To get a tax ID number in Oklahoma, you actually need two numbers from two different agencies. First, apply for a federal Employer Identification Number (EIN) from the IRS. It’s free and the online application issues your number immediately. Then register with the Oklahoma Tax Commission (OTC) through its OkTAP portal for the state tax accounts your business needs. A sales tax permit costs $20 plus a handling fee, and processing typically takes 5 to 10 business days.1Oklahoma Tax Commission. Help Center – Businesses
Which Tax ID You Need
The EIN is a nine-digit federal number the IRS assigns under 26 U.S.C. ยง 6109 to identify your business for federal tax purposes.2Office of the Law Revision Counsel. 26 USC 6109 – Identifying Numbers You need one if your business has employees, is set up as a corporation or partnership, or files certain federal returns like employment or excise tax returns.
The Oklahoma Tax ID is a separate registration with the OTC that sets up your state tax accounts. Most businesses need to complete the state step, and you generally need your federal EIN in hand before you apply for it.3Oklahoma.gov. About Oklahoma Licenses and Permits
You’ll need to register with the OTC if you:
- Sell taxable goods or services in Oklahoma. Any business selling tangible personal property or taxable services must hold a sales tax permit and collect the state’s 4.5% sales tax plus applicable local taxes. State law requires the permit before your first sale, and operating without one is a misdemeanor carrying fines up to $1,000.4Justia Law. Oklahoma Code 68-1364 – Permits to Do Business
- Have employees and withhold Oklahoma income tax from wages, which requires a state withholding tax account.5Oklahoma.gov. Filings for Businesses With Employees
- Serve alcohol under a mixed beverage, beer and wine, or caterer license from the ABLE Commission. You’ll also need a mixed beverage tax permit from the OTC, issued at no charge but requiring a surety bond and an active sales tax permit.6Justia Law. Oklahoma Code 37A-5-107 – Mixed Beverage Tax Permit
- Sell into Oklahoma from out of state. Remote retailers whose goods are used in Oklahoma must collect the applicable state and local use tax.7Oklahoma Tax Commission. Businesses – Sales and Use Tax
Step 1: Apply for a Federal EIN
The IRS issues EINs at no cost. The fastest route is the online application on irs.gov, which gives you the number as soon as you finish.8Internal Revenue Service. Get an Employer Identification Number
To use the online tool, your principal place of business must be in the United States, and you’ll need the Social Security number or Individual Taxpayer Identification Number (ITIN) of the responsible party, meaning the person who controls or manages the entity’s funds. Businesses based outside the U.S. have to apply by phone, fax, or mail.
Print the EIN confirmation letter and keep it. You’ll need the number for your Oklahoma registration.
Step 2: File With the Secretary of State If You’re an LLC, Corporation, or Partnership
If your business is a corporation, LLC, or partnership, file with the Oklahoma Secretary of State before registering with the OTC. That filing creates your legal business entity and produces a filing number the OTC will ask for.3Oklahoma.gov. About Oklahoma Licenses and Permits The online filing takes about 15 minutes and costs $100 plus a service fee.9Oklahoma.gov. Register Your Business
Sole proprietors operating under their own legal name can skip this step and go straight to the OTC application. Secretary of State registration and OTC registration are two different things, and you generally need both if you’re not a sole proprietor.
Step 3: Register With the Oklahoma Tax Commission
With your EIN (and Secretary of State filing number, if applicable) ready, register with the OTC through its online portal, OkTAP. The portal lets you set up multiple tax accounts in a single session.10Oklahoma Tax Commission. Have this information on hand:
- Legal business name, any DBAs, and your physical and mailing addresses.
- Your business structure: sole proprietorship, partnership, corporation, or LLC.
- Responsible party’s name, title, and SSN or ITIN.
- The date you started or plan to start operations.
- The tax accounts you’re registering for: sales tax, withholding tax, mixed beverage tax, and any others that apply.
Paper registration is also available. You can request the current form and mailing address from the OTC’s Taxpayer Assistance Division at 405-521-3160.
What It Costs and How Long the Permit Lasts
A sales tax permit costs $20 plus a handling fee, set by statute, and applies to each business location.4Justia Law. Oklahoma Code 68-1364 – Permits to Do Business If you operate at more than one location, expect a separate permit for each. Withholding tax account registration carries no additional fee.
New sales tax permits open with a six-month probationary period. If you file and pay on time during those first six months, the permit automatically renews for another 30 months without any action on your part.11Legal Information Institute. Oklahoma Administrative Code 710:65-9-1 – Obtaining a Sales Tax Permit to Do Business After that, permits expire every three years from the date of issuance and must be renewed.4Justia Law. Oklahoma Code 68-1364 – Permits to Do Business The OTC can refuse to renew a permit if you fall behind on filings or payments during probation, so those first six months matter.
Keeping Your Numbers Current
Once you have both numbers, both agencies expect you to keep the information accurate.
Federally, if the responsible party on your EIN changes, file IRS Form 8822-B within 60 days. The same form updates your business mailing address.12Internal Revenue Service. About Form 8822-B, Change of Address or Responsible Party Missing the deadline doesn’t automatically trigger a penalty, but IRS notices going to the wrong person can create larger problems later.
At the state level, your sales tax permit is tied to a specific location. If you move, add a location, or change your business structure, update your registration with the OTC. Businesses that collect sales tax file returns and remit collected taxes on the schedule the OTC assigns, typically monthly for retailers. Falling behind on those filings can lead to suspension or non-renewal at the end of the permit cycle.
