How to Get an Open Carry Permit in California After Baird v. Bonta

California does not issue a general open carry permit. The state bans carrying firearms openly in most populated areas through three separate statutes, and the only license that comes close to authorizing open carry is a narrow one available in counties with fewer than 200,000 residents. A January 2026 federal appeals court decision struck down the urban open carry ban as unconstitutional, but that ruling is being challenged and the law’s ultimate status is unsettled.

The Only California License That Authorizes Open Carry

In counties with populations under 200,000, the county sheriff has authority to issue a license to carry a loaded, exposed handgun. Three limits shape what this license actually does. It covers handguns only, not rifles or shotguns. It is valid only in the county that issued it. And it uses the same eligibility rules as a standard License to Carry (the CCW license), so the bar to qualify is identical.

The practical result: if you live in one of California’s smaller rural counties, you can apply. If you live in Los Angeles, San Diego, the Bay Area, or any other large metro, this license has not been available. Who Qualifies

Every applicant must meet each of the following:

  • Be at least 21 years old.3California Legislative Information. California Penal Code 26150
  • Be a resident of the county (or a city within it) where you apply, or have your principal workplace there and spend substantial time at that workplace.3California Legislative Information. California Penal Code 26150
  • Not be a person prohibited from possessing firearms. Felony convictions, certain misdemeanor convictions, active restraining orders, and mental health holds all disqualify.
  • Be the recorded owner, with the California Department of Justice, of each firearm the license will cover.3California Legislative Information. California Penal Code 26150
  • Complete a DOJ-approved training course.

Some jurisdictions add a psychological evaluation at the applicant’s expense, typically around $150. It is designed to identify conditions that would make carrying a firearm unsafe.

Non-California residents can apply under a narrow court-ordered arrangement in effect since April 2025. You must belong to one of four organizations (the California Rifle & Pistol Association, Gun Owners of America, Gun Owners of California, or the Second Amendment Foundation), attest under oath that you intend to spend time in the issuing jurisdiction within the next 12 months, and meet every other eligibility requirement.3California Legislative Information. Training, Cost, and Timeline

The mandatory course runs at least 16 hours for a new license and at least 8 hours for renewal. It covers firearm safety and handling, shooting technique, safe storage, legal transportation, where a license holder can carry, permissible use of a firearm, and permissible use of lethal force in self-defense. At least one hour must address mental health and mental health resources. There is a written exam and live-fire component in which you demonstrate safe handling and shooting proficiency with each specific firearm you want listed on the license.4California Legislative Information. With the exception of the mental health portion, the course must be taught and supervised by a firearms instructor certified by the California Department of Justice.5State of California – Department of Justice – Office of the Attorney General. You submit the standard Department of Justice application form to your county sheriff’s office; most jurisdictions accept it through an online portal. The agency then runs a background check and schedules an in-person interview. Expect to pay separate fees for the application, the background check, and the final issuance, which typically add up to several hundred dollars and vary by jurisdiction. The training course is billed directly by the instructor, and the issuing agency does not control what instructors charge. Approval or denial commonly takes several months.

What the Baird v. Bonta Ruling Changed

On January 2, 2026, the Ninth Circuit Court of Appeals held that California’s open carry ban in counties with populations over 200,000 violates the Second Amendment. The court applied the Supreme Court’s 2022 framework in New York State Rifle & Pistol Association v. Bruen, which requires firearm regulations to be consistent with the nation’s historical tradition of regulating arms.2Judicial Council of California. Because roughly 95 percent of Californians live in counties above that population threshold, the ruling effectively invalidates the open carry prohibition for the vast majority of the state. California filed a petition for en banc rehearing on January 16, 2026, and the case could ultimately reach the Supreme Court.

Until the litigation is fully resolved, the legal status of open carry in California’s urban counties remains unsettled. Enforcement could resume if a higher court reverses the decision, or the legislature could enact a replacement law. Anyone considering openly carrying a firearm should track the case rather than treat the current status as permanent.

How the Underlying Bans Still Work

Setting the Baird litigation aside, three statutes form California’s default prohibition on open carry, and they are the reason a permit question exists in the first place.

Carrying a loaded firearm on your person or in a vehicle is illegal in any public place within an incorporated city, or in a prohibited area of an unincorporated county. This applies to handguns, rifles, and shotguns.6California Legislative Information. California Penal Code 25850

Penalties

A first-time violation is generally a misdemeanor punishable by up to one year in county jail, a fine of up to $1,000, or both.6California Legislative Information. California Penal Code 25850

The charge escalates to a straight felony if you have a prior felony conviction, if the firearm is stolen and you knew or should have known, if you are an active gang participant, or if you are otherwise prohibited from possessing a firearm. Certain prior convictions for crimes against people or property, narcotics offenses, or carrying an unregistered handgun can be charged as either a felony or a misdemeanor at the prosecutor’s discretion.6California Legislative Information. Where Open Carry Is Already Legal Without a Permit

California law recognizes specific situations in which openly carrying a firearm requires no license at all. These exceptions apply regardless of how the Baird litigation is resolved.

  • On property you own or inside your own home.
  • At your fixed place of business, by a person present there.
  • While lawfully hunting or fishing, if you hold any required licenses, using firearms appropriate for the activity.
  • While actively using a target range or shooting club for practice.
  • When you reasonably believe carrying is necessary to protect life or property from an immediate, serious threat.

Each of these is narrow and fact-specific. Carrying a firearm to a restaurant because the neighborhood feels unsafe would not qualify. The immediate-danger exception calls for a genuine, specific threat, not a general sense of unease.

A License Is Not a Blanket Authorization

Holding a California license, whether the rural open carry license or a standard CCW, does not let you carry everywhere. State law designates a long list of sensitive places, including school zones, court and government buildings, airports, polling places, bars and restaurants serving alcohol, playgrounds, stadiums, public libraries, and property controlled by the Department of Parks and Recreation, where carrying a firearm is prohibited even with a valid license. Federal law also operates independently of any California license. California also does not honor concealed carry permits issued by any other state. A Texas, Florida, or Arizona permit has no effect the moment you cross into California; the license must be a California-issued one.
