Do You Actually Need One
Pennsylvania law requires every person or entity with a place of business in the Commonwealth to register for a sales tax license before making taxable sales.2Pennsylvania Code. 61 Pa. You can also owe without any physical footprint. Under Act 13 of 2019, any business with more than $100,000 in annual gross sales to Pennsylvania customers must register, collect, and remit sales tax regardless of where the business is located, and this applies to sellers inside and outside the United States.4Pennsylvania Department of Revenue. Foreign Entity Sales Tax Registration If you sell exclusively through a marketplace facilitator that already collects Pennsylvania sales tax on your behalf, only your direct sales and sales through non-collecting facilitators count toward the $100,000 threshold. Sellers who stay below that threshold and use a Certified Service Provider aren’t required to obtain a Pennsylvania license or file their own returns.
One boundary worth flagging: if you’re a non-Pennsylvania sole proprietorship or partnership without a permanent physical location in the state, you don’t get a standard license. You need a Transient Vendor Certificate, and you must notify the Department of Revenue in writing at least 30 days before entering Pennsylvania to sell, with the dates and locations where you’ll do business.3Department of Revenue. What to Gather Before You Start
Have these ready before you open the portal. Missing any of them will stall the application mid-flow.
- Your Federal Employer Identification Number from the IRS. Sole proprietors without employees can use a Social Security Number instead.
- Your business structure: sole proprietorship, LLC, partnership, S-corporation, or another entity type.
- Full legal names, home addresses, and Social Security Numbers for all owners, partners, or corporate officers.
- A description of your business activity, so the system opens the correct tax accounts.
- The date you expect to begin taxable sales. This sets your first filing deadline.
If your business involves hotel or short-term lodging, note that during registration so the hotel occupancy tax account opens alongside the standard sales and use tax account.
How to Register Through myPATH
Pennsylvania handles all business tax registration through myPATH, the state’s online tax portal.1Commonwealth of Pennsylvania. Register My Business for Taxes The old PA-100 paper form has been retired in favor of the electronic system, and there is no fee to register.
- Go to mypath.pa.gov. New businesses can register without creating an account first; look for the link labeled “Pennsylvania Online Business Tax Registration” on the main page. - Enter your business information. The system walks through screens for your FEIN or SSN, business address, entity type, and owner details.
- Select your tax accounts. Choose the Sales, Use, and Hotel Occupancy Tax account. The portal will also prompt you to register for other applicable taxes such as employer withholding or corporate net income if they apply.
- Review and submit. A final review screen lets you catch errors before you electronically sign and transmit the application. The electronic signature is a legal attestation that everything you entered is accurate.
Plan on 15 to 20 minutes if your documents are lined up.
Getting Your License Number and Certificate
After you submit, the Department of Revenue reviews the application and issues your 8-digit sales tax license number. Most businesses receive it within a few business days for online applications, though it can take longer if the department needs to verify information. Delivery happens through myPATH and by mail to your registered business address. Pennsylvania law requires you to display the physical certificate at your place of business.
Your license must be renewed at least every five years to remain valid.7Pennsylvania Department of Revenue. Letting the license lapse means you can’t legally collect sales tax or use exemption certificates for wholesale purchases until you renew.
What Happens Right After You’re Registered
Once your account is active, you begin filing sales tax returns. All new sales tax accounts start on a quarterly filing schedule.8Pennsylvania Department of Revenue. - Monthly filing if you reported $600 or more.
- Quarterly filing if you reported between $75 and $599.99.
- Semi-annual filing if you reported less than $75.
File a return for every period even if you had zero taxable sales. Skipping a return because no revenue came in is one of the most common mistakes new licensees make, and it triggers penalties.
Rate-wise, Pennsylvania’s base sales tax is 6%. Businesses in Allegheny County add 1% for a total of 7%, and businesses in Philadelphia add 2% for a total of 8% on taxable sales and services other than hotel rooms.9Pennsylvania Department of Revenue. Penalties for Selling Without a License
Registering before you sell isn’t optional. Vendors caught selling without a license face fines between $300 and $1,500 per violation, and failure to pay those fines can result in 5 to 30 days of imprisonment.10Pennsylvania Department of Revenue.
