How to Get a Mississippi Hardship License at 15: Rules and Limits

A Mississippi hardship license at 15 is a restricted driver’s license issued by the Department of Public Safety that lets a teenager drive unsupervised only for specific purposes — school, work, medical care, sibling transportation, family business, or a death in the family. To qualify, you must already hold a learner’s permit, have held it for at least 30 days with no traffic citations, and have completed a certified driver’s education course. A parent or guardian submits the application by email.

Who Can Apply

The Department of Public Safety limits hardship driving privileges to Mississippi residents between 15 and 17 years old who already hold a learner’s permit.1DPS Driver Service Bureau. Hardship Driver’s License That permit has to be at least 30 days old at the time you apply, and your record during that period must be clean. One citation disqualifies you.

Three further requirements apply to every applicant:2DPS Driver Service Bureau. Regular Driver License – Light Commercial Class D – Section: Hardship Driver’s License

  • You must have completed a state-certified driver’s education course. There is no way around this.
  • You must be in compliance with your school’s attendance policy.
  • You cannot have received a DUI.

The learner’s permit itself is a separate transaction done in person at a driver license station, requiring a written knowledge test, an eye exam, and documents including an original birth certificate, Social Security card, two proofs of residency, and a recent school attendance form. The permit costs $7 and lasts two years.3DPS Driver Service Bureau. Regular Learner’s Permit4DPS Driver Service Bureau. Driver Service Fees

Reasons the State Will Accept

Your application has to fit one of the hardship categories the Department recognizes:1DPS Driver Service Bureau. Hardship Driver’s License

  • Transportation to and from school, including sports and other extracurricular activities
  • Transporting siblings to school or school events
  • Commuting to a job
  • Medical appointments or treatment
  • Supporting a family business, including farm operations
  • Transportation needs arising from a death in the family

The application asks for specifics tied to the reason you select. A work claim needs the employer’s name, address, phone number, your hours, and the employer’s signature. A medical claim needs a letter from your doctor. A school transportation claim should include a schedule for any sports or extracurriculars.5Mississippi Department of Public Safety. How to Submit the Application

The hardship application is handled entirely by email. You do not apply in person. A parent or legal guardian has to be the person requesting the privilege, not the teenager.1DPS Driver Service Bureau. Hardship Driver’s License

The package has to be saved as PDFs and must include:5Mississippi Department of Public Safety. Request for Mississippi Hardship Driver License

  • The completed hardship request form from the Department of Public Safety
  • The certified driver’s education course certificate
  • A current school attendance form
  • A narrative written by the applicant explaining, in the teenager’s own words, why the license is needed
  • Supporting documents matching the hardship reason: doctor’s letter, employer signature, or activities schedule

Send the package to Hardship@dps.ms.gov. The Department will not accept photographs of documents, only PDFs. Submit the application once; do not resend. The decision comes back by email, and if the request is approved, the proof of hardship is mailed through USPS.1DPS Driver Service Bureau. Hardship Driver’s License

What a Hardship License Actually Allows

This is the part most families misread. A hardship license does not turn a 15-year-old into a fully licensed driver. It splits driving into two categories.

You can drive without an adult in the car only when the trip is to or from:1DPS Driver Service Bureau. Hardship Driver’s License

  • School or a school-related function
  • Dropping off or picking up siblings for school or school events
  • Work
  • A medical appointment or treatment

For anything else, including errands, visiting friends, or recreational driving, a parent, guardian, or other licensed driver who is at least 21 must be sitting in the passenger seat. Driving unsupervised outside the approved list is a violation that can cost the license.

How the License Can Be Taken Away

The Commissioner of Public Safety can revoke a hardship privilege for any reason. The Department points to four situations in particular:1DPS Driver Service Bureau. Hardship Driver’s License

  • A parent or guardian requests revocation
  • Any traffic citation from any law enforcement agency
  • Law enforcement reports of criminal activity or unsafe driving
  • Failure to comply with Mississippi’s compulsory school attendance requirements

There is no mention of warnings, second chances, or a formal hearing. For a 15-year-old, one ticket could mean waiting until age 16 and going through the standard licensing process instead.

Driving for Work Has a Federal Ceiling

If the hardship reason is work, there is a federal rule the state license cannot override. Under the Fair Labor Standards Act, no employee under 17 may drive a motor vehicle on public roads as part of the job.6U.S. Department of Labor. Fact Sheet 34 – Hazardous Occupations Order No. 2 – Youth Employment Provision and Driving Automobiles and Trucks under the FLSA Even at 17, work driving is only allowed under tight conditions, including a vehicle under 6,000 pounds, daylight hours only, completion of a state-approved driver’s education course, and driving that is occasional and incidental to the job.7eCFR. 29 CFR Part 570 – Child Labor Regulations, Orders and Statements of Interpretation

So a 15-year-old with a Mississippi hardship license can drive to and from work, but not as part of the work itself. Pizza delivery, driving between job sites, or any work-related trip on public roads is off limits under federal law no matter what the state license says.

Crossing Into Other States

A Mississippi hardship license is a restricted privilege issued under Mississippi law. Whether Alabama, Tennessee, Louisiana, or Arkansas will honor it is uncertain. States generally recognize each other’s standard licenses, but restricted licenses issued to minors sit in a different category, and the specific unsupervised-driving rules attached to the Mississippi license may not translate across the border.

The safe assumption is that the license works only within Mississippi. If school, a job, or a medical appointment takes you across state lines, have a licensed adult in the passenger seat for the out-of-state portion of the trip.

Insurance

A hardship license does not change Mississippi’s financial responsibility law. The vehicle has to carry at least $25,000 in bodily injury coverage per person, $50,000 per accident, and $25,000 in property damage coverage.8Justia. Mississippi Code 63-15-43 – Motor Vehicle Liability Policy In most cases the teenager is added to a parent’s existing policy. Because driver’s education is already required for the hardship license, any insurance discount for completing an approved course may be available right away.

Moving to a Regular License

The hardship license is temporary. Once you turn 16, you become eligible for a regular Class R license, but only after holding the learner’s permit for 12 months, or until your 17th birthday, whichever comes first. At that point you need a valid learner’s permit, a current school attendance form, and a signed Waiver of Road Testing Affidavit. No road test is required.9DPS Driver Service Bureau. If you turn 17 before reaching the 12-month mark, the waiting period disappears entirely. You can get both a learner’s permit and a full driver’s license on the same day after passing the knowledge and eye exams.9DPS Driver Service Bureau.
