the license type you’re seeking.4Bureau of Alcohol, Tobacco, Firearms and Explosives. Form 7/7CR Instructions – Application for Federal Firearms License
With the form, every responsible person must submit a passport-style 2″x2″ photograph and a completed FD-258 fingerprint card. The Type 03 collector’s license is the one exception; it does not require photos or fingerprints.
You also need a legitimate business location before you apply. Home-based operations are allowed, but you have to be able to show you’ll run it as an actual business — regular hours, proper record storage, secure firearm storage — and that local zoning permits it. The ATF investigator will verify all of this in person.
Mail the completed form, photographs, fingerprint cards, and fee (check, credit card, or money order; no cash) to the Federal Firearms Licensing Center in Portland, Oregon. The FFLC processes the fee and runs background checks on every responsible person.5Bureau of Alcohol, Tobacco, Firearms and Explosives. Apply for a License
The ATF Interview and the 60-Day Timeline
For every license type except the Type 03 collector, an ATF Industry Operations Investigator will schedule an in-person interview at your proposed business location. The IOI is checking that the premises exist and match what you described, that local zoning allows a firearms business there, that you have a plan for secure storage, and that you understand the recordkeeping obligations that come with the license. The investigator will also walk you through compliance expectations.
Treat the interview as a business meeting. The IOI is evaluating whether you’re prepared to operate lawfully, not looking for reasons to say no. The investigator then writes a report with a recommendation to the FFLC. From receipt of a complete application, the whole process takes approximately 60 days.5Bureau of Alcohol, Tobacco, Firearms and Explosives. Apply for a License
If Your Application Is Denied
A denial isn’t the end. The ATF must send a written notice explaining the specific grounds. You can request a hearing, which the ATF must hold at a location convenient to you.6Office of the Law Revision Counsel. 18 US Code 923 – Licensing
If the hearing goes against you, you have 60 days from receiving notice of the final decision to petition for judicial review in the U.S. District Court for the district where you live or do business. The court conducts a fresh review and can consider evidence that wasn’t part of the administrative record. If it finds the ATF wasn’t authorized to deny the application, it will order the license issued.
Extra Registrations Depending on What You’ll Sell
Special Occupational Tax for NFA Items
If you want to deal in suppressors, short-barreled rifles, short-barreled shotguns, or machine guns, your FFL alone isn’t enough. You also need to pay a Special Occupational Tax and register in the right class:
- Class 3 — Dealer of NFA firearms. Requires a Type 01, 02, or 09 FFL.
- Class 2 — Manufacturer of NFA firearms. Requires a Type 07 or 10 FFL.
- Class 1 — Importer of NFA firearms. Requires a Type 08 or 11 FFL.
The SOT is an annual tax; the tax period runs July 1 through June 30. It’s paid on ATF Form 5630.7 and is separate from your FFL fees.
ITAR Registration for Manufacturers
Type 07 and Type 10 holders have one more federal registration to worry about: the State Department’s Directorate of Defense Trade Controls under the International Traffic in Arms Regulations. This applies even if you never plan to export. The DDTC is explicit that manufacturers who do not engage in exporting are still required to register.7Directorate of Defense Trade Controls. Registration ITAR carries its own fee. Failing to register can result in significant civil and criminal penalties, so build it into your startup checklist.
What Comes After You’re Licensed
Getting the license is the easy part. Keeping it takes consistent recordkeeping. Every firearm that enters or leaves inventory must be logged in a bound acquisition and disposition book with manufacturer, model, serial number, type, caliber, date, and the other party’s identity.8eCFR. 27 CFR 478.125 – Record of Receipt and Disposition Before transferring a firearm to any unlicensed buyer, run a NICS check through the FBI’s NICS Operations Center; Texas is not a point-of-contact state.9eCFR. 28 CFR 25.6 – Accessing Records in the System A valid Texas License to Carry qualifies as an alternative to the NICS check under the Brady Act, which can speed up transactions.10Bureau of Alcohol, Tobacco, Firearms and Explosives. The ATF can inspect your premises and records once every 12 months, and refusing an inspection is itself a basis for revocation.11Bureau of Alcohol, Tobacco, Firearms and Explosives. The ATF can revoke a license for even a single willful violation of the Gun Control Act.13Bureau of Alcohol, Tobacco, Firearms and Explosives. Revocation of Firearms Licenses Mark your expiration date the day the license arrives. Before three years is up, the ATF will send a renewal notice with Form 8 Part II. If your renewal is postmarked before expiration but hasn’t been processed yet, you can request a Letter of Authorization from the FFLC to keep operating while the renewal is pending.14Bureau of Alcohol, Tobacco, Firearms and Explosives.
