To open a motor vehicle repair shop in New York, you must register the business with the Department of Motor Vehicles before you accept paid work. The process has three parts: file the VS-1 Original Facility Application by mail with a $10 application fee and a $150 registration fee, submit the supporting documents the DMV requires, and pass an on-site facility inspection. One certificate covers one location for two years, so a company with multiple shops needs a separate registration for each address.1New York State Senate. New York Vehicle and Traffic Law 398-C – Registration Required; Application; Fees and Issuance of Certificate of Registration
Who Has to Register
The rule applies to anyone who performs paid mechanical repairs, body work, or diagnostic services on motor vehicles, and to shops that inspect vehicles solely to appraise damage or estimate repair costs for insurance.2New York State Department of Motor Vehicles. Motor Vehicle Repair Shop Regulations A storefront garage, a mobile unit that drives to customers, and an individual working out of a home garage are all covered if money changes hands for the work.
A handful of situations are carved out under subdivision (b) of Section 82.3 of the regulations. If you think your operation might fit an exclusion, read the Commissioner’s Motor Vehicle Repair Shop Regulations (CR-82) and confirm before you assume you’re exempt. Operating without a required registration is a $1,000 civil penalty, and the DMV can ask the Attorney General for a court order shutting you down.3New York State Senate. Documents to Gather Before You File
Most denials come from an incomplete package. The DMV’s VS-145 Repair Shop Requirements sheet is explicit: if any required document is missing, the application is rejected.4New York State Department of Motor Vehicles. VS-145 Repair Shop Requirements Pull everything together before you open the VS-1.
- Proof of business name. Corporations and LLCs need a filing receipt from the New York State Department of State. Partnerships and sole proprietors using an assumed name need a Business Certificate (DBA) filed with the county clerk where the business is located, plus a phone bill showing the business name at the business address.
- Owner and officer identification. Copies of the front and back of a valid driver license for every owner, partner, officer, or LLC member. A non-driver ID card, passport, or resident alien card is accepted for anyone without a driver license.5New York State Department of Motor Vehicles. Original Facility Application
- Federal Employer Identification Number from the IRS. You can apply online at irs.gov and receive the number immediately at no cost.
- Certificate of Authority (DTF-17A) or New York State tax ID number from the Department of Taxation and Finance, confirming you can collect sales tax.5New York State Department of Motor Vehicles. Original Facility Application
- Workers’ Compensation and Disability Insurance, if you have employees. Attach proof of current coverage.4New York State Department of Motor Vehicles. VS-145 Repair Shop Requirements
- Zoning approval from your local municipality, dated within the last ten years, confirming the location is approved for automotive repair. Shops in the five boroughs of New York City (Queens, Kings, Richmond, Bronx, or New York County) also need a Certificate of Occupancy that states the exact location of the auto repair business.
- Refrigerant equipment proof. If you service air-conditioning systems, include a manufacturer’s certificate or invoice for approved refrigerant recycling or recapturing equipment. Any technician who handles vehicle refrigerants for pay must also hold Section 609 certification under the Clean Air Act, obtained through an EPA-approved program such as ASE or MACS.6US EPA. - A unique mailing address that is verifiable through the USPS. You need exclusive use of the mail receptacle at that address.
- For a mobile repair shop, the physical address where the vehicle is parked at night.
Filling Out the VS-1
The VS-1 Original Facility Application is available on the DMV website under business forms.7New York State Department of Motor Vehicles. Open and Operate a Repair or Body Shop Read the CR-82 regulations and the VS-145 requirements sheet first so you know what the form is really asking for.
You select your legal structure on the form, and the information required depends on the choice. A corporation whose stock is not publicly traded must list the name and home address of every officer, director, and stockholder who holds more than ten percent of the outstanding stock.1New York State Senate. New York Vehicle and Traffic Law 398-C – Registration Required; Application; Fees and Issuance of Certificate of Registration Partnerships must enclose a copy of partnership papers from the county clerk.
The form also asks you to identify the shop manager, describe the repair services you’ll offer, and state whether you service motor vehicle air-conditioning systems. Answer that AC question honestly, because the DMV investigator will check for refrigerant equipment during the on-site inspection. The application needs an original signature; stamped signatures are not accepted, and the DMV does not accept starter checks for payment.4New York State Department of Motor Vehicles. Where to Send It and What It Costs
Mail the completed VS-1, every supporting document, and your payment to:

Include two separate payments by check or money order, both made out to the Commissioner of Motor Vehicles: a $10 non-refundable application fee and a $150 registration fee.2New York State Department of Motor Vehicles. Motor Vehicle Repair Shop Regulations The $10 is gone whether you’re approved or not. The $150 covers your two-year registration if approved, though the commissioner may issue certificates on a staggered expiration schedule and prorate the fee by month, so your first certificate could cover slightly less than two full years.1New York State Senate. New York Vehicle and Traffic Law 398-C – Registration Required; Application; Fees and Issuance of Certificate of Registration
Plan on six to eight weeks for the administrative review. During that time the DMV verifies your insurance, business standing, and background information. Missing paperwork or an incorrect payment amount gets the whole package rejected, so run through the VS-145 checklist one more time before you seal the envelope.
The On-Site Inspection
After the paperwork clears, a DMV investigator schedules a visit to the shop. The investigator confirms that the facility has the tools and equipment for the services you listed, that the location matches what you described, and that you can produce the records and documentation the regulations require.9New York State Senate. New York Vehicle and Traffic Law 398-D – Motor Vehicle Repair Shop Requirements If you said yes to servicing AC systems, the investigator will look for your approved refrigerant equipment.
The regulations don’t publish an item-by-item checklist, and the investigator has broad authority to examine conditions at the facility. A clean, organized shop that visibly has the tools for the work it advertises is the straightforward path through this step.
Signs You Must Post Once You’re Registered
Three signs have to go up, and the specs are tighter than most new owners expect.
- Official indoor sign. The Commissioner provides this one. Post it indoors where customers can see it, or outdoors if the shop has no indoor customer area. Mobile units attach it to the vehicle in a spot pedestrians can see.10Cornell Law Institute. New York Comp. Codes R. and Regs. Tit. 15 82.7 – Signs
- Official outdoor sign. You buy and post this one. It must be three feet wide by two feet high, made of durable material, with a kelly green background and white lettering. “REGISTERED” appears in an arc with your registration number below it. The sign must be in place within 30 days of your registration date and visible to the public from outside the premises.10Cornell Law Institute. New York Comp. Codes R. and Regs. Tit. 15 82.7 – Signs
- Labor charge sign. At least 8½ by 14 inches, posted next to the indoor sign, explaining how your labor charges are calculated. You can show your hourly rate on it. Mobile units affix this one to the outside of the vehicle too.
Form VS-47, the DMV’s “Registered Repair Shop Notice to Consumers,” also has to be displayed conspicuously where customers can see it.11New York State Department of Motor Vehicles. DMV Registered Repair Shop Notice to Consumers The DMV does not supply the outdoor sign or the labor charge sign; order those from a sign shop or automotive supplier.7New York State Department of Motor Vehicles. Renewing Every Two Years
Repair shop registrations last two years.8New York State Department of Motor Vehicles. Renew, Replace, or Change a Business License or Registration The biennial renewal fee is $150.1New York State Senate. New York Vehicle and Traffic Law 398-C – Registration Required; Application; Fees and Issuance of Certificate of Registration The DMV mails a Facility Renewal Application (VS-2) as your expiration approaches. You can renew up to 60 days early, and the DMV accepts late renewals for up to six months after expiration, though operating during that late window still exposes you to penalties.
Online renewal is fastest. You’ll need your facility number and validation number from the business certificate, your federal EIN, the Social Security number of an owner, partner, or officer, and your business phone number and email.8New York State Department of Motor Vehicles. Renew, Replace, or Change a Business License or Registration Two things force a paper VS-2 renewal: a business address change you haven’t already filed with the DMV, and a felony or misdemeanor conviction of any owner, partner, or officer since the last renewal.
What Happens If You Skip Registration
Running an unregistered shop is a $1,000 civil penalty. A first-time offender can cut that to $500 by applying for registration within ten days of the penalty.3New York State Senate. New York Vehicle and Traffic Law 398-I – Unregistered Operation; Procedures and Penalties The discount is gone for anyone already penalized once, and for anyone operating while suspended or revoked: those cases are a flat $1,000 with no reduction.
Property owners are on the hook too. If an unregistered shop operates at the same premises on two or more occasions within 18 months and the owner knowingly allowed it, the commissioner can fine the property owner up to $15,000, order the premises sealed for up to 180 days, or both.3New York State Senate. New York Vehicle and Traffic Law 398-I – Unregistered Operation; Procedures and Penalties If you’re leasing space, verify your tenant’s registration status before signing.
