To remove a property lien in California, first identify what kind of lien it is and confirm it’s still legally enforceable, then choose the removal method that fits: ask the lienholder to release it, pay or settle the underlying debt, post a lien release bond, or file a court action. Once the lien is released, the release document has to be recorded with the county recorder before your title is actually clear.
Identify the Lien and Confirm It’s Still Enforceable
Start by pulling the recorded document from the county recorder’s office and reading it carefully. The type of lien decides everything that follows, because mechanic’s liens, judgment liens, state tax liens, and federal tax liens each have their own removal rules and their own expiration clocks.
A surprising number of liens are already unenforceable when the owner discovers them. Mechanic’s liens are especially fragile. A subcontractor or supplier who failed to serve a preliminary notice within 20 days of first providing labor or materials has no right to file a lien at all.1California Legislative Information. A written credit extension between owner and claimant can push the deadline out, but never past one year from project completion.
Judgment liens attach when a creditor records an abstract of judgment with the county recorder.4California Legislative Information. California Code CCP 697.310 – Judgment Lien on Real Property The judgment itself is enforceable for 10 years from the date it was entered.5California Legislative Information. California Code CCP 683.020 – Enforcement Period Creditors can renew before that clock runs out and reset it,6California Legislative Information. California Code CCP 683.110 – Renewal of Judgments so check the recorded documents for a renewal filing. If you’re near the 10-year mark and no renewal has been filed, waiting may be the cheapest route. If the judgment was entered against you without proper service or by a court that lacked jurisdiction, the judgment is void, and a void judgment supports no lien.
Federal tax liens run on a separate federal clock. Also check the recorded lien for accuracy: property description, dollar amount, names. Small errors don’t always kill a lien, but significant ones give you leverage.
Ask the Lienholder to Release It
If the lien has been paid, has expired, or was improperly filed, the cheapest move is a written request to the lienholder asking them to record a release. Attach whatever supports it: proof of payment, evidence a deadline was missed, or the procedural defect you found.
For mechanic’s liens where the 90-day enforcement window has closed, California requires a specific step before court: send the claimant a written demand to record a release, then wait 10 days.9California Legislative Information. California Code CIV 8482 – Demand for Release The demand letter is a prerequisite to a court petition, so don’t skip it.
For paid judgments, the creditor is required to immediately file an acknowledgment of satisfaction of judgment with the court.10California Legislative Information. California Code CCP 724.030 – Satisfaction of Judgment If they stall, send a formal demand. A creditor who ignores that demand without justification is liable for your actual damages plus a $100 statutory penalty and your attorney’s fees.11Justia. Pay or Settle the Underlying Debt
For most liens, resolving the debt is the direct route. Full payment isn’t always required; creditors sometimes accept less, particularly when collection looks doubtful or the owner can document hardship. Put any settlement in writing and require the creditor to record a lien release as part of the deal.
Judgment Liens
Pay the judgment and the creditor must file the acknowledgment of satisfaction.10California Legislative Information. California Code CCP 724.030 – Satisfaction of Judgment If they don’t, petition the court for an order declaring the judgment satisfied. Child support liens through the California Department of Child Support Services are released once the arrears are paid in full.
State Tax Liens
The Franchise Tax Board offers installment agreements. If your total liability is $25,000 or less and you haven’t defaulted on a prior plan, the FTB is generally required to accept an installment agreement that pays the full balance within five years.12California Legislative Information. Federal Tax Liens
The IRS accepts full payment, installment agreements, and offers in compromise. Once the tax liability is fully satisfied, the IRS must release the lien within 30 days.13Internal Revenue Service. Two IRS programs help when you need to sell or refinance before the tax debt is paid off. A certificate of discharge lifts the lien from a specific property while the tax debt remains; apply on Form 14135 at least 45 days before closing.15Internal Revenue Service. Post a Lien Release Bond
When a mechanic’s lien is blocking a sale or refinance and you can’t wait for litigation, a lien release bond is the fastest way out. You record a surety bond that substitutes for the property as the claimant’s security, and the property is immediately released from the lien.17Justia. California Code CIV 8424 – Lien Release Bond
The bond must equal 125 percent of the lien amount and be issued by a licensed surety company. The property owner, direct contractor, or subcontractor can be the principal. After recording, notify the claimant, who then has six months to sue on the bond rather than foreclose on the property. You pay a surety premium, but the title clears immediately.
Go to Court to Remove a Disputed Lien
When the lienholder won’t cooperate and the debt isn’t going to be paid, court is the remaining path. Which mechanism you use depends on the lien and the reason for challenge.
Petition to Release a Mechanic’s Lien
If the claimant missed the 90-day enforcement deadline, petition the court under Civil Code Section 8480 for a release order.18California Legislative Information. California Code CIV 8482 – Demand for Release The petition must be verified and must allege specific facts, including that the enforcement deadline has expired and the claimant is unable or unwilling to record a release.19California Legislative Information. At the hearing the claimant carries the burden of proving the lien is valid. The winner recovers reasonable attorney’s fees from the loser.20California Legislative Information. California Code CIV 8488 – Release Order Hearing Fee-shifting cuts both ways, so file only with a solid procedural argument.
Quiet Title Action
A quiet title lawsuit asks a judge to determine who holds valid interests in the property and to strike invalid ones. It works for any type of lien and is the usual choice when the fight is over disputed facts rather than a plain missed deadline.21California Legislative Information. California Code CCP 760.010 – Quiet Title It costs more and takes longer than a petition for release.
Vacating a Void Judgment
If the judgment behind a judgment lien was entered without proper service or by a court without jurisdiction, the judgment is void, and a court may set it aside at any time on motion under Code of Civil Procedure Section 473(d).22California Legislative Information. California Code CCP 473 – Relief From Judgment Vacate the judgment and the lien built on it falls with it. This is how many people resolve liens they never knew existed: a lawsuit filed, service botched, default judgment entered, abstract recorded. Prove bad service and the whole chain comes apart.
Fraudulent Liens
Recording a forged or knowingly false document with the county recorder is a felony under Penal Code Section 115.23California Legislative Information. California Code PEN 115 – Filing of False or Forged Instruments After a conviction or plea involving a fraudulent lien, the court can declare the false document void from the beginning. If a lien on your property rests on a fabricated debt or forged paperwork, report it to law enforcement and talk to an attorney about both the criminal referral and civil remedies.
Bankruptcy: A Limited Tool
Bankruptcy affects liens in two narrow ways. The automatic stay takes effect the moment the petition is filed and blocks lien enforcement while the case is pending. It doesn’t remove the lien, but it stops a forced sale and prevents new liens from attaching during the case.
Lien stripping is stronger and only available in Chapter 13. If your first mortgage balance exceeds the home’s current fair market value, a second mortgage or other junior lien can be treated as wholly unsecured and stripped, converted into unsecured debt alongside credit cards. The lien is removed permanently only after you finish the entire Chapter 13 plan, which runs three to five years. Fail to complete the plan and the lien returns. Chapter 7 does not offer lien stripping.
Record the Release and Confirm Clear Title
A release you never record isn’t much use. Until the release document is filed with the county recorder, the lien still shows on title searches and can block a sale or refinance.
For paid judgment liens, the creditor files the acknowledgment of satisfaction with the court, but confirm it also gets recorded with the county recorder. For mechanic’s liens resolved by court order, the release order itself must be recorded. Once you believe the release is recorded, order an updated preliminary title report from a title company and confirm the lien no longer appears. Title records sometimes lag or carry stale data. If a released lien still shows, send the title company a copy of the recorded release so they can clear it from their file. Fix it now, not the week of closing.
