To gift a car to a family member in Virginia, sign the title over as a gift, have the recipient file Form SUT-3 at the DMV within 30 days, and pay the title and registration fees. The 4.15% motor vehicle sales and use tax is waived only if the recipient is your spouse, son, daughter, or parent. On a $30,000 car, that exemption saves the recipient $1,245, so it is worth doing correctly.
Which Family Members Qualify for the Tax Exemption
Virginia exempts a gifted vehicle from the 4.15% sales and use tax only when it goes to the donor’s spouse, son, daughter, or parent.1Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions That is the complete list. Siblings, grandparents, grandchildren, aunts, uncles, and cousins do not qualify, even though many families assume they do. Adopted children are generally treated the same as biological children under Virginia law, so a gift to an adopted son or daughter should qualify. Step-children who have not been legally adopted are not explicitly covered by the statute.
On the DMV’s exemption paperwork, code “F” covers a gift to a son, daughter, or parent with no lien assumed and no payment made, and a separate code covers spouse transfers.3Virginia DMV. SUT Exempt Transaction Guidelines
If the Car Still Has a Loan on It
A vehicle with an active lien cannot simply be signed over. The lienholder holds the title until the loan is paid, and any ownership change needs the lender’s written authorization.4Virginia Department of Motor Vehicles. Transfer of Certificate of Title With Lien The two realistic paths are paying off the balance before transfer, or having the recipient formally assume the remaining debt with the lender’s consent.
Assumed loan balances have a tax consequence. The gift exemption for a son, daughter, or parent does not apply to any unpaid obligation the recipient takes on.1Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions If your daughter takes over a $10,000 loan balance with the car, the 4.15% tax applies to that $10,000, and she owes $415 at titling. Spouse transfers are the exception: the exemption still applies even if the recipient assumes the loan.
Documents You Need for the Transfer
Gather everything before the DMV visit. Missing one item can push the transfer back.
- Certificate of Title. The donor completes the “Assignment of Title by Seller” section on the back, writes “Gift” in the sale price field and “$0” for the purchase price, and both parties sign. Do not use correction fluid or scratch out errors; the DMV can reject a marked-up title, and you will have to request a corrected one.
- Form SUT-3, the Purchaser’s Statement of Tax Exemption. The recipient files this to claim the sales tax waiver. It asks for the VIN, year, and make, and requires selecting the exemption code that matches the family relationship.5Virginia Department of Motor Vehicles. Form SUT-3
- Odometer disclosure. Federal law requires the donor to record current mileage on the title or on Virginia Form VSA-5 at transfer. - Proof of Virginia address for the recipient.
If the original title is lost, the donor has to order a replacement before the gift transfer can move forward. A replacement title costs $15 and is typically mailed within five business days.8Virginia Department of Motor Vehicles. Transaction – Title Replacement
Filing at the DMV, Deadline, and Fees
The recipient brings the signed title, Form SUT-3, odometer disclosure, and proof of address to any Virginia DMV customer service center. A title application drop-off service is available at participating locations, with processing in about five business days.9Virginia Department of Motor Vehicles. Even with the sales tax waived, expect these charges:

- Registration for 4,001 to 6,500 lbs: $35.75.
- Registration for 6,501 to 10,000 lbs: $44.75.

What the Donor Should Do After the Handoff
Signing the title is not the last step for the giver. Virginia requires the person who sold, traded, or donated a vehicle to notify the DMV, which can be done online.13Virginia Department of Motor Vehicles. Transaction – Report a Vehicle Sold or Traded That report creates a record showing you no longer own the car, which matters if the recipient is in a crash or gets a ticket before finishing the title transfer.
Call your auto insurer to remove the gifted vehicle from your policy. Keeping it on wastes premium and can create confusion if a claim is filed after the change of ownership.
Insurance, Inspection, and Personal Property Tax for the Recipient
The recipient must carry liability insurance meeting Virginia’s minimums before registering.14Virginia Department of Motor Vehicles. Register Your Vehicle As of January 1, 2025, the minimum limits are $50,000 bodily injury per person, $100,000 bodily injury per accident, and $25,000 property damage, up from the older $25,000/$50,000/$20,000 amounts.15Virginia Department of Motor Vehicles. Insurance Requirements Registering without insurance triggers a $600 noncompliance fee, suspension of license and registration, and a $145 reinstatement fee.
Every vehicle registered in Virginia has to pass a safety inspection at an authorized station.16Virginia Code Commission. Virginia Code 46.2-1157 – Inspection of Motor Vehicles Required If the current sticker is valid, the recipient can wait for it to expire. If it has lapsed, get it inspected before driving on public roads.
Once the car is titled in the recipient’s name, they take on the annual local personal property tax on it. The rate varies by county or city and is assessed on the vehicle’s value by the local commissioner of the revenue. Qualifying vehicles used for personal purposes receive partial state relief on the first $20,000 of assessed value.17Virginia Code Commission. Federal Gift Tax Filing
If the vehicle’s fair market value is more than $19,000, the donor may need to file IRS Form 709 (United States Gift Tax Return) for that year. The $19,000 figure is the annual gift tax exclusion for 2026 — the amount one person can give another in a single year without a filing requirement.18Internal Revenue Service. Filing Form 709 does not mean you owe tax. The return tracks lifetime gifts above the annual exclusion against your lifetime exemption, which is over $13 million for 2026. Most people never owe actual gift tax, but failing to file when required can bring IRS penalties.19Internal Revenue Service. Instructions for Form 709 Married couples who elect to split gifts can combine their exclusions, allowing up to $38,000 in vehicle value before a return is needed, though both spouses have to file Form 709 to make that election.
