To get a TWC tax account number, register your business with the Texas Workforce Commission within 10 days of becoming liable for state unemployment tax. The fastest route is the online Unemployment Tax Registration (UTR) portal, which issues your account number immediately once you complete the application. Paper registration through Form C-1 works too, but takes about two weeks.
First, Confirm You Actually Need to Register
Registration is only required once your business meets one of the liability tests in the Texas Unemployment Compensation Act. You are liable if you paid $1,500 or more in total wages during any single calendar quarter in the current or preceding year, or if you employed at least one person for any part of a day during 20 or more different calendar weeks in a year.1State of Texas. Texas Labor Code – Section 201.021 Those 20 weeks do not need to be consecutive.
Two specialized categories use different thresholds:
- Domestic employers become liable at $1,000 or more in cash wages during a calendar quarter for household work in a private home.2Texas Workforce Commission. Texas Unemployment Compensation Act
- Agricultural employers must register if they pay $20,000 or more in cash wages during any calendar quarter, or employ 10 or more agricultural workers for at least part of a day in 20 different weeks.3Employment and Training Administration – U.S. Department of Labor. You Have 10 Days Once You Cross a Threshold
The registration deadline is 10 days from the day your payroll or staffing first meets a liability test.4Texas Workforce Commission. Determine Whether You Need to Establish an Unemployment Tax Account The clock does not wait for the end of the quarter. Miss the window and TWC can backdate your tax liability to the date you should have registered, adding penalties and interest for any late reports on top of the taxes themselves.
Gather Your Information Before You Start
TWC estimates the online application takes about 20 minutes if you have everything ready.5Texas Workforce Commission. Unemployment Tax Registration – Register a Tax Account Pull these together first:
- Your Federal Employer Identification Number (FEIN).
- Your legal business name exactly as registered with the Texas Secretary of State.
- Your business structure: sole proprietorship, partnership, corporation, LLC, or other entity type.
- Your physical Texas address and your mailing address for TWC correspondence.
- The Social Security number and home address of every owner, partner, or corporate officer.
- The exact date you first paid wages in Texas. Getting this date wrong can trigger backdated assessments.
Register Online Through the UTR Portal
The Unemployment Tax Registration portal on the TWC website is the quickest way to obtain your account number. You enter your business and payroll information into the secure system, and if TWC’s rules confirm you are liable, UTR assigns your tax account number the moment you submit the completed application.5Texas Workforce Commission. Unemployment Tax Registration – Register a Tax Account TWC also mails a formal Employer Liability Notice to your registered address, which typically arrives within about two weeks.
UTR lets you file any overdue quarterly reports and pay taxes during the registration session itself. If you skip that step, you will need to wait for the mailed Employer Liability Notice to arrive before you can access your account through the separate Unemployment Tax Services (UTS) system. The same login credentials work for both UTR and UTS.
Cannot finish in one sitting? UTR saves your progress for up to a year, so you can return and complete the application later.
Registering by Mail or Fax With Form C-1
If you cannot use the online portal, submit a paper Status Report (Form C-1) to TWC by mail or fax.6Texas Workforce Commission. Tax Forms and Instructions The form asks for the same ownership and payroll details as the online application, and the current version is available on the TWC website.
Paper submissions take longer because TWC staff verify the information manually. Expect to wait roughly two weeks or more before your account number and Employer Liability Notice arrive by mail. For most employers, and especially anyone close to the 10-day deadline, UTR is the better option.
What You Receive After Registering
Your Employer Liability Notice contains your permanent tax account number and your initial unemployment tax rate. For 2026, every new Texas employer starts at a 2.70% entry-level rate regardless of industry.7Texas Workforce Commission. You pay unemployment tax on the first $9,000 of wages each employee earns per calendar year. Wages above that amount for a given employee are not subject to state unemployment tax.8Texas Workforce Commission. Independent Contractors Do Not Get You Out of Registering
Whether you owe unemployment tax depends on whether your workers are employees or independent contractors, and that determination follows IRS common-law rules, not the label on the paperwork. Someone is your employee if you control both what work gets done and how it gets done. The IRS weighs behavioral control, financial control, and the nature of the relationship together.10Internal Revenue Service. Employee (Common-Law Employee)
Classifying workers as contractors to sidestep unemployment tax carries real exposure. Texas law imposes a $200 penalty per misclassified worker in connection with government contracts,11State of Texas. Texas Labor Code Section 214.008 – Misclassification of Certain Workers; Penalty and TWC can separately assess back taxes, interest, and penalties for every quarter you should have been paying tax on those workers.
Buying an Existing Business Changes the Picture
If you acquire all or part of an existing Texas business, the previous owner’s unemployment tax history can transfer with the deal. State law requires the prior employer’s compensation experience to move to the new owner when there is common management, control, or ownership between the two entities.12State of Texas. Ask for the seller’s unemployment tax rate information before you close.
