How to Qualify for Farm Tax Exemption in NY: Forms and Deadlines

To qualify for a farm tax exemption in NY, your operation generally needs at least seven acres in agricultural production for the past two years with average annual gross sales of $10,000 or more, and you file Form RP-305 with your local assessor by the taxable status date (March 1 in most towns). That’s the headline program, called the agricultural assessment, which values farmland by soil productivity instead of market price. Separate exemptions cover sales tax on farm purchases, property tax on new farm buildings, and several federal credits. Each has its own form and deadline, and missing any one of them costs a full tax year of savings.

Who Qualifies for the Agricultural Assessment

The agricultural assessment program lives under Article 25-AA of the Agriculture and Markets Law, not the Real Property Tax Law. The basic eligibility test is sometimes called the 7-7-10 rule: at least seven acres, used for agricultural production during the preceding two years, with average annual gross sales of $10,000 or more over that two-year window.1New York State Senate. Smaller operations face a higher financial bar. Rented farmland can qualify too. If a rented parcel independently meets the acreage and sales requirements, it’s eligible on its own. If it falls short on sales but meets the other criteria, it can still qualify when farmed under a written lease of at least five years alongside land that is already eligible.2New York State Department of Agriculture and Markets. Inside vs. Outside an Agricultural District

There are two paths into the program. Most applicants own land inside a state-certified agricultural district, which counties create to cover large tracts of actively farmed land. Forms to File and When

New applicants start with Form RP-305, which asks for total acreage, how many acres serve each agricultural purpose, and gross sales figures proving you meet the threshold. Before your first application, your county Soil and Water Conservation District office prepares a soil group worksheet (Form APD-1) for each parcel.4Department of Taxation and Finance. Only the agricultural portions get the reduced assessment. Once a current worksheet is on file, you generally don’t need a new one unless boundaries change.

Depending on your situation, you may also need one of these supplemental forms:

  • Form RP-305-b, if your gross sales fell short because of a natural disaster or prolonged adverse weather and you’re applying for an exception.
  • Form RP-305-c, for rented land that doesn’t independently meet the sales threshold but is farmed under a five-year written lease alongside eligible land.
  • Form RP-305-e, for new orchards and vineyards not yet in full production.

Filing is annual. Even after initial approval, you file either RP-305 or the renewal RP-305-r every year for every enrolled parcel. Miss the deadline once and you lose the reduced assessment for that tax year.

What Happens if You Convert the Land

Converting land that receives an agricultural assessment to a non-agricultural use triggers roll-back taxes equal to the taxes saved over the prior five years, plus interest.8Department of Taxation and Finance. On high-value land near suburban growth corridors, the bill can be large, so run the numbers before selling for development or retiring acreage from production.

Sales Tax Exemption on Farm Purchases

Separate from the property tax programs, New York exempts many farm purchases from sales tax. You claim it by presenting Form ST-125, the Farmer’s Exemption Certificate, to vendors at the time of purchase.9Tax.NY.gov. Farmer’s and Commercial Horse Boarding Operator’s Exemption Certificate ST-125 The exemption covers tangible personal property used predominantly in farm production: equipment, building materials, feed, seed, fencing, and materials used to build, repair, or maintain structures that are themselves used predominantly in production.

Predominantly means more than 50% of the item’s use, measured by hours, miles, or another reasonable metric.9Tax.NY.gov. Reverse those percentages and it doesn’t. Auditors do check usage logs on dual-use vehicles and equipment.

The exemption applies to the item, not to services. Veterinary care, equipment repair labor, and similar services are generally taxable even when performed for a farm. Once you have an ongoing relationship with a supplier, keeping a current ST-125 on file eliminates the need to present it at every transaction.

Property Tax Exemption for New Farm Buildings

Ten-Year Exemption Under RPTL Section 483

When you build or reconstruct a structure essential to farming operations, the added assessed value from that construction is exempt from property tax for ten years under Real Property Tax Law Section 483.10New York State Senate. Covered structures include barns, greenhouses, and storage buildings used in production.

To qualify, the land must be at least five acres and actively used in bona fide agricultural or horticultural production carried on for profit. File Form RP-483 with your local assessor on or before the taxable status date and within one year of completing construction.10New York State Senate. The owner’s personal dwelling doesn’t qualify, but housing for regular employees primarily employed in farming operations does.

Permanent Exemption Under RPTL Section 483-a

Certain specialized structures get a permanent exemption instead of a ten-year one. Section 483-a covers silos and forage storage structures, feed grain storage bins, commodity sheds, bulk milk tanks and coolers, and manure storage and handling facilities.11New York State Senate. If you’re building a new silo or manure lagoon, file under 483-a rather than 483.

Federal Benefits That Stack On Top

New York’s programs handle property and sales taxes. Several federal benefits sit alongside them and are claimed on your federal return.

Section 179 for Equipment

Instead of depreciating equipment over several years, Section 179 lets you deduct the full purchase price in the year you place it in service. For the 2026 tax year, the maximum deduction is $1,160,000, phasing out when total equipment purchases exceed $2,890,000. A separate $32,000 cap applies to certain utility vehicles. Farm equipment, vehicles, and some building improvements all qualify.

Federal Fuel Tax Credit

Gasoline and undyed diesel used on a farm for farming purposes qualify for a federal excise tax credit claimed on Form 4136. Based on the most recently published rates, the credit is $0.183 per gallon for gasoline and $0.243 per gallon for undyed diesel.12Internal Revenue Service. Estate Tax and Special Use Valuation

Passing a farm to the next generation raises federal estate tax concerns on larger operations. The basic federal estate tax exclusion for 2026 is $15,000,000 per individual, following the increase enacted by the One, Big, Beautiful Bill signed in July 2025.13Internal Revenue Service. For estates that exceed the exclusion, Section 2032A lets the executor value qualifying farm real estate at its agricultural use value rather than fair market value. The maximum reduction for 2026 is $1,460,000.
