To get unemployment in NY, you file a claim with the New York State Department of Labor, prove you lost work through no fault of your own and earned enough during your base period, and then certify each week that you are able, available, and looking for work. Who Qualifies
Eligibility has two parts. The first is financial: you need enough reported wages. The second is the reason your job ended.
The Wage Test
You must have earned wages in at least two calendar quarters of your base period. The standard base period is the first four of the last five completed calendar quarters before the quarter you file.3Labor.ny.gov. That request must be made within 10 days of the date on your Monetary Determination letter.4Department of Labor. Request for Reconsideration
One tradeoff worth understanding before you ask: wages “used” to establish this claim cannot be used again on a future claim.4Department of Labor. Request for Reconsideration If you pull recent wages in now, they will not be available if you need to file again soon.
The Reason You Lost Your Job
You need to have lost work through no fault of your own, and you must be ready, willing, and able to work. Fired for misconduct or a policy violation, or a quit without good cause, generally disqualifies you. If the firing was for a criminal act, those wages cannot even count toward calculating your benefit.5Department of Labor. Before You File a Claim for Unemployment FAQs
Quitting is not an automatic bar. New York recognizes good-cause reasons including domestic violence or threats affecting your workplace, leaving to care for a seriously ill family member or infant when there is no other option, following a spouse or committed domestic partner who relocated for work, and intolerable working conditions such as persistent harassment or false accusations of dishonesty. What to Have Ready Before You File
The online form does not save easily, so pull everything together first.7Department of Labor. What Do I Need to File? You will need:
- Your Social Security number and a driver’s license or government ID. Non-citizens should have their employment authorization number.
- For each employer over the past 18 months: legal name, address, Federal Employer Identification Number, and New York State registration number. These are on your W-2.
- Start and end dates for each job.
- Bank account and routing number if you want direct deposit.
- Your DD-214 if you had military service in the past 18 months.
Filing Your Claim
File online at the Department of Labor’s website using an NY.gov ID, which you can create from the login page.8Labor.ny.gov. The application walks through your personal information, employers, last day worked, and reason for separation. Take real care with the separation reason. Picking the wrong category can trigger an investigation and hold up your payments for weeks.
After You File
You will receive a Monetary Determination letter by mail. It states whether you qualify based on wages, gives your weekly benefit rate, and lists the wages employers reported.10Department of Labor. How Much You Will Receive
As of October 2025, the weekly rate runs from $140 up to $869 based on your base-period earnings.3Labor.ny.gov. How Your Weekly Unemployment Insurance Benefit Payment Is Calculated Benefits are available for up to 26 weeks.
If You Work Part-Time
You can work part-time and still collect a reduced benefit. Reductions are based on hours worked in the week:12Department of Labor. Partial Unemployment Eligibility
- 0 to 10 hours: no reduction
- 11 to 16 hours: 25% reduction
- 17 to 21 hours: 50% reduction
- 22 to 30 hours: 75% reduction
- 31 or more hours: no benefits that week
If your gross weekly pay exceeds the maximum benefit rate, you are ineligible that week regardless of hours. And there is a per-day cap: even if you worked 12 hours in a single day, only 10 count toward your weekly hours total.12Department of Labor. Partial Unemployment Eligibility
Pension and Retirement Payments
If you get a pension, annuity, 401(k) distribution, or similar payment from a base-period employer that contributed to the plan, your weekly benefit is reduced by the full amount of the payment. This applies even if you also contributed. If you were the sole contributor, no reduction applies. Certifying Each Week
Every week you must certify that you were unemployed or partially employed, available for work, and actively job searching. Certification is available Monday through Friday from 7:30 a.m. to midnight, and continuously from Saturday 12:01 a.m. through Sunday at midnight.9Department of Labor. Report every job, including freelance and self-employment, even work lasting an hour. Once you are back full-time, stop certifying. Claiming for weeks you actually worked is the fastest path to a fraud case.14Labor.ny.gov. Certify for Weekly Unemployment Insurance Benefits
The Work Search Rule
You need at least three work search activities per week.15Department of Labor. Work Search Frequently Asked Questions Applications, interviews, networking events, and career workshops all count. Keep a written log with dates, companies, positions, contacts, and outcomes. You do not submit it weekly, but the Department can audit at any time.
If you turn down a job offer, your claim gets reviewed to decide whether the offer was suitable. You generally do not have to take a position that pays well below the prevailing rate for similar work in your area, or one open because of a labor dispute. Beyond those protections, refusing a reasonable offer can end your benefits.
How You Get Paid
You choose direct deposit or a Way2Go debit card when you file. If you file by phone and do not request direct deposit, the card comes in the mail automatically. It provides free ATM withdrawals through the Allpoint and MoneyPass networks.16Labor.ny.gov. Unemployment Insurance Payment Options
Taxes
Unemployment benefits are taxable federally. New York sends you IRS Form 1099-G by January 31 for the prior year. You can ask for a flat 10% to be withheld from each payment for federal taxes, either when you file or later through your NY.gov account.17Employment and Training Administration – U.S. Department of Labor. If You Are Denied
You have 30 days from the date on the determination letter to request a hearing, and the request must be in writing.18Unemployment Insurance Appeals Board. An Administrative Law Judge holds the hearing through the Virtual Hearings Center, usually within 30 days of your request. Overpayments and Fraud
If the Department decides you were paid benefits you should not have received, you have to repay. This can happen without any wrongdoing on your part, for example when an employer reports different wages than you did.
Intentional fraud is different. Under New York law, a false statement to collect benefits results in forfeiture of between 4 and 80 future benefit days on top of full repayment. Aggravated fraud, such as having someone else certify using your login, can trigger the 80-day maximum, and serious cases can bring criminal restitution and prosecution.20Labor.ny.gov. The two most common triggers are failing to report part-time earnings and continuing to certify after going back to work full-time. The Department cross-references employer wage data quarterly, so discrepancies surface.
