How to Get Married in California Without a Ceremony

To get married in California without a ceremony in the traditional sense, apply for a confidential marriage license at a county clerk’s office, then have an authorized officiant conduct a brief private signing where you each state that you take the other as your spouse. California law requires that moment of solemnization, so a truly ceremony-free marriage isn’t possible, but the confidential license strips the event down to its legal minimum: no witnesses, no guests, no public record. The whole thing can be finished in a single afternoon.

Why the Confidential License Is the Closest Option

California issues two kinds of marriage licenses. A public license requires at least one witness at the ceremony, and the resulting record is open to anyone who asks for a copy. A confidential license requires no witnesses at all, and the marriage record stays sealed from public view unless a court orders its release.1California Department of Public Health. Types of Marriage Licenses

Both licenses produce a legally identical marriage. There is no second-tier status. A confidential marriage carries the same weight for taxes, inheritance, healthcare decisions, immigration, and every other legal purpose as a wedding held in front of three hundred guests. What you give up is the audience. What you gain is privacy, speed, and a sealed record.

Who Qualifies

California Family Code Section 500 sets three conditions. Both people must be at least 18 years old, both must be unmarried, and both must already be living together as spouses when they apply.2California Legislative Information. California Code FAM 500 – Confidential Marriage Minors cannot obtain a confidential license under any circumstances, even with parental consent.1California Department of Public Health. Types of Marriage Licenses

The “living together as spouses” requirement sounds like it might involve paperwork, but in practice the county clerk has you sign an affidavit on the license itself attesting that you meet it.1California Department of Public Health. Types of Marriage Licenses Clerks do not typically ask for a lease or utility bills. The affidavit satisfies the statute.

If either of you was previously married, that marriage must be fully dissolved before applying. If the divorce or annulment became final within the last 90 days, bring a certified copy of the final judgment to your appointment.3Santa Clara County Clerk-Recorder. Apply for a Marriage License

Applying at the County Clerk

Both of you must appear together, in person, at a County Clerk-Recorder’s office. Most counties require an appointment. Some allow walk-ins during limited hours. Check the county website before you go.

Bring valid government-issued photo ID (driver’s license, state ID, or passport) and be ready to provide:

  • Your full legal names, as given at birth or changed by court order
  • A mailing address, which can be a business address or PO box rather than your home4Justia Law. California Code Family Code 350-360
  • Your dates and places of birth, including state or country
  • Your parents’ full birth names, including mothers’ maiden names, and their birthplaces3Santa Clara County Clerk-Recorder. Apply for a Marriage License

Most county forms also ask for Social Security numbers, though the state statute doesn’t list them as required.4Justia Law. California Code Family Code 350-360 Have the numbers with you anyway. Many counties offer online pre-registration that cuts your appointment time considerably.

Fees vary. Los Angeles County charges $85, Santa Clara County $83, Yolo County $90, and Riverside County $122.5Los Angeles County Registrar-Recorder/County Clerk. Marriage License and Ceremony Fees Accepted payment methods vary by county but generally include cash, debit cards, and money orders.

The Private Signing

This is where the phrase “without a ceremony” trips people up. California does not let you file paperwork and be married. Someone authorized must officiate, and both of you must declare in that person’s presence that you take each other as spouses.7Justia Law. California Code Family Code 420-425 No specific words are required. You can say “I do,” read vows, or simply state that you take each other as spouses. The law doesn’t prescribe a script.

What makes the confidential license different is that no witnesses need to be present and no witnesses sign the license.1California Department of Public Health. Types of Marriage Licenses The “ceremony” can be you, your partner, and the officiant standing in a clerk’s office or your living room for two minutes. That is as close to no ceremony as California law permits.

If you want to keep it maximally simple, have the county clerk officiate. Each county clerk is automatically designated a commissioner of civil marriages and can perform the signing right there at the office, often the same day you pick up the license.

Who Can Legally Officiate

California Family Code Section 400 authorizes a specific list:8Justia Law. California Code Family Code 400-402

  • Priests, ministers, rabbis, and other authorized representatives of a religious denomination
  • Active or retired California judges, court commissioners, and commissioners of civil marriages
  • Federal judges, including Supreme Court justices, appellate and district judges, bankruptcy and tax court judges, and U.S. magistrates (active or retired)
  • California state legislators and constitutional officers, and members of Congress representing a California district, while in office
  • County clerks

Notaries public are not on this list and cannot legally solemnize a marriage in California. If a notary signs your license, the marriage may not be valid.

Having a Friend Officiate

Many counties run a “Deputy Commissioner for a Day” program that lets a friend or family member officiate after a short deputization. In Los Angeles County, the program costs $75 and involves a one-hour virtual class and an oath, after which the person can perform a ceremony anywhere in California.9Los Angeles County Registrar-Recorder/County Clerk. Deputy Commissioner for a Day Program Apply at least two months ahead. The deputized person doesn’t need to live in the county. Not every county offers this, so ask your clerk’s office.

Filing the License After the Signing

The officiant must return the completed license to the county clerk’s office within 10 days of the signing.10California Legislative Information. California Code Family Code 506 Until that happens, the marriage isn’t recorded. If the clerk officiated, this is handled internally. If a private officiant did the signing (a minister, a deputized friend), confirm they understand the deadline and follow up to make sure the license was returned. This is the step that occasionally falls apart.

Getting Certified Copies

Once the clerk records the license, it becomes an official marriage certificate. Only you and your spouse can purchase certified copies, and you must appear together with valid photo ID at the county clerk’s office where the license was registered.1California Department of Public Health. Types of Marriage Licenses Certified copies of a confidential marriage certificate are not available from the state Department of Public Health. Los Angeles County charges $19 per copy.11Los Angeles County Registrar-Recorder/County Clerk. Online Request – Marriage Records Fees are similar in other counties. Order several at once; you’ll want them for name changes, insurance, and other administrative follow-ups.

The record itself stays sealed from public access. Nobody but you and your spouse can obtain a copy without a court order showing good cause.12California Legislative Information. California Code Family Code FAM 511 – Confidential Marriage Certificates The clerk can confirm that a marriage exists if asked, but will not disclose the date or any other details.

Recognition Outside California

A confidential marriage performed in California is recognized in every other U.S. state and by all federal agencies. The license type doesn’t limit recognition. For immigration purposes, USCIS requires that the marriage be legally valid in the place of celebration, entered into in good faith, and that both parties were present during the ceremony.13U.S. Citizenship and Immigration Services.
