How to Get Your Hazmat Endorsement in Virginia

To get a hazmat endorsement in Virginia, you need a valid Virginia CDL, a TSA fingerprint-based background check, entry-level driver training if this is your first hazmat endorsement, and a passing score on the hazmat knowledge test at a Virginia DMV customer service center. The TSA background check is the slow step, taking 30 to 60 days, so start it before anything else and use the wait to finish training and study.

Who Qualifies

You must already hold a valid Virginia CDL. Federal law requires you to be at least 21 to transport hazardous materials or drive commercially across state lines.¹ Virginia issues CDLs at 18, but under-21 drivers are limited to intrastate work without a hazmat endorsement.

You must also be a U.S. citizen, lawful permanent resident, naturalized citizen, or hold another eligible immigration status such as refugee or asylee in lawful status.² And you need a current DOT medical certificate on file, which is a baseline CDL requirement rather than an endorsement-specific one.³

Start the TSA Background Check

The TSA threat assessment is the bottleneck. Virginia DMV cannot issue the endorsement until TSA clears you, and clearance typically takes 30 to 60 days. Starting here lets the background check run in parallel with training and test prep.

You submit fingerprints at a Virginia DMV customer service center equipped to process hazmat applications. Not every location offers this service, so check the DMV website for one that does.⁴ The fee is $83 and is non-refundable.⁵

If you already hold a valid Transportation Worker Identification Credential (TWIC), the fee drops to $41 and you skip the fingerprinting step. That reduced-fee application can be filed at any Virginia DMV customer service center.⁵

Bring identity and immigration documents that TSA accepts, such as a U.S. passport, birth certificate, or permanent resident card. Acceptable forms vary by immigration category.⁶ When TSA clears you, DMV mails an approval letter. Keep it. You need to return to DMV in person to finalize the endorsement.⁴

Complete Entry-Level Driver Training

First-time hazmat applicants must complete entry-level driver training (ELDT) in hazmat theory before taking the knowledge test. The requirement applies to anyone adding the endorsement on or after February 7, 2022, regardless of when the underlying CDL was issued.⁷

Training has to come from a provider listed on FMCSA’s Training Provider Registry. There is no set number of hours, but the curriculum must cover all 13 required topics, and you have to score at least 80 percent on the provider’s theory assessment.⁸ Your provider reports completion to the registry, and DMV verifies it electronically before letting you sit for the test.⁹

If you held a hazmat endorsement before February 7, 2022 and are renewing, ELDT does not apply.⁹

Pass the Hazmat Knowledge Test

The hazmat knowledge test is administered at a Virginia DMV customer service center. It covers the hazardous materials section of the Virginia CDL manual: hazard class identification, shipping papers, placards, spill response, and emergency procedures. There is no behind-the-wheel component. Virginia DMV will not let you take the test until FMCSA’s registry confirms ELDT completion, if training is required in your case.¹⁰

Study the hazardous materials section of the manual carefully. If you fail, DMV allows retakes, though a waiting period may apply between attempts.

Return to DMV to Finalize the Endorsement

Once TSA has approved you and your knowledge test is on record, go back to a Virginia DMV customer service center in person. DMV photographs you and issues a new CDL card with the “H” endorsement.⁴

On top of the $83 background check fee, the endorsement itself costs $1 per year of your license’s validity.⁵ The background check is where the money actually goes.

Criminal Convictions That Block Approval

The TSA check is not a formality. Some convictions permanently disqualify you; others disqualify you for a period of years. Screening yourself before paying $83 can save you time and money.

Permanent Disqualifications

Convictions for the following offenses (including conspiracy or attempt) permanently bar the endorsement:

Espionage, sedition, or treason
Federal terrorism offenses or comparable state crimes
Murder
Improper transportation of hazardous materials under federal law
Explosives offenses, including possession, distribution, or manufacturing
Bomb threats against public facilities or transportation systems
Crimes involving a transportation security incident that caused significant loss of life, environmental damage, or economic disruption¹¹

Interim Disqualifications

A second list of offenses disqualifies you if you were convicted within seven years of applying, or released from incarceration within five years of applying. Conspiracy and attempt count the same as the underlying conviction.

Unlawful firearms possession or dealing
Arson
Robbery or extortion
Kidnapping
Assault with intent to kill
Drug distribution or possession with intent to distribute
Fraud, bribery, or money laundering connected to other listed crimes
Smuggling or immigration violations
Voluntary manslaughter¹²

Once the applicable window has passed, you can apply again.

If TSA Sends a Denial Letter

A Preliminary Determination of Ineligibility letter tells you which offense triggered the finding. You have 60 days from receipt to file an appeal, a waiver request, or both.¹³

An appeal argues the information is wrong: expunged record, mistaken identity, or similar. A waiver accepts the conviction but asks TSA to approve you anyway. TSA evaluates waivers on five factors: circumstances of the offense, restitution, completion of court-ordered treatment, medical evidence of restored mental capacity where relevant, and any other evidence that you do not pose a security threat.¹³

Renewing the Endorsement

Federal rules cap the endorsement at five years and require a new TSA security screening at each renewal.¹⁴ You retake the hazmat knowledge test, submit new fingerprints, and pay the $83 fee again.¹⁵

Virginia DMV mails a renewal notice at least 60 days before expiration, and federal guidance is to file at least 30 days out so the background check has time to clear.¹⁴ If the endorsement lapses, you cannot legally haul placarded loads until the new one is issued.

Moving to Virginia With an Out-of-State Endorsement

Bringing a hazmat endorsement from another state does not exempt you from Virginia’s process. TSA’s threat assessment applies to new applications, renewals, and transfers, so you go through the background check again at a Virginia DMV location.² Virginia law requires TSA confirmation that you are not a security threat before DMV prints the endorsement on a Virginia CDL.¹⁶

Driving Placarded Loads Without the Endorsement

Operating a commercial vehicle in violation of any CDL restriction, including hauling placarded hazardous materials without the “H” endorsement, is a Class 2 misdemeanor in Virginia. A hazmat-related conviction can also trigger a three-year disqualification from driving any commercial vehicle requiring placards.¹⁷ That is a heavy cost for a shortcut that saves almost no time compared to running the process correctly.
