To get an Alabama mortgage loan originator license, you need to complete 20 hours of NMLS-approved pre-licensing education, pass the SAFE MLO Test with a score of at least 75%, clear an FBI background check and credit review, meet Alabama’s financial responsibility standards, and file an MU4 application through the Nationwide Multistate Licensing System with sponsorship from a licensed employer. Plan on roughly $260 in application and testing fees, plus whatever your education provider charges.
Who Needs the License
Alabama law requires an individual MLO license before you take a residential mortgage loan application, or offer or negotiate loan terms, for compensation on any dwelling located in the state.1Alabama Legislature. Alabama Code 5-26-4 – License and Registration Required Independent contractor loan processors and underwriters are included; employee processors working under a licensed company are not.2Alabama State Banking Department. Alabama Code Title 5 Chapter 26 – Alabama Secure and Fair Enforcement for Mortgage Licensing Act
You do not need an Alabama MLO license if you fall into one of these groups:
- Employees of banks, savings associations, credit unions, or similar federally regulated institutions, who register through a federal process instead.
- Anyone negotiating mortgage terms with or on behalf of an immediate family member.
- Anyone negotiating terms on a loan secured by their own residence.
- Licensed attorneys negotiating terms as part of representing a client, as long as they are not paid by the lender, broker, or any other originator.
Step 1: Complete 20 Hours of Pre-Licensing Education
Your first move is 20 hours of coursework through an NMLS-approved provider. Alabama uses the federal SAFE Act breakdown with no additional state-specific education required:3NMLS. Alabama – NMLS
- 3 hours on federal law and regulations
- 3 hours on ethics, including fraud, consumer protection, and fair lending
- 2 hours on non-traditional mortgage lending standards
- 12 hours of electives on mortgage origination topics
Classroom, online, or any other NMLS-approved format counts. If you already completed federal, ethics, and non-traditional hours for another state, those transfer; you would only need to make up any shortfall in electives.2Alabama State Banking Department. Step 2: Pass the SAFE MLO Test
The SAFE Mortgage Loan Originator Test costs $110 and requires at least 75% to pass.4Office of the Law Revision Counsel. 12 US Code 5104 – State License and Registration Application and Issuance Alabama does not have a separate state test. The Uniform State Test content is built into the national exam, so one sitting covers both.3NMLS. Alabama – NMLS
Fail and you can retake after 30 days. Fail three times in a row and the wait jumps to 180 days. That penalty is steep enough that investing in a prep course usually beats scheduling the exam too early.
Step 3: Background Check, Credit, and Character Standards
You authorize the NMLS to run an FBI criminal background check and pull a credit report as part of your filing.4Office of the Law Revision Counsel. 12 US Code 5104 – State License and Registration Application and Issuance Fingerprints go through an NMLS-approved vendor, currently Fieldprint.5Nationwide Multistate Licensing System. Completing the Criminal Background Check Process The background check costs $36.25 and the credit report $15.00, each charged once per filing regardless of how many states you apply to.6NMLS. Felony Convictions
Alabama will deny your application if you have been convicted of, or pled guilty or no contest to, a felony within the seven years before your application date. For felonies involving fraud, dishonesty, breach of trust, or money laundering, the seven-year lookback does not apply; those are disqualifying no matter how long ago they happened. A pardon removes the conviction from consideration.7Alabama Legislature. Alabama Code 5-26-6 – License and Registration Requirements
Financial Responsibility
The Alabama State Banking Department also weighs whether you have shown financial responsibility. Red flags include:7Alabama Legislature. Alabama Code 5-26-6 – License and Registration Requirements
- Current outstanding judgments, except those from medical expenses
- Current outstanding tax liens or other government liens
- Foreclosures within the past three years
- A pattern of seriously delinquent accounts within the past three years
Credit score alone cannot sink your application. The Banking Department is prohibited from denying a license based solely on credit score, and it cannot use a credit report as the only reason for denial.7Alabama Legislature. Alabama Code 5-26-6 – License and Registration Requirements The review targets patterns of financial mismanagement, not a number.
Step 4: File the MU4 Application
With education done, the test passed, and your background check in motion, you file the Individual Form (MU4) through NMLS. The MU4 asks for employment history, any criminal or regulatory actions, and financial disclosures.8Nationwide Multistate Licensing System. Filing the Individual MU4 Form in NMLS The fees at this stage are a $75 Alabama state license fee and a $35 NMLS processing fee. Combined with the background check and credit report, your NMLS-side costs come to roughly $161.25 before education and testing.
Step 5: Get Employer Sponsorship
Your license will not go active until a licensed mortgage broker, lender, or servicer sponsors you in NMLS by linking your record to their company account.9Nationwide Multistate Licensing System. Creating Relationships and Sponsorships You can file the MU4 and run the background check while you job hunt, but the application sits in a pending state until sponsorship is confirmed.
Sponsorship also usually handles your surety bond. Every Alabama MLO must be covered by one, and if you work as an employee or exclusive agent of a company licensed under the Alabama Consumer Credit Act or the Mortgage Brokers Licensing Act, your employer’s bond can satisfy that requirement.10Alabama Legislature. Alabama Code 5-26-14 – Surety Bond Required That covers most MLOs. If you are an independent contractor or your employer’s bond does not reach your origination activity, you will need to arrange your own. Confirm coverage with your employer before buying a separate bond.
If you later leave or get terminated, the employer ends the sponsorship in NMLS.11NMLS. Terminating Employment Records Your license does not transfer automatically; a new employer must create fresh sponsorship, and you cannot originate loans during the gap.
Temporary Authority If You Are Already Licensed Elsewhere
If you are a federally registered MLO at a bank or credit union moving into a state-licensed role, or you already hold a state license in another state, you may qualify for Temporary Authority to originate in Alabama while your application is pending. The provision was added to the SAFE Act in 2018.12NMLS. NMLS Policy Guidebook – Temporary Authority TA runs until the state acts on your application or 120 days pass with an incomplete application, whichever comes first. If your application is complete and you are only waiting on the state’s decision, TA continues past 120 days until the state decides.13NMLS Resource Center. Length of TA Period First-time applicants with no prior license do not qualify.
Keeping the License: Annual Renewal and CE
Alabama MLO licenses renew annually between November 1 and December 31. The renewal fee is $75 through NMLS.14Alabama Legislature. Alabama Code 5-26-9 – License Renewal Before submitting renewal, you must complete 8 hours of NMLS-approved continuing education for the year:3NMLS. Alabama – NMLS
- 3 hours of federal law and regulations
- 2 hours of ethics, including fraud, consumer protection, and fair lending
- 2 hours of non-traditional mortgage lending standards
- 1 hour of electives
If you are licensed for the first time during the same calendar year you completed your pre-licensing education, you do not need to complete CE for that year. Both CE and renewal share a December 31 deadline, so treat that date as hard.
