How to Get California Residency: Deadlines, DMV, and Taxes

To get California residency, you move to the state with the intent to make it your permanent home, then back that intent up with action: a California driver’s license within 10 days, vehicle registration within 20 days, voter registration, a California address on your financial and employment records, and a resident tax return for your first full year here. Under Government Code Section 244, residency comes down to two elements working together — you actually live here, and you plan to stay.1California Legislative Information. The Legal Test: Presence Plus Intent

California Government Code Section 243 says every person has a legal residence, and Section 244 sets the rules for locating it.2California Legislative Information. California Code GOV – 2431California Legislative Information. California Government Code 244 Your residence is where you return when you’re not somewhere else for work or a temporary purpose. You can only have one residence at a time. You change it only through the combination of action and intent. What that means in practice: taking a six-month contract in Los Angeles while your house, license, and voter registration stay in Texas doesn’t change your residency. A genuine move means severing meaningful ties to your old state and building new ones in California through daily life. The paperwork below is how the state, universities, and the tax board see that pattern.

Deadlines That Start the Day You Arrive

Two clocks begin running as soon as you become a resident, and both are short.

Driver’s license — 10 days. New residents must apply for a California driver’s license within 10 days of establishing residency. You visit a DMV office, surrender your out-of-state license, and pass a written knowledge test. Vehicle registration — 20 days. Any vehicle you bring with you must be registered in California within 20 days. You pay registration fees plus a use tax based on the vehicle’s value, and most vehicles need a California smog inspection before the DMV will process the paperwork.5California Department of Motor Vehicles. Miss these and you risk fines. You also weaken any later residency claim. An out-of-state license sitting in your wallet six months after you moved is one of the fastest ways to undermine your case, especially if you later apply for in-state tuition.

Auto Insurance Before You Drive

Your policy has to meet California’s minimum liability limits before you get behind the wheel here. As of January 1, 2025, under Senate Bill 1107, the minimums are $30,000 for bodily injury per person, $60,000 for bodily injury per accident, and $15,000 for property damage per accident. Update your address on the policy at the same time, since insurers price premiums based on where the car is garaged.

What to Bring to the DMV

For a REAL ID-compliant license — now required for domestic flights and entering federal facilities — you need three categories of documents.7California Department of Motor Vehicles. REAL ID Document List

  • Identity: an unexpired U.S. passport, a certified U.S. birth certificate, a certificate of naturalization, or a permanent resident card. If your current legal name differs from what appears on that document, bring a certified marriage certificate, court-ordered name change, or similar record.
  • Social Security number: your Social Security card, a W-2, an SSA-1099, or a pay stub showing your full SSN.
  • Two proofs of California residency: two different documents showing your California address. Utility bills, a lease or mortgage statement, bank records, employment documents, insurance papers, vehicle registration, or an IRS or California tax return all count.

Get these together before your appointment. A missing document means a wasted trip, and DMV appointments can take weeks to rebook. If you’ve just arrived and don’t yet have utility bills in your name, a signed lease paired with a bank statement showing your new address works.

Voter Registration and Your Paper Trail

Registering to vote through the Secretary of State is one of the clearest declarations of intent to stay. You must be a U.S. citizen, a California resident, and at least 18 by Election Day.8California Secretary of State. Beyond voting, anchor as many records as you can to your California address. Open a bank account at a local branch. Update your address with your employer. Move professional memberships and subscriptions. No single item proves residency by itself, but the pattern is what agencies and universities look at when deciding whether your move is permanent.

Filing California Taxes

If you move partway through the year, you file as a part-year resident for that tax year and report income earned while living in California on your state return.9State of California Franchise Tax Board. A full-year resident return is one of the strongest pieces of residency evidence you can produce. You’re voluntarily putting all your income under California’s graduated rates, which top out at 13.3 percent on income above $1 million. Continuing to file as a resident of your old state while claiming California residency for other benefits is a contradiction that will surface quickly.

In-State Tuition Is a Separate, Stricter Standard

General legal residency is not the same as residency for tuition at California’s public universities and community colleges. The tuition rule is deliberately harder: you must be physically present in California for more than one year — 366 days — immediately before the residence determination date for the term you’re enrolling in.12University of California Office of the President. You also have to show intent by completing the residency steps above as close to your arrival date as possible. Waiting months to get a California license or register to vote gives the campus residency office a reason to reject the claim. Other Things to Handle Once You’re Here

Community property. California is a community property state. Under Family Code Section 125, property you and a spouse acquired in another state that would have been community property had you lived here at the time is treated as “quasi-community property,” and in a California divorce it’s divided the same way as community property regardless of whose name is on the title.16California Legislative Information. Wills and estate plans. Probate Code Section 6113 generally honors an out-of-state will if it was valid where signed.17California Legislative Information. California Code, Probate Code – PROB 6113 Your existing will doesn’t become invalid the day you move, but California’s community property rules can change how assets actually pass to heirs, so a review with a California estate attorney is worth the time.

Professional licenses. California has no blanket reciprocity for professional or vocational licenses. Each board sets its own rules for out-of-state applicants, and some require additional exams, supervised hours, or coursework.
