To get an annulment in Arizona, you file a petition in Superior Court asking a judge to declare that your marriage was never legally valid, prove that a specific legal defect existed at the time of the ceremony, serve your spouse with the papers, and obtain a signed Decree of Annulment. The process uses the same procedural rules as a divorce, but you carry a higher burden: you have to show the marriage itself was flawed from the start, not that it fell apart later.
Do You Qualify to File?
Two threshold questions decide whether an Arizona court will hear your case.
First, residency. Either you or your spouse must have lived in Arizona for at least 90 days before filing. Military members stationed in Arizona meet this requirement even if their legal home is elsewhere.1Superior Court of Arizona in Maricopa County. General Information – Annulment The jurisdictional rules match those for a dissolution.2Arizona Legislature. Arizona Revised Statutes Title 25-302 – Procedure and Law
Second, grounds. Arizona Revised Statutes 25-301 lets a Superior Court void a marriage when a legal impediment made it invalid from the beginning.3Arizona Legislature. Arizona Revised Statutes Title 25-301 – Grounds The statute is broad; the specific impediments come from other sections of Arizona law and long-standing common-law principles. The most common grounds people rely on are:
- Bigamy — one spouse was already legally married to someone else at the time of the ceremony.
- Incest — the parties fall within a prohibited degree of relationship under A.R.S. 25-101.4Arizona Legislature. Arizona Revised Statutes Title 25-101 – Void and Prohibited Marriages
- Lack of consent or capacity — one party could not understand or agree to the marriage because of a mental condition, intoxication, or duress at the ceremony.
- Fraud or misrepresentation — one party lied about something fundamental to the marriage, such as identity, ability to have children, or intention to live together as spouses. Minor lies and broken promises generally will not qualify.
- Underage marriage without proper consent — Arizona allows 16- and 17-year-olds to marry only with parental consent or a court emancipation order, and only if the other spouse is no more than three years older. Anyone under 16 cannot marry at all.5Arizona Legislature. Arizona Revised Statutes 25-102 – Consent Required for Marriage of Minors
If your ground is a defect you could challenge but chose to live with (fraud you discovered a year ago and ignored, for example), file promptly. A judge can conclude that staying in the marriage after learning about the defect amounts to accepting it, and deny the annulment on that basis.
One boundary worth naming: a civil annulment from a Superior Court is the only kind that changes your legal status. A religious annulment, such as one from a Catholic tribunal, addresses standing within your faith and does nothing to your legal marriage. They operate independently, and some people need both.
The Forms You File
Pick up or download the annulment packet from your county’s Clerk of the Superior Court.6Yavapai County Government. Annulment – Packet 5a The core documents are the same statewide:
- Petition for Annulment, listing both spouses’ names, your residency, the date of the marriage, and the specific legal ground you are relying on. State the ground clearly enough for a judge to evaluate it.
- Summons, which formally notifies your spouse that a legal action has been filed.
- Preliminary Injunction, setting temporary rules for both parties on property, insurance, and conduct while the case is pending.
- Confidential Sensitive Data Sheet, which captures Social Security numbers and other private identifiers and stays sealed.
- Notice of Right to Convert Health Insurance, required even though the marriage is being declared invalid.
Fill every field completely. Incomplete forms get kicked back, and each round trip delays the case by weeks. Counties add a few local forms to the packet, so follow the checklist that comes with yours.
Filing Fees and Waivers
The statewide base fee for an annulment petition is $261, which includes a $5 spousal maintenance fund surcharge and a $65 conciliation court surcharge in counties that operate one.7Arizona Judicial Branch. Superior Court Filing Fees Counties add local fees on top. In Maricopa County the total is $376.8Maricopa County Clerk of Superior Court. Filing Fees In Coconino County it is $346.9Coconino County. If you cannot afford the fee, apply for a waiver or deferral. A full waiver is available if you receive Supplemental Security Income. TANF or food stamp recipients, and people working with a nonprofit legal aid provider, typically get the fee deferred to a later date. People with incomes between 150% and 225% of the federal poverty level may be placed on a payment plan.10Arizona Judicial Branch. Fee Waivers and Deferrals
Serving Your Spouse
After the clerk stamps your documents, you have to formally deliver copies to your spouse. You cannot hand the papers over yourself. Service must go through a sheriff, a constable, a certified private process server, or someone the court specifically appoints.11New York Codes, Rules and Regulations. Arizona Rules of Family Law Procedure Rule 40 – Summons Private process servers generally charge between $20 and $100 per job.
If your spouse is cooperative, they can sign an Acceptance of Service confirming they received the documents voluntarily, which eliminates the need to hire a server. Either way, file proof of service with the court so the judge knows notice was proper.
If your spouse has disappeared and you cannot locate them after a genuine search, ask the court for permission to serve by publication in a newspaper of general circulation. Judges are reluctant to grant this because it provides much weaker notice than personal delivery, so document the steps you already took: contacting relatives, checking last-known addresses, and searching public records. Publication adds several weeks to the timeline.
The Response Window and Default
Once your spouse is served, the clock starts. A respondent who lives in Arizona has 20 days to file a written response. A respondent outside Arizona has 30 days.12University of Arizona Law. Arizona Rules of Family Law Procedure – Rules 32 and 42
If no response arrives, file an Application and Affidavit of Default and move toward a default judgment. Annulments differ from divorces here in a useful way: the 60-day waiting period required before a divorce decree can be entered does not apply.13Arizona Legislature. Arizona Revised Statutes Title 25-329 – Waiting Period On a default motion, the court must either schedule a hearing or rule within 21 days of the filing date.14New York Codes, Rules and Regulations. Arizona Rules of Family Law Procedure Rule 44.1 – Default Decree or Judgment by Motion and Without a Hearing After filing the default application, send a copy to your spouse, who gets an additional 10-day grace period before the court acts.
The Hearing and the Decree
If your spouse contests the annulment, the court will schedule an evidentiary hearing. You carry the burden of proof. That means testimony or documents showing the legal impediment existed at the ceremony. For bigamy, a prior marriage record. For fraud, documentation of what was concealed. For lack of capacity, medical records or witnesses describing your spouse’s condition the day of the wedding. A judge will not take your word for it without corroboration.
If the proof satisfies the judge, they sign a Decree of Annulment.15Yavapai County Superior Court. Decree of Annulment of Non-Covenant Marriage The signed decree becomes a permanent court record. Both parties return to the legal status they held before the ceremony: you can update government documents, change your name back, and remarry without carrying a divorce on your record.
If You Have Children
Annulling the marriage does not make the children illegitimate. Children born during a marriage that is later annulled remain the legitimate children of both parents. The court handles custody, parenting time, and child support in an annulment case the same way it does in a divorce. Your packet will include extra forms for a parenting plan and child support calculations. Do not skip them. The judge will not finalize the decree without resolving the children’s situation.
What the Decree Does to Property, Taxes, and Benefits
Because the annulment declares the marriage never existed, Arizona’s community property rules do not apply the way they would in a divorce. The general approach is to return each person to their pre-marriage financial position. You keep what you brought in, and jointly acquired property gets divided based on each person’s contributions rather than a presumptive 50/50 split. If you bought a house together or mingled finances during the marriage, expect the court to sort through who contributed what. Retirement funds typically go back to the person who earned them, though a judge has discretion to weigh the length of the marriage and each party’s circumstances.
Taxes are the step most people miss. The IRS treats you as having been unmarried for every year the voided marriage existed. File amended returns on Form 1040-X for each affected tax year that is still open, switching your filing status from married filing jointly to single or head of household. You generally have three years from the date you filed the original return, or two years from when you paid the tax, whichever is later, to claim a resulting refund.16Internal Revenue Service. Publication 501 – Dependents, Standard Deduction, and Filing Information The IRS can catch the discrepancy years later, and you will owe interest on any underpayment.
Spousal and survivor Social Security benefits based on the annulled marriage end. If you were receiving benefits before the marriage, the Social Security Administration may reinstate them effective as of the month the decree was issued, provided you file a timely application.17Social Security Administration. SSA Handbook 1853 – Reinstatement of Benefits When Marriage Terminates
If your immigration status depends on the marriage, talk to an immigration attorney before you file. A conditional permanent resident whose marriage is annulled can still seek a waiver of the joint filing requirement on Form I-751 by showing the marriage was entered in good faith and the late filing was not their fault,18U.S. Citizenship and Immigration Services. Removing Conditions on Permanent Residence Based on Marriage but the sequence and documentation matter enough to get right the first time.
