Who Can Request a Copy
Illinois law restricts certified birth certificates to specific people. Under 410 ILCS 535/25, you can obtain a copy if you are:4Illinois General Assembly. 410 ILCS 535/25 – Vital Records Act
- The person named on the certificate, if of legal age.
- A parent or legal representative of the person named.
- Requesting with a genealogical interest, but only for births that occurred at least 75 years ago. These copies are stamped “FOR GENEALOGICAL PURPOSES ONLY.”
- Acting under a court order from a court of competent jurisdiction.
The statute uses “legal representative” rather than listing every possible relationship. In practice that covers attorneys acting for you, guardians with court documentation, and agents with a valid power of attorney. If you are requesting on someone else’s behalf, bring whatever paperwork establishes your authority.
What to Bring or Include
The application asks for details that help the clerk find the record:
- Full name at birth, including maiden name if applicable
- Date of birth
- Mother’s full maiden name
- Father’s full name
- Your relationship to the person named
The Health Department also asks for the hospital where the birth took place, which helps narrow the search when the name or date is common.2Winnebago County Health Department. To request a correction, complete the Affidavit and Certificate of Correction Request form from IDPH and submit it with a valid, unexpired government-issued photo ID. You also need supporting documents, and IDPH’s general guideline is that each should have been created before the person turned 19 and must show the name and date of birth exactly as you want them to appear.6Illinois Department of Public Health.
