To qualify for disability in Nebraska, you must meet the Social Security Administration’s strict medical definition of disability and then satisfy the non-medical rules for one of two federal programs: Social Security Disability Insurance (SSDI), which requires a recent work history, or Supplemental Security Income (SSI), which is based on limited income and resources. The medical standard is identical for both. Your claim is filed through Social Security and reviewed for the medical decision by Nebraska Disability Determination Services, and the full process typically takes three to six months.
The Medical Standard You Have to Meet
Social Security uses a narrow definition. You must be unable to perform any substantial work because of a physical or mental condition expected to last at least 12 continuous months or result in death.1Office of the Law Revision Counsel. 42 USC 423 – Disability Insurance Benefit Payments Temporary injuries do not qualify, no matter how severe. Partial disability is not recognized either. If you can perform any job that exists in the national economy, even one that pays less than your previous work, SSA will find you ineligible.2Social Security Administration. Disability Benefits – How Does Someone Become Eligible?
SSA maintains a manual called the Listing of Impairments, often called the Blue Book, that organizes qualifying conditions by body system and spells out the clinical findings required for each.3Social Security Administration. Part III – Listing of Impairments (Overview) If your condition matches a listing, you are approved automatically. If it doesn’t, SSA can still find you disabled by deciding your impairment equals a listing in severity, or by evaluating how your limitations affect your ability to work.
Certain severe diagnoses move faster through a program called Compassionate Allowances. The list includes some aggressive cancers, early-onset Alzheimer’s, and rare childhood conditions.4Social Security Administration. Compassionate Allowances You do not need to request special treatment; the system flags qualifying diagnoses on its own.
The Earnings Cap That Disqualifies You Upfront
Regardless of which program you apply for, earning too much work income disqualifies you before SSA ever looks at your medical records. In 2026, the monthly cap for substantial gainful activity (SGA) is $1,690 for non-blind applicants and $2,830 for applicants who are statutorily blind.5Social Security Administration. Substantial Gainful Activity If you are currently earning more than that, SSA denies the claim at the first step of its evaluation.
SSDI: Do You Have Enough Work History?
SSDI is an earned benefit funded by Social Security payroll taxes. You qualify by accumulating work credits. In 2026, you earn one credit for every $1,890 in wages, up to four credits per year.6Social Security Administration. Benefits Planner – Social Security Credits and Benefit Eligibility
How many credits you need depends on how old you were when your disability began:7Social Security Administration. How You Earn Credits
- Before age 24: six credits (about 18 months of work) earned in the three years before your disability started.
- Ages 24 through 30: credits for roughly half the time between age 21 and the onset of disability.
- Age 31 and older: at least 20 credits in the last 10 years, with the total rising with age (for example, 28 credits at 50, 40 credits at 62 or older).
If you have not worked recently enough or long enough, SSDI will deny your claim on technical grounds no matter how severe your medical condition is. SSI is the alternative in that situation.
One more thing to plan for: even after SSA finds you disabled, SSDI payments do not start immediately. Federal law requires a five-month waiting period from the date your disability began, so the first check arrives in the sixth full month.8Office of the Law Revision Counsel. 42 USC 423 – Disability Insurance Benefit Payments Because most claims take months to decide, applicants are often past the waiting period by the time they are approved and receive back pay for those months.
SSI: Do Your Income and Resources Qualify?
SSI requires no work history. It is a needs-based program for people with very limited income and resources who also meet the same medical standard as SSDI applicants.9Office of the Law Revision Counsel. 42 USC 1382 – Eligibility for Benefits
Your countable resources cannot exceed $2,000 for an individual or $3,000 for a couple.10Social Security Administration. 2026 Cost-of-Living Adjustment (COLA) Fact Sheet Resources include bank accounts, cash, stocks, and most property. Your primary home and one vehicle used for transportation generally do not count. SSA also looks at income from wages, pensions, and non-cash support like free housing.
The maximum federal SSI payment in 2026 is $994 per month for an individual and $1,491 for a couple.11Social Security Administration. SSI Federal Payment Amounts Nebraska runs its own state supplement on top of the federal payment, but the state handles those payments directly rather than through SSA.12Social Security Administration. Understanding Supplemental Security Income SSI Benefits Contact the Nebraska Department of Health and Human Services for the current supplement amount.
How SSA Decides Your Case Medically
Every claim moves through a five-step sequence. SSA stops as soon as it can reach a decision.13Code of Federal Regulations. 20 CFR 404.1520 – Evaluation of Disability in General
- Step 1: Are you currently earning above the SGA limit? If yes, denied.
- Step 2: Is your condition “severe,” meaning it significantly limits basic work activities like standing, lifting, or concentrating? Minor conditions get screened out here.
- Step 3: Does your impairment meet or equal a Blue Book listing and last at least 12 months? If yes, approved.
- Step 4: Can you still perform any job you held during the past 15 years? If yes, denied.
- Step 5: Given your limitations, age, education, and work experience, is there other work in the national economy you can do? If yes, denied. If no, approved.
Steps 4 and 5 turn on something called your residual functional capacity (RFC): the most you can still do despite your impairments. SSA rates your physical abilities on a scale from sedentary to heavy work, considering how long you can sit, stand, walk, lift, and carry on a sustained basis.14Code of Federal Regulations. 20 CFR 404.1545 – Your Residual Functional Capacity Mental limitations such as difficulty concentrating, following instructions, or interacting with coworkers are rated separately and factored in.
Age matters at step 5. SSA uses three brackets: younger individuals (18–49), those closely approaching advanced age (50–54), and those at advanced age (55 and older).15Code of Federal Regulations. Appendix 2 to Subpart P of Part 404 – Medical-Vocational Guidelines Older applicants with limited education and a history of physically demanding work have an easier path at step 5, because SSA acknowledges that adapting to new types of work gets harder with age.
How to File Your Application in Nebraska
You have three ways to file:
- Online at ssa.gov. The fastest option, with no appointment required, and you can start and stop as you go.16Social Security Administration. Apply Online for Disability Benefits
- By phone at 1-800-772-1213 (TTY 1-800-325-0778), 7 a.m. to 7 p.m. Monday through Friday.
- In person at a Social Security field office in Omaha, Lincoln, Grand Island, or another Nebraska location. Call ahead to schedule.
Pulling your records together before you file saves weeks of back-and-forth. The two main forms are the Adult Disability Report (SSA-3368), covering your medical condition and its effect on your ability to work, and the Work History Report (SSA-3369), detailing your past jobs.17Social Security Administration. Work History Report – Form SSA-3369-BK For the medical side, gather:
- Names, addresses, and phone numbers of every doctor, clinic, hospital, and therapist who has treated you
- Approximate dates of treatment for each provider
- Lab results, imaging reports, and any formal diagnoses
- A list of current medications, dosages, and prescribing doctors
You also need detailed descriptions of every job you held in the five years before you stopped working, including the physical and mental demands: how much lifting, standing, and walking the job required. That information feeds directly into the RFC assessment at steps 4 and 5. SSI applicants additionally need recent bank statements, pay stubs, and documentation of any property or investments. Both programs require proof of identity and citizenship, such as a birth certificate. After you submit, you will get a confirmation number. Keep it; you will need it to check your status.
What Nebraska DDS Does With Your File
Once a Social Security field office confirms you meet the non-medical requirements, your file moves to Nebraska Disability Determination Services, which operates under the Nebraska Department of Education.18Nebraska Department of Education. Disability Determination Services (DDS) Home This is where the medical decision happens.
DDS assigns a disability examiner and a medical consultant to review your clinical records. They first request evidence from your own treating providers.19Social Security Administration. Disability Determination Process If those records leave gaps, DDS will schedule a consultative examination with an independent physician at no cost to you. The initial decision typically arrives within three to six months, and you will receive a letter explaining the outcome and the reasoning.
If you are applying for SSI with certain clearly severe conditions, you may receive temporary payments right away while DDS finishes its review. This is called a presumptive disability determination. Qualifying conditions include amputation of a leg at the hip, total deafness, total blindness, Down syndrome, ALS, end-stage renal disease requiring dialysis, bed confinement due to a longstanding condition, and terminal illness with a life expectancy of six months or less, among others.20Social Security Administration. Understanding Supplemental Security Income Expedited Payments You do not have to repay these presumptive payments if you are ultimately approved.
If You Are Denied: The 60-Day Clock
Initial denial rates are high. A denial is not the end of your claim, but you have 60 days from receiving the decision to request the next level of review.21Social Security Administration. Request Reconsideration Missing that deadline can force you to start over with a new application.
The first appeal level is reconsideration, where a different examiner at Nebraska DDS reviews your file from scratch. You can submit additional medical evidence. Reconsideration denial rates are also high, but it is a required step before you can ask for a hearing.
The hearing before an Administrative Law Judge (ALJ) is where many denials are overturned, because it is the first time a decision-maker sees you in person and hears your testimony under oath.22Social Security Administration. SSA’s Hearing Process The ALJ may call a medical expert to discuss your condition and a vocational expert to testify about jobs someone with your limitations could perform. You have the right to bring witnesses, and your representative can cross-examine any expert. Written evidence must be submitted at least five business days before the hearing, and SSA must give you at least 75 days’ notice of the date.
If the ALJ denies you, you can ask the Appeals Council to review the decision for legal errors, abuse of discretion, or lack of substantial evidence.23eCFR. Appeals Council Review If that fails, the final option is filing a civil lawsuit in federal district court.24Social Security Administration. Federal Court Review Process
Getting Help With Your Claim
You can hire an attorney or non-attorney representative at any stage, though most applicants bring one on at the ALJ hearing. Disability representatives typically work on contingency, so they only get paid if you win. Federal law caps the fee at 25% of your back pay or $9,200, whichever is less, for cases decided at or before the hearing level.25Federal Register. Maximum Dollar Limit in the Fee Agreement Process – Partial Rescission SSA withholds the fee from your back pay and pays the representative directly, so you never write a check. Cases that go beyond the hearing to the Appeals Council or federal court can involve higher fees through a separate petition process.
