How to Get a Sales Tax License in PA: Apply Through myPATH

To get a sales tax license in PA, register online through myPATH, the Pennsylvania Department of Revenue’s tax portal, before you make your first taxable sale. The license — officially the Sales, Use, and Hotel Occupancy Tax License — is free, and the entire application is digital. Once you have it, you collect Pennsylvania’s 6% sales tax (7% in Allegheny County, 8% in Philadelphia) on qualifying sales and send it to the Department of Revenue.1Department of Revenue | Commonwealth of Pennsylvania. Who Has to Register

Any business selling taxable goods or services from a physical location in Pennsylvania needs the license, no matter the structure. Sole proprietorships, LLCs, partnerships, and corporations all register the same way, and all must do so before the first taxable sale.2Cornell Law School. 61 Pa Code 60.16 – Local Sales, Use and Hotel Occupancy Tax A storefront counts, so does a farmers’ market booth, so does a warehouse.

You don’t need to be located in Pennsylvania to owe the license. Out-of-state sellers with more than $100,000 in annual Pennsylvania gross sales must register, collect, and send tax the same as in-state businesses. The rule covers direct online sellers and marketplace facilitators.3Department of Revenue | Commonwealth of Pennsylvania. Online Retailers

One license covers three taxes:

  • Sales tax on retail sales of taxable goods and services
  • Use tax on items you buy without paying sales tax and then use in your business
  • Hotel occupancy tax on lodging and hotel room rentals

What to Have Ready Before You Apply

The online application moves fastest if you pull these together first:

  • Your tax identification number: an SSN for a sole proprietor, or a Federal Employer Identification Number (FEIN) for every other structure.
  • Business details: legal name, trade name if different, the physical address of every location, and a mailing address.
  • Owner and officer information: names, home addresses, and SSNs for all owners, partners, or corporate officers. Pennsylvania can hold these individuals personally responsible for unpaid sales tax.
  • Business start date and the date of your first taxable sale. If your first sale predates your registration, the state can assess back taxes to that date.
  • A six-digit NAICS code that matches your primary business activity. The U.S. Census Bureau maintains a lookup tool.
  • A plain-language description of what you sell.

How Long Approval Takes

The Department of Revenue usually processes applications in seven to ten business days while it verifies your identification numbers and business details. Once approved, the printed license comes to your business address by mail, and a digital copy becomes available in your myPATH account.

Display the license prominently at each location it covers; photocopies are acceptable for multiple sites.6Commonwealth of Pennsylvania Open Data Portal. Sales, Use and Hotel Occupancy Tax Licenses and Certificates If you open a new location, you need a separate license for that address.

What Happens After You’re Registered

The department assigns you a filing frequency based on your tax liability:

  • Monthly for higher liability
  • Quarterly for moderate liability
  • Semi-annually for lower liability

Your assigned schedule arrives with your license materials, and the department can change it later if your volume shifts. File on time even in a period with no taxable sales. A zero return is still a return, and skipping it triggers penalties.

Retail sales tax licenses must be renewed at least every five years. The department will notify you when renewal is due, and there’s no fee, but you have to be current on your returns and any tax owed before the renewal goes through.7Department of Revenue | Commonwealth of Pennsylvania. Penalties for Selling Without a License

Operating without a valid license carries a fine of up to $1,000.8Pennsylvania Code and Bulletin. 61 Pa Code 9.2 – Sales and Use Tax Changes The lack of a license doesn’t erase the tax obligation. The Department of Revenue can still assess what you should have collected, plus interest, back to when your sales began.

Interest also accrues from the original due date, so delay compounds the cost.

Buying Inventory Tax-Free With Your License

An active license lets you buy resale inventory without paying sales tax at purchase. Give your supplier a Pennsylvania Exemption Certificate (Form REV-1220) with your eight-digit sales tax license number.10Commonwealth of Pennsylvania. The certificate applies only to items you’ll resell. Things you buy for your own business use — office supplies, equipment, furniture — remain taxable. If you invoke a resale exemption and end up keeping the item, you owe use tax on it and should report that on your next return.
