How to Get a Mississippi Sales Tax Permit: TAP Registration and Bond

To get a Mississippi sales tax permit, register your business for free through the Department of Revenue’s Taxpayer Access Point (TAP) portal; the permit packet arrives by mail in about two weeks. There’s no application fee, and the same permit covers both goods and Mississippi’s long list of taxable services.

Who Has to Register

Every in-state business making retail sales needs a permit before collecting the state’s 7% sales tax.1Mississippi Department of Revenue. Registration Information for Sales and Use Tax Applicants That includes sellers of tangible goods, and it also includes a wide range of service businesses. Auto repair, plumbing, electrical work, landscaping, laundry and dry cleaning, hotel stays, pest control, parking, car washes, and computer software services are all taxed at the standard rate.2Mississippi Department of Revenue. Out-of-state businesses with a physical location in Mississippi register the same way.1Mississippi Department of Revenue. Registration Information for Sales and Use Tax Applicants Remote sellers with no physical presence must register once their sales into the state exceed $250,000 over any twelve-month period. There is no separate transaction-count threshold.3Mississippi Department of Revenue. Business Tax Frequently Asked Questions

One boundary worth knowing: if you sell only through a marketplace like Amazon or Etsy, the marketplace facilitator is generally the party responsible for collecting and remitting the tax on your Mississippi sales. The Department of Revenue audits the facilitator rather than the individual seller for those facilitated transactions. The main exception involves sellers with more than $1 billion in annual U.S. gross sales, who can contractually agree to handle collection themselves.4Justia Law. • Ownership structure: sole proprietorship, LLC, corporation, partnership, or other.
  • The date you began or plan to begin making taxable sales.

Bond Requirement for Home-Based and Short-Term Locations

If you operate from your home, or from a temporary location leased for fewer than 90 days, Mississippi requires you to post a cash or surety bond before your permit will be issued.5Cornell Law School Legal Information Institute. 35 Miss. Code. R. 4-01-03-101 The bond must cover your estimated tax liability for a six-month period, with the exact amount set by the Commissioner. Home-based e-commerce shops and seasonal market sellers should plan for this before expecting the permit in hand.

Getting the Permit in the Mail

Allow about two weeks after submission for the permit packet to arrive by mail.1Mississippi Department of Revenue. • Annual filing if total annual tax payments are under $600.
  • Quarterly filing between $600 and $3,599.
  • Monthly filing at $3,600 or more.
