To pass the Georgia Business and Law exam, you need 35 correct answers out of 50 questions within two hours, which is a 70 percent score. The test is open-book, computer-based, and administered by PSI after your contractor license application has been approved by the appropriate state board. Which version you take and which reference book you carry in depend on your trade.
Two Boards, Two Versions of the Exam
Georgia splits contractor licensing between two boards under the Secretary of State’s office, and that split determines your exam.
If you are applying as a residential-basic, residential-light commercial, or commercial general contractor, you fall under the State Licensing Board for Residential and General Contractors. Your exam, your approved reference book, and your application all come from that board, and the exam requirement applies unless you qualify for an exemption under O.C.G.A. § 43-41-8.1Justia. Electrical, plumbing, conditioned air, low voltage, and utility contractors fall under separate divisions within the Construction Industry Licensing Board.2Georgia Secretary of State. You cannot schedule the exam until your application is approved, so build in lead time.
What the Exam Covers
The 50 questions are split across nine content areas. The weighting is published in the PSI Candidate Information Bulletin, and it tells you where to spend your study hours.3PSI Services. State Licensing Board for Residential and General Contractors Candidate Information Bulletin

The Legal Topics People Lose Points On
Georgia Lien Deadlines
Lien questions are a reliable source of wrong answers because the deadlines are strict and sequential. A contractor or supplier filing a lien must record the claim with the clerk of the superior court in the county where the property sits within 90 days of finishing the work or furnishing the materials.4Justia. Georgia Code 44-14-361.1 – How Liens Declared and Created Within two business days after filing, a copy must go to the property owner by certified mail or statutory overnight delivery, or the lien is invalid.
From the filing date, you have 365 days to begin a court action to enforce the lien, and within 30 days of filing that lawsuit you must file a notice of the action with the clerk. Total liens on a project cannot exceed the original contract price. Memorize the sequence: 90 days to file, 2 business days to notify, 365 days to sue.
When Workers’ Comp Kicks In
Georgia requires workers’ compensation coverage if you regularly employ three or more people. Corporate officers and LLC members count toward that three even if some of them personally waive coverage. Sole proprietors and partners are treated as employers, not employees, but they can opt in by notifying the carrier in writing.5State Board of Workers’ Compensation. Workers’ Compensation Insurance FAQs Regular part-time and seasonal workers count too, which is how a small framing crew with weekend help crosses the threshold without realizing it.
Employee vs. Independent Contractor
Expect questions on classification. Under federal law, the analysis is the economic reality of the relationship: whether the worker is economically dependent on you or genuinely in business for themselves. Relevant factors include the worker’s opportunity for profit or loss, the permanence of the arrangement, and how much control you have over how the work is done.6U.S. Department of Labor. Employment Relationship Under the Fair Labor Standards Act (FLSA) Writing “1099 contractor” into an agreement does not make someone one if the facts say otherwise.
OSHA Lead Standard
On the safety side, know OSHA’s construction lead rule. The permissible exposure limit is 50 micrograms of lead per cubic meter of air averaged over eight hours, with an action level of 30 micrograms.7Occupational Safety and Health Administration. 1926.62 – Lead Higher-risk tasks like manual demolition, heat gun work, and abrasive blasting require interim protective measures before you finish a formal exposure assessment. You will not be asked to calculate exposure, but you need to know which tasks trigger which protections.
Reference Books and How to Prepare Them
Open-book sounds generous until the clock starts and you are flipping through an unfamiliar index. The real preparation is knowing where things live in your book before test day.

The IRS Employer’s Tax Guide (Publication 15, Circular E) is also approved for tax questions.10Georgia Secretary of State. Utility Managers Suggested Exam Reference List Confirm your division’s exact approved list on the Secretary of State’s website before you buy anything.
You can highlight, underline, and add permanent tabs. You cannot bring photocopies, loose inserts, or handwritten notes pasted into the book. Proctors inspect materials before the session, and anything that violates the rules gets confiscated. In some cases, a violation can get you removed from the exam.11Georgia Secretary of State. Electrical Contractors Suggested Reference List Only references on your division’s approved list are allowed in the room.
Tab the sections tied to the heaviest content areas: estimating formulas, business organization comparisons, the lien statute, the OSHA safety sections, and the IRS tax tables. Practice finding a specific rule by tab in under 20 seconds. That is the drill that saves time on test day.
Application and Scheduling
Your application has to clear the board before PSI will let you register. For the State Licensing Board for Residential and General Contractors, the application fee is $200 plus a $10 processing fee, and it is nonrefundable.12Georgia Secretary of State. Test Day
Arrive at least 30 minutes early. Late candidates can be turned away and forfeit the fee. You need two forms of ID: one government-issued photo ID with your signature (driver’s license, state ID, or passport), and a second ID that shows your signature and preprinted legal name. The names on both have to match your registration.3PSI Services. Phones and bags go in a locker. Questions appear one at a time on the computer, and you have 120 minutes for all 50. The system shows your score as soon as you finish. If you pass, that score report goes to the board to move the license forward.
If You Fail
Your first approval gives you two attempts to pass the Business and Law exam within a one-year eligibility window. Fail twice and you have to wait at least a year from the date of your second attempt before trying again, and the next approval gives you only one attempt.3PSI Services. State Licensing Board for Residential and General Contractors Candidate Information Bulletin If you passed one of the two required exams (trade or Business and Law) and failed the other, you only retake the one you failed. Both have to be passed inside the same one-year window.
When You Don’t Have to Take It
Georgia waives the exam in two situations under O.C.G.A. § 43-41-8. First, if you hold a current, valid contractor license from a state with a reciprocal agreement with Georgia, and that state’s licensing standards (including its exam) were substantially equivalent to Georgia’s, you can apply without sitting for the Georgia test.13Justia. Georgia Code 43-41-8 – Eligibility for Licensure Without Examination Second, if you already hold a current Georgia license in a comparable category, as an individual licensee or as a qualifying agent, you can get licensed in the new capacity without retaking the exam.
The burden is on you to prove you qualify, and the board has discretion over whether your documentation is enough. Bring complete records of your out-of-state license, exam history, and work experience.
