To register for sales tax in New York, apply for a Certificate of Authority through the New York Business Express portal using Form DTF-17, at least 20 days before you make your first taxable sale. There is no application fee. Who Has to Register
New York’s definition of a “vendor” is wide. If you sell tangible personal property or taxable services in the state, you need a Certificate of Authority, whether you run a storefront, sell from home, work a seasonal farmers market booth, or make a single taxable sale a year.2Department of Taxation and Finance. Any physical footprint in New York (an office, warehouse, employees, or inventory stored in the state) creates nexus, so you must register regardless of your sales volume. Out-of-state sellers with no physical presence still have to register once, over the preceding four sales tax quarters, they had more than $500,000 in gross receipts from sales delivered into New York and made more than 100 such sales. If You Only Sell Through a Marketplace
Platforms like Amazon and Etsy are treated as “marketplace providers” and are generally responsible for collecting and remitting New York sales tax on the tangible personal property sales they facilitate.5Department of Taxation and Finance. If you also sell outside the marketplace (your own website, craft fairs, in person), those sales still require your own Certificate of Authority. Even marketplace-only sellers often register anyway so they can use resale certificates when buying inventory.
What to Gather Before You Apply
The application is Form DTF-17, Application for a Certificate of Authority. Pull everything together before you start, because the online system will time out if you stop to hunt for a document. You will need:
- Your Federal Employer Identification Number, or Social Security Number if you are a sole proprietor without an FEIN.
- Your legal business name exactly as filed with the New York Department of State.
- A six-digit NAICS code classifying your business, which you can look up at census.gov/naics.6U.S. Census Bureau. North American Industry Classification System – NAICS
- Full legal names, home addresses, Social Security Numbers, and contact information for every owner, partner, and officer.
- The physical address where you actually operate, not just a mailing address.
- A reasonable projection of your monthly sales. The department uses this figure to assign your filing frequency, so accuracy matters more than optimism.
Buying an existing business adds one more step. File Form AU-196.10, Notification of Sale, Transfer, or Assignment in Bulk, by registered mail at least 10 days before you take possession of or pay for the assets, whichever comes first.7Department of Taxation and Finance. How to Submit the Application
Use the New York Business Express portal at nybusiness.ny.gov. Create a secure account, go to the sales tax registration section, and enter the information from Form DTF-17. The portal also flags whether your business needs additional licenses or permits, which is a useful bonus. If you run multiple locations under one business, you can register all of them in a single session.8Department of Taxation and Finance. A paper Form DTF-17 mailed to the Department of Taxation and Finance is the other option, but electronic filers typically receive their certificate within a few business days while paper applications can take several weeks.
Either way, the application has to be filed at least 20 days before you begin making taxable sales.1Department of Taxation and Finance. After Your Certificate Arrives
When the certificate comes back, post it prominently at your place of business where customers and inspectors can see it. Each location gets its own certificate with its own identification number.9New York State Senate. The certificate stays valid as long as you continue operating and filing your required returns.
Filing Frequency and New York’s Non-Calendar Quarters
The department will assign you a filing frequency based on your expected sales volume: annual, quarterly, or part-quarterly (monthly). Quarterly filers follow New York’s own sales tax year, which does not line up with calendar quarters. The quarters run March through May, June through August, September through November, and December through February.10Department of Taxation and Finance. Buying Inventory Tax-Free with a Resale Certificate
Holding a Certificate of Authority lets you buy inventory without paying sales tax on it. Instead of paying tax at the register, you give your supplier a completed Form ST-120 (Resale Certificate), which they keep as proof they were not required to collect tax on the sale.12Department of Taxation and Finance. Exemption Certificates for Sales Tax The form must include the date, both parties’ names and addresses, your Certificate of Authority ID number, and your signature. You can provide it at purchase or within 90 days after.
Use resale certificates only for items you genuinely plan to resell. If you buy something tax-free with a resale certificate and then use it in your business or personally, you owe use tax on it, and misuse can bring civil and criminal penalties.
What Late or Skipped Filings Cost
The penalty structure is aggressive enough to plan around. Late filing or late payment starts at 10% of the tax due when you are less than a month late, then adds 1% for each additional month, up to 30%. If a return is more than 60 days overdue, the minimum penalty is the lesser of $100 or the full amount of tax owed. Registered vendors who fail to file face a minimum penalty of $50 regardless of the amount due.13New York State Senate. New York Tax Law 1145
Interest compounds on top of the penalty at 14.5% per year or the underpayment rate set by the commissioner, whichever is higher. If the state finds the failure was due to fraud, the penalty jumps to twice the full amount of tax owed, plus interest at the same rate.13New York State Senate.
