How to Get a Mortgage Loan Originator License in NY

To get a mortgage loan originator license in New York, you complete 20 hours of NMLS-approved pre-licensing education, pass the national SAFE MLO test with a score of at least 75%, submit the Individual Form (MU4) through the Nationwide Multistate Licensing System with fingerprints and a credit authorization, line up a licensed New York mortgage banker or broker to sponsor you, and pay $409 in state and NMLS fees plus fingerprinting and credit report costs. The Department of Financial Services (DFS) reviews everything and issues the license once your sponsor activates it in NMLS.

Plan on several weeks from the time you start coursework to the day your license goes active, and expect to spend well over $500 all in.

Confirm You Actually Need the State License

New York Banking Law Section 599-c makes it illegal to take residential mortgage applications or negotiate loan terms for compensation without a DFS-issued MLO license.1New York State Senate. New York Banking Law BNK 599-B – Definitions A few people doing adjacent work are outside that rule:

  • Loan processors and underwriters who work as supervised W-2 employees of a licensed MLO and do not hold themselves out to the public as originators. Independent contractors doing the same tasks are not exempt.2Office of the Law Revision Counsel. 12 USC 5103 – SAFE Mortgage Licensing Act
  • Licensed real estate agents and brokers doing only brokerage work, so long as they are not paid by a lender, mortgage broker, or another MLO.1New York State Senate. New York Banking Law BNK 599-B – Definitions
  • Employees of banks, credit unions, and other federally regulated depository institutions. These originators register through the federal system instead and are not covered by the steps in this article.1New York State Senate. New York Banking Law BNK 599-B – Definitions

If you’re a sole-proprietor processor or an independent contractor, the processing exemption does not apply to you regardless of your job title.

Check Whether You Can Qualify

Before investing time and money in the coursework, read Section 599-e against your own history. The DFS evaluates three things.

Criminal history. A felony conviction involving fraud, dishonesty, money laundering, or breach of trust is a permanent bar. Any other felony blocks licensure for seven years from the conviction date. These rules apply to domestic, foreign, and military convictions alike. The superintendent has discretion to waive a conviction if you were pardoned.3New York State Senate. New York Code BNK 599-E – Issuance of a License

Financial responsibility. The DFS pulls your credit report and looks for unpaid tax liens, recent foreclosures, and patterns of delinquency. The test is whether your history shows the responsibility expected of someone handling other people’s mortgage transactions.3New York State Senate. New York Code BNK 599-E – Issuance of a License

Character and general fitness. This is the subjective piece. Regulators can deny an application if other evidence suggests you’d pose a risk to consumers, even with a clean credit report and criminal check.3New York State Senate. New York Code BNK 599-E – Issuance of a License

Step 1: Complete 20 Hours of Pre-Licensing Education

You cannot sit for the exam until you finish 20 hours of NMLS-approved coursework. New York’s required breakdown is:4New York State Department of Financial Services. Mortgage Loan Originators Application

  • 3 hours of federal law and regulations
  • 3 hours of ethics, covering fraud, consumer protection, and fair lending
  • 2 hours of nontraditional mortgage products
  • 3 hours of New York state law and regulations
  • Remaining hours in elective or additional topics to reach 20

The three New York-specific hours are built into the 20, not stacked on top. Some providers deliver everything as one course; others sell a national package and a separate New York module. Either structure is fine as long as the courses are NMLS-approved and finished before you register for the test.

Step 2: Pass the SAFE MLO Test

Once your coursework is done, schedule the SAFE Mortgage Loan Originator Test through NMLS. The exam covers federal mortgage-related laws, general mortgage knowledge, origination activities, ethics, and uniform state content. You get 125 multiple-choice questions, 115 scored and 10 unscored pretest items, and you need at least 75% on the scored questions to pass.5New York State Senate. Fail it, and you can retake after 30 days. You get three consecutive tries under that 30-day window; after a third failure, you wait six months before the next attempt.6eCFR. 12 CFR Part 1008 – SAFE Mortgage Licensing Act State Compliance

Step 3: File the MU4 in NMLS

The application lives entirely in the NMLS portal on the Individual Form (MU4). Have the following ready before you start.

Ten-Year Employment and Residence History

Both histories go in reverse chronological order with no gaps.7Nationwide Multistate Licensing System. Completing Residential and Employment History Months between jobs still need an entry; you cannot skip from one employer to the next.

Fingerprints for the FBI Background Check

Fingerprints must be submitted through an NMLS-approved vendor.8Nationwide Multistate Licensing System. Completing the Criminal Background Check Process In New York, that vendor is IdentoGo. You pay the fingerprinting fee at the appointment, and results are tied to your NMLS profile automatically.

Credit Report Authorization

You authorize the credit pull inside NMLS, and the report is delivered to the DFS through TransUnion. If you have a security freeze on your TransUnion file, lift it first. Otherwise the filing and your payment will be voided and you have to start the submission over.9Nationwide Multistate Licensing System. Requesting a Credit Check in NMLS

Employer Sponsorship

Your license will not activate until a licensed New York mortgage banker or broker sponsors you in NMLS. The sponsoring company links your individual record to its corporate license and is responsible for supervising your work.10New York State Department of Financial Services. Temporary Authority to Act as a Mortgage Loan Originator You can only be sponsored by one entity at a time.

Attestation and Deficiency Window

Submitting the MU4 requires a digital attestation that everything in the filing is true and complete. Watch your NMLS account for deficiency notices after you submit. If the DFS flags your application as incomplete, you have 30 days to provide what’s missing before it is treated as withdrawn.4New York State Department of Financial Services. Step 4: Pay the Fees

Three non-refundable charges come due at submission:4New York State Department of Financial Services. Mortgage Loan Originators Application

  • $125 investigation fee
  • $254 license fee
  • $30 NMLS processing fee

That’s $409 before fingerprinting (paid to IdentoGo at your appointment), the credit report charge (processed inside NMLS), and your education course tuition. Budget well over $500 total.

Starting Work Before Final Approval

New York participates in NMLS Temporary Authority, which lets some experienced originators begin working before the state formally approves the license. It’s useful if you’re leaving a bank for a non-bank lender, or moving to New York already licensed somewhere else.

To qualify, you must be a W-2 employee of a licensed New York mortgage entity that has sponsored you in NMLS, and you must meet one of these:11NMLS. Temporary Authority to Operate FAQs for Mortgage Loan Originators

  • Registered in NMLS as an MLO for at least one continuous year before the application date, or
  • Held a state MLO license for at least 30 continuous days before the application date

Any gap between the prior registration or license and the new sponsorship cannot exceed 14 calendar days. You are disqualified automatically if you’ve ever had an MLO license denied, revoked, or suspended, been served with a cease-and-desist order, or been convicted of a felony or disqualifying misdemeanor.

Temporary Authority does not waive the education or exam requirements; it only lets you start originating before you finish them. The authority ends when the state grants or denies your license, when you withdraw the application, or after 120 days with an incomplete application, whichever comes first.11NMLS. Keep the License Active

The license renews yearly through NMLS during the window of November 1 through December 31.12NMLS Resource Center. Renewing Individual Licenses or Registrations Miss the deadline and you have a reinstatement window from January 1 through the last day of February, usually with added fees. Treat December 31 as the real deadline.

New York requires 11 hours of continuing education each year, three more than the federal SAFE Act floor. Starting the year after you’re first licensed, those 11 hours must include:13New York State Senate. New York Banking Law BNK 599-J – Continuing Education for Mortgage Loan Originators

  • 3 hours of federal law and regulations
  • 2 hours of ethics (fraud, consumer protection, fair lending)
  • 2 hours of nontraditional mortgage lending standards
  • 3 hours of New York state law and regulations
  • 1 hour of additional elective content

All CE must be NMLS-approved and completed before you file the renewal. Let the license lapse for five years or more and you’ll have to pass the SAFE MLO test again before you can be relicensed.5New York State Senate. New York Code BNK 599-G – Testing of Mortgage Loan Originators
