Who Can Apply
Both applicants must be at least 18. Since July 2021, New York has not allowed anyone under 18 to marry, and all prior exceptions for minors with parental or judicial consent have been eliminated. There are no residency or citizenship requirements at the state level, though Utica’s county-of-residence policy still applies at that office.
What To Bring
New York Domestic Relations Law § 15 sets the requirements, and the accepted proof of age is broader than most people expect. Any one of the following works: a birth record or certified copy, a baptismal record, a passport, a driver’s license, a government- or school-issued photo ID, a life insurance policy, an employment certificate, a school record, an immigration or naturalization record, or a court record showing your date of birth.5New York State Senate. Both applicants also need to provide their Social Security numbers. The application asks for each person’s full name, address, age, occupation, place of birth, and parents’ names and countries of birth.5New York State Senate. New York Domestic Relations Law 15 – Duty of Town and City Clerks
If either of you was previously married, the clerk will ask whether each former spouse is living or dead, and whether either applicant is divorced. One additional item to ask about when you schedule: under Domestic Relations Law § 13-aa, certain applicants may be asked to take a blood test for sickle cell anemia. A religious exemption is available, and the result does not affect your ability to marry.

Choosing Someone To Perform the Ceremony
New York is specific about who can legally solemnize a marriage. A ceremony performed by anyone outside the categories listed in Domestic Relations Law § 11 is not a valid marriage. The authorized categories include ordained clergy and leaders of Ethical Culture societies affiliated with the American Ethical Union; the current or former governor, village mayors, county executives, and city mayors; members of the New York State Legislature (who cannot charge a fee); justices and judges of the state’s unified court system, federal judges sitting in New York, and certified retired judges; and judges, peacemaker judges, chiefs, and council members of Indian tribal courts.7New York State Senate. The officiant is responsible for returning the signed license to the issuing clerk. Once the clerk processes it, your Certificate of Marriage Registration is mailed to you automatically within 15 calendar days of the clerk receiving the completed license back.3New York State Department of Health.
