How to Legally Change Your Name in Iowa After Marriage

To change your name in Iowa after marriage, write the new name you want on your marriage license application before the ceremony, then use the certified marriage certificate as your legal proof to update records with the Social Security Administration, the Iowa DOT, the State Department, and every other institution that has you on file. Iowa Code Section 595.5 treats the name recorded on the marriage license as the legal name of each spouse once the marriage is official, so no separate court order is required.1Iowa Legislature. Iowa Code 595.5 – Name Change Adopted Done in the right order, the full update takes a few weeks.

Pick the Name You Want on the License

Iowa gives both spouses real flexibility. You are not limited to taking your partner’s surname. The Social Security Administration recognizes several combinations under Iowa law: either spouse may adopt the other’s surname, both spouses may hyphenate or combine their surnames into a double surname, and there is no prohibition against adopting an entirely new surname through the marriage license.2Social Security Administration. One boundary to know up front: this covers surnames tied to the marriage. If you also want to change your first name, that requires Iowa’s separate court-ordered name-change process.

Order Certified Copies of the Marriage Certificate

Before you can update anything, you need at least one certified copy of your marriage certificate from the county recorder where the license was issued. This is not the decorative certificate signed at the ceremony. A certified copy carries a raised seal or stamp from the issuing authority and includes filing numbers that government agencies require for verification.3Department of Transportation. Most Iowa counties charge $15 per certified copy.4Jones County, Iowa. The license application itself typically costs $35, and most counties include one certified copy in that fee.

Update Social Security First

Start with the Social Security Administration. Every other agency verifies your name against federal records, so if SSA has not caught up, those updates will fail.

REAL ID Considerations

If your current license has the REAL ID gold star and you want to keep it, REAL ID rules require documentation linking the name on your birth certificate to your current legal name. Your certified marriage certificate bridges that gap. If you already hold an Iowa license and Social Security card in your current legal name, the DOT can verify the connection electronically without extra paperwork.3Department of Transportation. Update Your U.S. Passport

A passport name change goes through the Department of State. Which form you use, and how much you pay, depends on timing.

  • Within one year of both passport issuance and the name change: use Form DS-5504 and mail it with your current passport, certified marriage certificate, and a new passport photo. No application fee, though you can add $60 for expedited processing.12U.S. Department of State. Name Change for U.S. Passport or Correct a Printing or Data Error
  • More than one year since either issuance or the name change: you will generally renew by mail using Form DS-82. The fee is $130 for a passport book or $30 for a card only. Include a certified copy of your marriage certificate to document the change.13U.S. Department of State. Renew Your Passport by Mail

If you recently renewed your passport and then got married, filing DS-5504 within that first year saves you the full $130 renewal fee. After one year, there is no free option.

File Taxes Without a Name Mismatch

A name mismatch between your tax return and SSA records is one of the most common causes of refund delays for newly married filers. The IRS cross-checks the name and Social Security number on your return against the SSA database, so the name on your return has to match whatever the SSA has on file when you file.14Internal Revenue Service. Name Changes and Social Security Number Matching Issues

If you marry late in the year and have not updated your Social Security record before filing season, use your former name on the return. Filing under your married name before SSA is updated will trigger a mismatch and delay your refund. Once SSA has your new name, you can also notify the IRS directly by filing Form 8822, which updates your name for individual tax matters.15Internal Revenue Service. Update Everything Else

With Social Security, driver’s license, and passport done, the hardest part is behind you. What remains is a longer but easier list.

Employer and Payroll

Notify your employer as soon as your Social Security card arrives so payroll records and your W-2 reflect the correct legal name for tax purposes. Your employer may also ask you to complete a new W-4 if you are adjusting withholding after marriage.

Banks and Financial Accounts

Most banks require an in-person visit with your updated driver’s license and certified marriage certificate to change account titles, debit cards, and credit cards. Update brokerage accounts, retirement accounts, and any accounts where you are listed as a beneficiary at the same time.

Insurance

Health, auto, and life insurance providers all need your updated name. Mismatched records cause problems during claims, especially health insurance claims where the name on your ID does not match your policy.

Voter Registration

Iowa lets you update your voter registration online through the DOT’s voter registration portal, by mailing a new registration form to your county auditor, or in person. If an election is approaching, online and mail updates must be submitted at least 15 days before Election Day. In-person registration is available through Election Day itself.

Professional Licenses

If you hold a professional license in Iowa, check your board’s notification requirements, because timelines vary by profession. Insurance producers, for example, must notify the Iowa Insurance Division within 30 days of the name change and provide a copy of the legal document proving it.16Legal Information Institute (LII) / Cornell Law School.
