How to Get Your Orange County Marriage Certificate

An Orange County marriage certificate is issued by the Orange County Clerk-Recorder Department after you apply for a marriage license, hold a ceremony within 90 days, and have the officiant return the signed license for recording. Certified copies then cost $19 each, and you can order them at offices in Santa Ana, Anaheim, or Laguna Hills, or by mail.

Step 1: Apply for the Marriage License

The certificate starts as a license. California requires both people to be at least 18, unmarried, and able to consent.1California Legislative Information. Public or Confidential License

Orange County issues two license types, and both carry equal legal weight.

  • Public license, $61. Your ceremony needs at least one witness, and up to two may sign. The completed license is filed with the County Recorder and becomes a public record, so anyone can order a copy.3Orange County Clerk Recorder Department. Marriage Services
  • Confidential license, $66. No witnesses are needed and none sign. The record is filed with the County Clerk, is not publicly accessible, and only the two spouses can order copies (with photo ID). Anyone else needs a court order. What You’ll Bring

Both people must appear together in person. Each needs a valid, unexpired, government-issued photo ID showing name and date of birth, such as a driver’s license or passport.3Orange County Clerk Recorder Department. Marriage Services Start the application in the Clerk-Recorder’s online portal before your appointment. You’ll enter full legal names, states or countries of birth, and parent information. If either of you was previously married or in a domestic partnership, be ready with the end date and the city and state where the dissolution or death occurred. The portal generates a confirmation number to bring with you.

Step 2: Book and Attend the In-Person Appointment

Appointments are booked through the Clerk-Recorder’s scheduling system at any of three offices:

You pay the license fee at the appointment: $61 public or $66 confidential. Cash, check, and credit card are accepted, and card payments may carry a small processing fee. If you plan to change your name, make that election when you sign the license. The license is valid for 90 days from issuance. Miss that window and the license expires; you’d have to apply and pay again.2California Department of Public Health. California Marriage License General Information

Step 3: Hold the Ceremony

California allows a wide range of officiants: licensed or ordained clergy of any religious denomination; active or retired judges, court commissioners, and magistrates; members of the state legislature; members of Congress representing California; and current or former elected local officials. Every county clerk also serves as a commissioner of civil marriages and can appoint deputy commissioners.7California Legislative Information. California Code FAM 400-402

If you don’t have your own officiant, the Orange County Clerk-Recorder performs civil ceremonies for $28. The service is only for couples who obtained their license from the Orange County office. Ceremonies take place at the North County Branch in Anaheim, the South County Branch in Laguna Hills, or the Old County Courthouse in Santa Ana.8Orange County Clerk Recorder Department. Step 4: The Officiant Returns the License

The officiant completes the solemnization section and returns the original license to the county recorder within 10 days of the ceremony.9California Legislative Information. California Code Family Code 423 – Return of Marriage License The legal duty falls on the officiant, not on you, but follow up anyway. An unfiled license creates real problems later when you need a certified copy for a name change or legal proceeding. Once the Clerk-Recorder records the returned license, your marriage becomes a permanent county record and certified copies are available to order.

Step 5: Order Certified Copies

A certified copy of your Orange County marriage certificate costs $19.10Orange County Clerk Recorder Department. Fee Schedule Order more than one. Different agencies each want an original: the Social Security Administration, the DMV, your employer’s HR department, your bank, and your insurance company.

You can request copies in person at any of the three branch offices. Mail requests are typically processed within 5 to 10 business days from when the office receives the request, not counting weekends, holidays, or delivery time.6Orange County Clerk-Recorder Department. Using the Certificate Abroad: Apostille

If another country that is part of the Hague Convention needs to recognize your marriage certificate, you’ll need an apostille from the California Secretary of State. The fee is $20 per apostille. Requests can go by mail to the Sacramento office or in person to Sacramento or Los Angeles. In-person requests carry an added $6 special handling fee.11California Secretary of State. A mail request needs four things: the original certified marriage certificate (not a photocopy), a cover sheet identifying the country where the document will be used, a check or money order for $20 payable to the Secretary of State, and a self-addressed return envelope. What the Certificate Lets You Do Next

Change Your Name

The certificate is the starting document for every name-change update, but each agency has to be handled separately. Start with the Social Security Administration, because most other agencies want to see a card in your new name. You’ll file Form SS-5 with your certified marriage certificate and proof of identity such as a driver’s license or passport. The SSA accepts only originals or copies certified by the issuing agency, though it returns everything after processing.12Social Security Administration. For a passport, the form depends on your situation: DS-5504 for name changes and data corrections, DS-82 for standard renewals, and DS-11 for first-time applicants or anyone who can’t renew.13U.S. Department of State. Passport Forms A certified marriage certificate is required either way.

After Social Security and passport, update your California driver’s license at the DMV, your bank accounts, employer payroll records, and insurance policies. Each will ask for a certified marriage certificate.

Update Taxes and Health Insurance

Your marital status on December 31 controls your filing status for the whole tax year. A couple married any time during the year files as either married filing jointly or married filing separately for that full year, and the IRS notes that most couples pay less by filing jointly.14Internal Revenue Service. Marriage is also a qualifying life event for health insurance. You generally have 60 days from the wedding date to add a spouse to an employer plan or enroll through the marketplace.
