How to Get Your IHSS W-2 Form and File Your Taxes

Your IHSS W-2 is the annual wage and tax statement for work you did through California’s In-Home Supportive Services program, and the fastest way to get it is to download it from the IHSS Electronic Services Portal at etimesheets.ihss.ca.gov. The California Department of Social Services also mails a paper copy by January 31 each year. What the form shows, and what you do with it, depends on whether you live with the person you care for.

Download It From the Electronic Services Portal

The portal usually has your W-2 ready before the paper copy reaches your mailbox. After logging in at etimesheets.ihss.ca.gov:1Riverside County Department of Public Social Services. IHSS Electronic Services Portal – W-2 Pages From ESP Provider User Guide

  • Open the Financial menu in the navigation bar.
  • Click the Taxes drop-down and choose W-2 Forms.
  • Pick the tax year.
  • Click View W-2 next to the recipient’s name. A PDF opens that you can save or print.

If you care for more than one recipient, each one generates a separate W-2. Download all of them before you file.

If the Paper Copy Doesn’t Arrive

Mail delivery after the January 31 send date usually takes another week or two. If nothing has arrived by mid-February, log into the ESP to confirm your mailing address, then call the IHSS Service Desk at 1-866-376-7066 or contact your county IHSS office to request a duplicate. The California State Controller’s Office doesn’t handle IHSS W-2 reissues; those go through your county office or CDSS.2State Controller’s Office. Form W-2 Wage and Tax Statement FAQs

What the Boxes Mean for You

Open the PDF and look at Box 1 first. That number, or its absence, tells you which category you fall into.

Non-Live-In Providers

If you don’t share a home with the recipient, your full IHSS earnings appear in Box 1 as federal taxable wages and in Box 16 as state taxable wages. You report them like income from any other job.

Live-In Providers

If you live in the same home as the person you care for and have a processed SOC 2298 on file, Box 1 and Box 16 will both read zero. The money isn’t missing; it’s reported in Box 12 with code II, which shows the total amount excluded under IRS Notice 2014-7.3California Department of Social Services. Live-In Provider Self-Certification Information The exclusion comes from Section 131 of the Internal Revenue Code, which treats Medicaid waiver payments to live-in caregivers as nontaxable difficulty-of-care payments.4Internal Revenue Service. Certain Medicaid Waiver Payments May Be Excludable From Income California follows the same rule for state income tax.

Social Security and Medicare Still Show Up

The income tax exclusion doesn’t touch FICA. Even with $0 in Box 1, most live-in providers will still see Social Security tax withheld in Box 4 (6.2%) and Medicare tax withheld in Box 6 (1.45%).3California Department of Social Services. Live-In Provider Self-Certification Information Check those amounts against your final December pay stub.

Some family caregiving arrangements are exempt from FICA entirely, so those boxes will also be zero. FICA is not withheld when the provider is a spouse caring for their spouse, a parent caring for their child, or a child under 21 caring for their parent. Other relatives and non-relatives are not exempt.5Internal Revenue Service. Family Employees If you fit one of the exempt categories but still see FICA withheld, call your county IHSS office to fix the classification.

Filing Your Taxes With It

Non-live-in providers enter the W-2 the same way as any wage statement. The Box 1 number flows through to your federal and California returns as taxable wages.

Live-in providers run into a quirk: IRS e-filing rejects W-2s with $0 in Box 1. If your form has no federal withholding in Box 2 and no state withholding in Box 17, you generally don’t need to enter it on your return at all. If you do need to report the income, most tax software has a dedicated prompt for Medicaid waiver payments or nontaxable earned income rather than a direct W-2 entry. Follow that path instead of forcing the W-2 through the wage section.

Keep the W-2 and your final December pay stub for at least three years. The IRS can audit returns within three years of filing.

Claim the EITC Even With $0 Wages

This is the part live-in providers often miss. Even though your IHSS wages are excluded from gross income, you can choose to count them as earned income when claiming the federal Earned Income Tax Credit and the Additional Child Tax Credit. The IRS lets you include all (but not part) of the excluded payments for this purpose.4Internal Revenue Service. Certain Medicaid Waiver Payments May Be Excludable From Income

California has a parallel rule. The Franchise Tax Board allows excluded IHSS income to count as earned income for the California Earned Income Tax Credit.6Franchise Tax Board. In-Home Supportive Services Depending on household size and total income, those credits can be worth thousands of dollars.

If the Numbers Are Wrong

If the wages don’t match your pay stubs, FICA withholding looks off, or your live-in exclusion wasn’t applied even though your SOC 2298 was processed, call the IHSS Service Desk at 1-866-376-7066 to start a correction. When CDSS agrees the W-2 is wrong, it issues a Form W-2c (Corrected Wage and Tax Statement). Corrections take several weeks, so request them early.

As a backup while you wait, the IRS can give you a Wage and Income Transcript showing what your employer reported. Order one through the “Get Transcript” tool at IRS.gov, by phone at 800-908-9946, or by mailing Form 4506-T. Online requests usually arrive within five to ten days.7Internal Revenue Service. How Do I Get My Tax Transcript The transcript doesn’t replace the W-2 for filing, but it confirms what the IRS has on record.

Why Box 1 Reads the Way It Does: the SOC 2298

The live-in income tax exclusion is not automatic. You have to file Form SOC 2298, the Live-In Self-Certification Form, so the state knows you share a home with the recipient. Until that form is processed, your IHSS wages are reported as taxable income on your W-2.3California Department of Social Services. Live-In Provider Self-Certification Information You can download it from the CDSS website or pick it up at your county IHSS office.8California Department of Social Services. SOC 2298 – IHSS Program Live-In Self-Certification Form for Federal and State Tax Wage Exclusion

Allow up to 30 days after the processing center receives it before your wages start being excluded. Wages paid before the form is processed will not be retroactively adjusted on that year’s W-2.3California Department of Social Services. Live-In Provider Self-Certification Information So if you filed the form partway through the year, expect a mixed W-2 showing some taxable wages in Box 1 and the rest excluded in Box 12.

Amending Earlier Returns

If you were a live-in provider in prior years and reported your IHSS wages as taxable because you didn’t know about the exclusion, you can file Form 1040-X to claim a refund. The deadline is three years from the date you filed the original return or two years from the date you paid the tax, whichever is later.4Internal Revenue Service. Certain Medicaid Waiver Payments May Be Excludable From Income You don’t need a corrected W-2 for years before your SOC 2298 was processed. The state will not amend those forms.3California Department of Social Services. Live-In Provider Self-Certification Information Adjust the income directly on your 1040-X and attach a statement referencing IRS Notice 2014-7.
