How to Legally Change Your Name in Tennessee After Marriage

To change your name in Tennessee after marriage, you use your registered marriage certificate as the legal document that authorizes a surname change, then update your records in a specific order: Social Security first, Tennessee driver license second (within 10 days), and every other account after that. No court order, no filing fee, no judge involved — the marriage certificate does the work of a name-change decree, but only for your last name.

The order matters because each agency checks against the one before it. If your driver license visit happens before Social Security has processed the change, the state system won’t verify and you’ll leave without a new license.

What the Marriage Certificate Can and Can’t Do

A registered marriage certificate lets you adopt your spouse’s surname or hyphenate both surnames. Every agency in the chain accepts it as sufficient proof.

It does not authorize a first-name change, and it does not let you move your maiden name into the middle-name slot or drop a middle name. Any change beyond the surname requires a formal court petition, which is a separate process with its own filing fee.

Getting a Certified Marriage Certificate

The document you need is the registered certificate issued after the ceremony, not the marriage license that authorized the wedding and not a decorative commemorative certificate. The registered version carries an official seal and shows both spouses’ full legal names along with the date of marriage. Without those elements, the Social Security Administration and the Tennessee Department of Safety will reject it.

Request certified copies from the county clerk’s office in the county that issued the license. Fees vary by county but are generally modest. Order at least two copies. You’ll be handing originals to multiple agencies, and while they mail them back, a spare keeps you moving if one gets held up.

Update Social Security First

Social Security comes first because every other agency verifies your name against Social Security records. Fill out Form SS-5, available at ssa.gov or any local Social Security office, and submit it with your certified marriage certificate and a proof of identity such as a valid U.S. passport or state-issued driver license.

Update Your Tennessee Driver License Within 10 Days

Tennessee Code § 55-50-333 requires you to notify the Department of Safety within 10 days of a name change.² Many people assume the window is 30 days. It isn’t. Because you need Social Security to process the change first, start that step immediately after the wedding to keep the driver license visit inside the 10-day window.

Once your Social Security record shows the new name, go to a Tennessee Driver Services Center in person. This cannot be done online or by mail; the center needs a new photograph and has to verify the Social Security update through the state system.³

Bring your current license and the original or certified copy of your registered marriage certificate. The pre-ceremony marriage license alone will not be accepted.³ A first-time duplicate license costs $8 total ($6 license fee plus a $2 application fee). If you have already replaced your license once during the current period, the cost rises to $12. County clerks offering driver services charge an additional $4 administrative fee.⁴

You leave with a temporary paper license valid while the permanent card is printed and mailed to your registered address.

Missing the deadline is technically a Class C misdemeanor with a potential fine of up to $50.⁵ Enforcement on late name changes is rare, but driving with a license that shows the wrong name creates problems at traffic stops and any moment your ID gets checked against state records.

REAL ID at the Same Visit

If your current license is not already REAL ID-compliant (marked with a gold star), the name-change visit is a natural time to upgrade. Federal REAL ID enforcement began in May 2025, so you need one for domestic flights and entry to federal buildings. Beyond the standard name-change documents, a REAL ID application requires proof of U.S. citizenship (birth certificate or valid passport), your Social Security number, and two proofs of Tennessee residency dated within the last four months, such as a utility bill, bank statement, or current pay stub.⁶

One detail matters if you have a name history: you must bring documentation for every name change linking your current name back to the name on your birth certificate. The renewal fee for an adult passport book is $130, or $30 for a card only. Expedited processing costs an additional $60 per application, and 1-2 day delivery adds $22.05.⁸

If you have travel booked under your old name, keep the old passport until the new one arrives. The name on your airline reservation must exactly match the name on the ID you present at the TSA checkpoint.⁹ Booking under the new name while carrying an old-name passport is a reliable way to get held up at security.

Voter Registration, Banks, Insurance, and Employer

Update your Tennessee voter registration through the state’s online portal or by submitting a paper application to your county election commission.¹⁰ No fee, no deadline, but doing it before the next election avoids trouble at the polls.

Banks and credit unions typically want to see your new driver license in person before they update account names, reissue debit cards, or print new checks. Bring the marriage certificate as well; some institutions require both. Notify your health, auto, and life insurance providers too. A name mismatch between your policy and your ID can slow down claims at exactly the moment speed matters.

Tell HR at work so payroll, your W-4, and benefits enrollment all reflect the new name. This isn’t cosmetic: if the name on your W-2 doesn’t match your Social Security record at year’s end, your tax refund can be delayed.

Tax Filing During the Transition

The IRS cross-references the name and Social Security number on every return against SSA records. If your return shows your married name but Social Security hasn’t been updated yet, expect processing delays and a slower refund.¹¹

The practical rule: file under whatever name the SSA currently has on record. If you married in December and haven’t finished the Social Security update by the time you file in January, file under your former name. Update Social Security, then file with the new name next year.¹¹

Professional Licenses and Other Credentials

If you hold a professional license issued by a Tennessee state board (nursing, real estate, counseling, education, and many others), you need to notify that board separately. Many require written notice within 30 days of a name change, along with a copy of the supporting document and your license number. Each board runs its own process, so check with yours directly.

Don’t forget non-state credentials: college transcripts, professional certifications, published work, and any place your name functions as a professional identifier. University registrar offices usually update alumni records with a copy of the marriage certificate. Handling these early prevents the slow accumulation of mismatched records that becomes hard to untangle years later.

When a Court Order Is Required Instead

The marriage certificate route only covers a surname change. If you want to change your first name, adopt a name unrelated to either spouse’s surname, or modify your middle name, you’ll need to file a formal name-change petition with a Tennessee court. The process involves filing the petition with proof of identity and residency, then appearing at a hearing, often scheduled within a week or two of filing.

Filing fees vary by county. In Shelby County, for example, the fee is $166.50 in person or $170 by video hearing. Once the judge signs the order, that decree replaces the marriage certificate as the document you carry through the same sequence: Social Security first, driver license within 10 days, then everything else.³
