To get a hardship license in Georgia, known officially as a Limited Driving Permit, you apply in person at a Georgia Department of Driver Services (DDS) Customer Service Center, bring proof that your suspension type qualifies and that you face extreme hardship without driving, and pay a $32 permit fee plus a reinstatement fee that depends on why your license was suspended.1Georgia Department of Driver Services. Fees and Terms The permit lasts up to a year for most suspensions and lets you drive only for narrowly defined purposes such as work, school, and medical care.
Do You Qualify
Georgia ties eligibility to the reason your license was suspended. You may apply for a Limited Driving Permit if you fall into one of these situations:2Justia Law. Georgia Code 40-5-64 – Limited Driving Permits for Certain Offenders
- A first DUI conviction within a five-year period, measured between arrest dates.
- A suspension for accumulating 15 or more points on your driving record within 24 consecutive months.3Justia Law. Georgia Code 40-5-57 – Suspension or Revocation of License
- A first-time administrative license suspension under Georgia’s implied consent law, which usually follows failing or refusing a chemical test during a DUI stop.4Justia Law. Georgia Code 40-5-67.2 – Terms and Conditions for Implied Consent Suspension
- A suspension for failure to comply with a child support order.
- A speeding violation as a driver 18 or older for exceeding the limit by 24 to 33 mph, if the sentencing judge finds a limited permit reasonable.
Across every category you must also show extreme hardship. That means no reasonable alternative transportation to work, school, medical care, or court-ordered obligations.2Justia Law. Georgia Code 40-5-64 – Limited Driving Permits for Certain Offenders
Some drivers cannot get a standard limited permit at all. Commercial driver’s license holders are excluded. So are people with multiple DUI convictions within five years, though a second DUI offender may qualify for the separate ignition interlock permit described below. Suspensions tied to vehicular homicide or habitual violator status also bar you from applying.
When You Can Apply
The waiting period depends on the suspension.
For a first DUI conviction, you can apply at the time of conviction. The court completes referral form DDS-1126, and you take it to DDS.5Georgia Department of Driver Services. DDS Forms For an administrative license suspension under implied consent, you must wait at least 30 days from the effective date of the suspension before applying.4Justia Law. Georgia Code 40-5-67.2 – Terms and Conditions for Implied Consent Suspension A second DUI offender seeking the ignition interlock permit must serve at least 120 days of the suspension first.6Justia Law. Georgia Code 40-5-64.1 – Ignition Interlock Device Limited Driving Permit
Points-based and child support suspensions have no statutory waiting period, but you still need the documents and the hardship showing.
What to Bring
Assemble your packet before the trip. Missing one item usually means starting over.

- For a first DUI conviction, the completed First DUI Conviction Permit Referral form (DDS-1126) from the sentencing court.5Georgia Department of Driver Services. DDS Forms

- Certificates for any court-ordered programs you have completed, including the DUI Alcohol or Drug Use Risk Reduction Program. Only DDS-certified programs count.7Georgia Department of Driver Services. DUI Alcohol or Drug Use Risk Reduction Program

What You Can Drive For
A Limited Driving Permit does not restore full driving privileges. Georgia law limits you to specific purposes:2Justia Law. Georgia Code 40-5-64 – Limited Driving Permits for Certain Offenders
- Going to and from work, or driving as part of your job.
- Attending the college or school where you are enrolled.
- Medical appointments and prescription pickups.
- Court-ordered programs such as DUI treatment, defensive driving, or substance abuse support meetings.
- Court appearances and probation office visits.
Grocery runs, social visits, and other personal errands are not covered. The permit prints its conditions on its face, so any officer who stops you can see exactly what driving is authorized.
How Long It Lasts
For most suspension types, the permit is valid for up to one year or until your full license is reinstated, whichever comes first.2Justia Law. Georgia Code 40-5-64 – Limited Driving Permits for Certain Offenders Renewal costs $5 per period if you are still serving a suspension and remain eligible.1Georgia Department of Driver Services. Fees and Terms
An administrative license suspension under implied consent is the exception. There, the limited permit expires after 30 days.2Justia Law. Georgia Code 40-5-64 – Limited Driving Permits for Certain Offenders That short window is one reason implied consent suspensions are often worth challenging at the administrative hearing stage.
If You Have a Second DUI
A second DUI conviction within five years disqualifies you from the standard limited permit. Georgia offers a separate ignition interlock device limited driving permit instead.6Justia Law. Georgia Code 40-5-64.1 – Ignition Interlock Device Limited Driving Permit
To qualify, you must serve at least 120 days of your suspension, then either obtain a certificate of eligibility from an accountability court or submit proof of enrollment in a substance abuse treatment program. An ignition interlock device must be installed on every vehicle you drive, and it requires a breath sample before the engine will start and periodically during the trip.
The interlock permit is valid for one year. After 12 months of successful monitoring, the interlock restriction is removed and the permit can be renewed for up to one additional two-month period while you work toward full reinstatement.6Justia Law. Georgia Code 40-5-64.1 – Ignition Interlock Device Limited Driving Permit The permitted driving purposes match the standard limited permit. Installation fees typically run $125 to $350, with monthly monitoring of $70 to $125, paid out of pocket.
How You Can Lose the Permit
DDS will revoke the permit if you are convicted of any moving violation or of driving outside the conditions printed on it.2Justia Law. Georgia Code 40-5-64 – Limited Driving Permits for Certain Offenders A routine speeding ticket can end it. The court will require you to surrender the physical permit, which is forwarded to DDS.
Once revoked, you cannot apply for any driver’s license for six months from the date you surrendered the permit. DDS may also add a suspension period based on the underlying conviction. Driving in violation of the permit’s conditions is a misdemeanor, carrying potential jail time, fines, and a criminal record on top of losing your driving privileges.2Justia Law. What Insurance Will Cost
The $32 permit fee and the reinstatement fee are the upfront costs. What follows can be larger. Drivers who need to file an SR-22, a certificate proving minimum liability coverage that is commonly required after DUI-related suspensions, typically pay between $1,800 and $5,600 per year for liability-only coverage, averaging around $3,000 annually after a DUI. If you finance or lease your vehicle and need full coverage, expect $6,000 to $7,000 per year. The SR-22 filing itself runs $25 to $50, but the filing signals higher risk to insurers, and you may need to maintain it for several years.
