The reliable ways to get out of jury duty in Nevada are to fit one of the automatic exemptions under state law, or to ask the court for an excuse or deferral backed by documentation of a medical problem, a family emergency, a genuine hardship, or a scheduling conflict. You cannot opt out because service is inconvenient, and ignoring the summons can bring a contempt finding and a fine of up to $500.1Nevada Legislature. Automatic Exemptions You Can Claim as a Right
If you fit one of the categories in NRS 6.020, the court must excuse you once you ask and confirm you qualify. No hardship story required.
- You are 70 or older. The court will excuse you from both grand jury and trial jury service on your request, with your age confirmed by affidavit or other proof.
- You are 65 or older and live 65 or more miles from the courthouse. Both conditions have to be met.
- You are a member of the Nevada Legislature or a Legislative Counsel Bureau employee, and the Legislature is in session.
- You are a police officer as defined under Nevada law.
These are exemptions of right, not judicial favors.2Nevada Legislature. Nevada Revised Statutes 6.020 – Exemptions From Service Notify the court, prove you qualify, and you are done.
Medical Conditions
Under NRS 6.030, the court can temporarily excuse you for sickness or physical disability, and can permanently excuse you for a permanent physical or mental disability that prevents satisfactory service. For a permanent excuse, expect the court to ask for a certificate from a physician or advanced practice registered nurse describing the nature and extent of the disability.3Nevada Legislature. Whatever the county, the medical documentation should be on letterhead, dated close to your reporting date, and specific about why service is not possible. A vague note will not carry the request.
Serious Illness or Death in the Family
A serious illness or death in your immediate family is a recognized ground for a temporary excuse.3Nevada Legislature. Nevada Revised Statutes 6.030 – Grounds for Excusing Jurors Attach documentation such as a hospital admission record or death certificate with your request.
Financial or Personal Hardship
Hardship claims that don’t fit the medical or family boxes go to the judge. The jury commissioner’s office does not have authority to release you on hardship grounds alone.4Washoe Courts. Frequently Asked Questions If you are self-employed, work for tips, or would lose significant income, you can lay that out for the judge, but there is no guarantee. Bring documentation of your income and expenses, and be ready to explain why serving would be a real burden rather than an inconvenience.
Scheduling Conflicts and Deferrals
If the problem is when you were called rather than whether you can serve at all, ask for a deferral instead of an excuse. A deferral simply moves your service to a later date, and courts grant them more readily. Washoe County’s jury commissioner will work with callers to find a reasonable alternative reporting date.4Washoe Courts. Frequently Asked Questions Prepaid travel, exam schedules, and similar conflicts are common grounds. Have the itinerary, enrollment verification, or other proof ready.
Disqualification Is Not the Same as an Excuse
If you don’t actually qualify for jury service in Nevada, respond as disqualified rather than asking for an excuse. Qualified jurors must be electors of the state, have a working knowledge of English, cannot have been convicted of treason, a felony, or another serious crime without restored civil rights, and cannot be incapable of serving due to a physical or mental condition.5Nevada Legislature. Smaller Counties
Smaller counties may use paper forms or accept requests by mail, fax, or in person. Your summons tells you which method to use. Humboldt County, for instance, requires written excuse requests at least three days before your appearance date.7Humboldt County, NV. Jury Request to be Excused
Practical Points for Any Court
Respond early. Courts are far more receptive to requests submitted well before the reporting date than to last-minute pleas. Put your juror identification number on everything you send. Attach copies of documents, not originals. Keep copies of your submission. If the court denies your request, you are expected to appear; failing to show up after a denial puts you at real risk of contempt.
What Happens if You Just Ignore the Summons
Throwing the summons away is the worst option. The court will issue an order requiring you to appear and explain your absence. Without a satisfactory reason, you can be held in contempt and fined up to $500.1Nevada Legislature. Nevada Revised Statutes 6.040 – Penalty for Failing to Attend and Serve as a Juror The fine is not the end of it. A contempt finding stays on your record, and the court can issue a bench warrant if you keep ignoring the show-cause order. Even a valid excuse has to be raised before the reporting date, not after you have been marked absent.
If Your Summons Is Federal, the Rules Are Different
A summons from the U.S. District Court for the District of Nevada is a separate matter. Federal qualification requires U.S. citizenship, being at least 18, one year of residency in the judicial district, and the ability to read, write, and speak English.8Office of the Law Revision Counsel. 28 US Code 1865 – Qualifications for Jury Service Federal courts can excuse jurors for “undue hardship or extreme inconvenience,” including long travel distances, grave family illness, and severe economic hardship. Active-duty military members, police and fire personnel, and public officers actively performing official duties are automatically exempt.9Office of the Law Revision Counsel. 28 USC Chapter 121 – Juries; Trial by Jury
Ignoring a federal summons is more expensive than ignoring a state one: up to $1,000 in fines, up to three days in jail, community service, or any combination of those.
