How to Get a One-Day Marriage Officiant License in New York

To get a one-day marriage officiant license in New York, apply to the same town or city clerk’s office that issued the couple’s marriage license, pay a $25 fee, and provide your details along with the couple’s information exactly as it appears on their license. The authority comes from Domestic Relations Law § 11-d, which took effect on March 28, 2023, and lets almost any adult solemnize a specific wedding for a specific couple.1New York State Senate. Who Can Apply

You must be at least 18. That is effectively the only personal qualification. You do not need to live in New York, live in the town or city where you apply, hold any professional credential, or have any prior connection to the couple.1New York State Senate. Once licensed, you can perform the ceremony anywhere in New York State. The wedding does not have to happen in the town or city where the license was issued.

Where To Apply

Apply to the same clerk’s office that issued the couple’s marriage license. This is a hard rule in the statute, and it catches people out when the couple gets their license in one jurisdiction but plans to marry somewhere else. The wedding can happen anywhere in the state; the officiant application cannot.1New York State Senate. New York Code DOM 11-D – One-Day Marriage Officiant License

The fee is $25, set by statute. Most clerk’s offices accept credit cards, money orders, or certified checks; policies on personal checks vary.2Association of Towns of the State of New York. Town Clerks and One-Day Marriage Officiant Registrations You do not have to appear in person. The law says the applicant “shall not be required to personally appear,” so mail and, where the office supports it, online submission are both legitimate.1New York State Senate. What Goes On the Application

The clerk collects two sets of information. From you: full legal name, date of birth, home address, email, and phone number. From the couple: both partners’ names, dates of birth, and addresses exactly as they appear on the marriage license application.1New York State Senate. “Exactly as they appear” is not decorative language. If any name or date on your application doesn’t match the marriage license, the clerk can reject the filing. Before submitting, have the couple send you the details straight from their own application.

Timing

The marriage license itself is valid for 60 calendar days starting the day after it’s issued. For active U.S. military personnel, that window extends to 180 days.3NY.gov. Information on Getting Married in New York State The one-day officiant license cannot outlive the marriage license, so both need to be active on the wedding date.

There is also a mandatory 24-hour waiting period after the marriage license is issued before any ceremony can take place. A judge or justice of the New York Supreme Court can waive this if circumstances require it.4NYC City Clerk. Marriage Ceremony

The practical order is: the couple gets their marriage license, you apply at that same clerk’s office, and the wedding takes place at least 24 hours after the marriage license issued but before it expires. Applying two to three weeks ahead of the wedding gives a comfortable buffer, especially for mailed applications.

Running the Ceremony

New York does not dictate vows, readings, or rituals. Only two requirements have to be met for the marriage to be legally valid.5New York State Senate. New York Domestic Relations Law 12 – Marriage, How Solemnized

First, both partners must declare in your presence, and in front of at least one witness, that they take each other as spouses. Any phrasing that captures that intent works. The classic “Do you take this person to be your spouse?” answered with “I do” is fine; so is any other wording that has both partners verbally committing.

Second, at least one witness besides you must be present. New York sets no minimum age for a witness, but the state recommends choosing someone who would be competent to testify in court about what they saw.3NY.gov. Filing the License After the Wedding

Once vows are exchanged, your legal work is not done. Make sure the officiant section and the witness section of the marriage license are filled out completely and accurately. The couple hands the license to you and the witness; you review, complete your section, and confirm everything matches.6New York State Department of Health. Responsibilities of the Officiant Performing the Ceremony

The completed license must be returned to the issuing clerk’s office within five days of the ceremony. Many clerks provide a self-addressed envelope; you can also drop it off in person. Until the clerk receives the signed license, the marriage is not recorded and the couple cannot get their marriage certificate. Violations of § 13-b’s filing requirements can carry misdemeanor penalties, so treat the five-day window as a real deadline.7New York State Senate. What the License Does Not Do

A one-day officiant license is tied to one specific couple and expires as soon as the ceremony is complete or the couple’s underlying marriage license runs out, whichever comes first.1New York State Senate. New York Code DOM 11-D – One-Day Marriage Officiant License It is not a general credential. If a friend asks you to officiate their wedding next month, you go through the whole application again, at whichever clerk’s office issued their marriage license.
